论宪政的实证评价标准

宪政的实证评价标准至少涉及到这样一些基本问题：宪法是否规定了合理的权利体系与权力结构,实现了对权利和权力的平衡配置;宪法的规定及其实施是否保证了法律创制的合法有效性,法律体系是否为政治国家和市民社会提供了必要的法律生活模式;国家权力能否得到有效的控制;司法是否具有独立性,人权是否获得切实的司法保护。     

依间接证据认定协同行为的证明结构

作为垄断协议的一种高级形式——协同行为,其在实施中往往不会遗留直接证据。如何利用间接证据来证明公司间的价格行为属于协同行为成为现代各国反垄断机构的挑战性的课题。利用欧美等国家(地区)的相关判例,并借助于间接证据的特殊分类及在分类证据组合上的特殊性来推定某些行为属于卡特尔,是解决这一难题的有效方法。     

我院新生英语现状分析与教学对策

笔者以2009级新生两个专业、83名学生作为教学对象,通过问卷调查等形式,对学生的英语基础知识水平等情况作了充分的了解,制订出教学对策,并在教学实践中着重培养学生自主学习能力,收到初步成效。     

MDCK细胞感染犬细小病毒后的差异表达谱分析

通过了解MDCK细胞感染犬细小病毒(CPV)后基因表达水平的差异,研究病毒对细胞的致病作用以及细胞抵御病毒感染的机制。利用表达谱基因芯片技术,分析持续感染犬细小病毒的MDCK细胞基因表达水平的变化情况,并用Real-Time PCR技术加以验证。结果显示,获得了359个差异大于1.5倍的表达基因(P0.05),占总基因数的1.53%,其中193个上调表达(0.84%),166个下调表达(0.69%)。对差异基因进行GO功能聚类分析,小部分涉及免疫应答、生长周期调控、信号转导和蛋白酶活性,其他大部分基因功能未知。利用Real-Time PCR随机验证5个基因在持续感染CPV后的差异表达,其结果和芯片杂交的结果一致。表明建立了MDCK细胞持续感染CPV后的差异表达谱,初步了解到CPV对宿主细胞的制约作用,引起部分细胞增殖调控相关基因发生了表达下调,以及细胞对感染的积极应答反应,部分免疫反应基因、肽链内切酶活性基因等发生了上调表达,从而为探索病毒的致病机理和宿主的抗病毒途径提供了试验基础。     

Isolation and characterisation of a novel sildenafil analogue adulterant,desmethylpiperazinyl propoxysildenafil,in a dietary supplement

A new sildenafil analogue was detected during routine screening of dietary supplements suspected to be adulterated with an erectile dysfunction drug(s) using HPLC-DAD. The UV spectrum of this compound was highly similar to that of sildenafil and almost identical to that of desmethylpiperazinyl sildenafil. The analogue was purified by using semi-preparative HPLC and structurally elucidated by performing mass spectrometric and NMR spectroscopic experiments. The spectral data revealed that this sildenafil analogue bears an n-propoxy group instead of an ethoxy group and possesses no methylpiperazinyl moiety. The isolated compound, structure of which was further confirmed by spectral comparison with synthetic one, was thus named as desmethylpiperazinyl propoxysildenafil.     

台湾当局自由贸易协议实践的亚太转向及其前景

自20世纪90年代以来,为因应全球区域一体化的浪潮,台湾当局力推自由贸易协议（FTA）战略,但成效不佳。2008年马英九执政后,两岸关系在“九二共识”的基础上得以缓和并稳步发展,台湾参与区域经济一体化的问题被重新提上议事日程。当前,台湾当局的FTA战略目标逐渐从传统的中南美洲“友邦”逐渐转向亚太地区,从单纯的“政治驱动型”向“政治经济平衡型”特征转变。未来,台湾当局FTA实践的进展,并不单纯取决于台湾当局作为世界贸易组织成员的身份,更取决于两岸经济整合的深度和两岸政治互信的程度。台湾当局FTA实践的经验,对于未来参与TPP同样具有借鉴意义。     

竞业限制协议履行中的若干法律问题研究

劳动者解除竞业限制约定的前提,是竞业限制期限内用人单位未支付经济补偿已达三个月;劳动者应在用人单位迟延支付经济补偿时进行催告,并在三个月后通知其解除竞业限制约定;用人单位解除竞业限制协议,必须采取劳动者知道或应当知道的方式;劳动者解除竞业限制约定后,还可求用人单位支付拖欠的经济补偿金。     

Interdoc and West European Psychological Warfare: The American Connection

Interdoc, or the International Documentation and Information Center, was established in The Hague in early 1963 in order to coordinate a transnational network of institutes active in the field of analysing trends in communist ideology and societies. The product of deliberations between intelligence agencies and the private sector in Western Europe during the late 1950s, Interdoc reflected a need to develop and project a European stance on Cold War issues separate from an all-dominant US influence. Yet the Americans were present from the beginning, and their involvement gradually increased over time. This article covers the details of this involvement and uses it to comment on how Interdoc represents an interesting case of inter-service cooperation in anti-communist activities in the West.     

Participatory development and empowerment: The dangers of localism

Recent discussions in development have moved away from holistic theorisation towards more localised, empirical and inductive approaches. In development practice there has been a parallel move towards local ‘participation’ and ‘empowerment’, which has produced, albeit with very different agendas, a high level of agreement between actors and institutions of the ‘new’ Left and the ‘new’ Right. This paper examines the manifestations of this move in four key political arenas: decentralised service delivery, participatory development, social capital formation and local development, and collective actions for ‘radical democracy’. We argue that, by focusing so heavily on ‘the local’, the see manifestations tend to underplay both local inequalities and power relations as well as national and transnational economic and political forces. Following from this, we advocate a stronger emphasis on the politics of the local, ie on the political use of ‘the local’ by hegemonic and counter-hegemonic interests.     

和谐社会的宪政学解读——关于不断提高我党构建社会主义和谐社会能力的几点思考

中国市民社会发育发展与政治国家的关系决定了和谐社会状态的实现必然地要表现出与西方社会不同的发展路径。市民社会的和谐与政治国家的互动及政治国家的理性运作是社会和谐状态实现的重要前提条件;西方社会中的政治国家是从市民社会中分离出来的,与之不同的是,中国市民社会与政治国家之间的关系却表现为市民社会从政治国家中分离出来;中国封建社会至今的国家高度中央集权、市民社会发育不成熟的客观历史,决定了中国和谐社会的建构进路必然地不同于西方社会,和谐社会的建构进路必然地要表现为伴随着法治国家建设进程的不断深化,采取由执政党政策指导的国家引导型,主要靠政府自律实现社会和谐的实际进路。
