A Behavioural Understanding of Privacy and its Implications for Privacy Law

This article draws upon social interaction theory (the work of Irwin Altman) to develop a theory of the right to privacy, which reflects the way that privacy is experienced. This theory states that the right to privacy is a right to respect for barriers, and that an invasion of privacy occurs when a privacy barrier is penetrated. The first part of the paper establishes the position of the author's theory in the existing scholarship. The second part of the paper expands upon the theory to explain the nature of privacy barriers and the way that the author's theory manages a number of specific privacy issues, including threats to privacy, attempted invasions of privacy, unforeseeable interferences with privacy and waiving the right to privacy. The final part of the paper demonstrates the impact that this approach to privacy could have upon judicial reasoning, in particular Article 8 European Convention on Human Rights.     

Reform and the politics of hybridization in mature health care states

This article examines the cases of three health care states -- two of which (Britain and the Netherlands) have undergone major policy reform and one of which (Canada) has experienced only marginal adjustments. The British and Dutch reforms have variously altered the balance of power, the mix of instruments of control, and the organizing principles. As a result, mature systems representing the ideal-typical health care state categories of national health systems and social insurance (Britain and the Netherlands, respectively) were transformed into distinctive national hybrids. These processes have involved a politics of redesign that differs from the politics of earlier phases of establishment and retrenchment. In particular, the redesign phase is marked by the activity of institutional entrepreneurs who exploit specific opportunities afforded by public programs to combine public and private resources in innovative organizational arrangements. Canada stands as a counterpoint: no window of opportunity for major change occurred, and the bilateral monopoly created by its prototypical single-payer model provided few footholds for entrepreneurial activity. The increased significance of institutional entrepreneurs gives greater urgency to one of the central projects of health policy: the design of accountability frameworks to allow for an assessment of performance against objectives.     

Socializer or Signal?, How Agency Accreditation Affects Organizational Culture

Agency accreditation has grown steadily as a management strategy in recent decades. Accreditation is meant to help professionalize public administration work by requiring an agency to adopt policies and practices that are sanctioned by an external organization. Advocates claim that accreditation facilitates the diffusion of best practices and builds a culture of professionalism in an agency. Accreditation clearly leads agencies to adopt formal policies. This article identifies two ways in which accreditation might affect organizational culture: (1) by socializing employees, and (2) by signaling the agency’s priorities to employees. Analyzing attitudinal data from officers in six American police departments, this study finds no association between accreditation and officers’ own values, but finds that accreditation is strongly correlated with officers’ perceptions of their agencies’ priorities.
