Parenting without Protection: How Legal Status Ambiguity Affects Lesbian and Gay Parenthood 下载免费PDF全文
Through the lens of lesbian and gay parenthood we ask how individuals who experience “legal status ambiguity”—that which emerges when legal fluctuations combine with divided attitudes, ignorance of the law, and autonomous institutional gatekeepers—exercise their legal rights and responsibilities. The results from thirty‐one interviews with lesbian and gay parents in Oregon and their six adult children suggest that the state's fluctuating legal and social climates for lesbian and gay parenting between 1985 and 2013 presented significant challenges for two generations of same‐sex parents. Although both cohorts created and utilized a range of legal and social mechanisms to assert their legal rights, they found these rights to be controlled as much by gatekeeper perspectives as by legal force. After the 2015 Obergefell ruling on marriage equality, lesbian and gay parenting status remains a site of ongoing legal and social contestation, providing insight into the risks and challenges of legal status ambiguity. 相似文献

Abstract A significant change in the finance of social housing in the 1980s was a movement to transfer responsibility for funding to the private sector. This article argues that governments must continue to be involved in social housing finance as this movement progresses. Financing initiatives undertaken in Australia are used to signal the risks associated with the provision of social housing finance, to illustrate the mechanisms employed to manage these risks, and to highlight the conflicts that arise when a mix of public and private funding is attempted. The article proposes the introduction of “equity bonds” as an innovative way to raise funds for social housing and to overcome inefficiencies arising from the present complex and costly administrative structures. However, a commitment to ongoing subsidies to close the full rental gap is necessary for equity bonds to serve those most in need. 相似文献

The issue in bureaucracy and democracy is one of control. This paper calls for greater control resources for elected officials whereby they can overcome the abundant power resources of bureaucrats. A process of exchange as against a process of authority is suggested as a strategic means of democratic control over bureaucracy. Successfully meeting the challenge of reconciling deeply cherished norms of popular control with dependence on appointed administrators requires acknowledgement not only of the rights of the controllers but also of the powers of the controlled.(1) It requires thinking strategically about creating and marshaling alternative resources to counteract the abundant resources bureaucrats have, to circumvent control for both selfish and public spirited reasons. In the context of drastic cutbacks many Dutch municipalities consider citizens’ initiatives (CIs) as an attractive alternative for municipal policies aimed at improving the livability and safety in neighbourhoods, simultaneously building responsible citizenship. In this paper we combine different theoretical perspectives to analyse the institutional settings in which CIs are being realised, and how municipalities try to facilitate such initiatives. Municipalities can do this by either trying to structure the relevant networks or by various forms of process management. This analysis sheds light on how municipalities use a variety of instruments to mobilise citizens to participate in CIs. In using such instruments they can influence various factors (like motivations, personal resources, social capital and expected responsiveness; cf. Lowndes et al.’s CLEAR model) that increase the likelihood of civic engagement. 相似文献

Using Barcelona as a case study, this article examines the relationship between local governance and local democracy. It begins with the terms of the debate and continues by identifying the context in which a particular model of governance arose in Barcelona. The article then looks at the extent to which governance fosters democracy, by strengthening the role of civil society organisations in government and creating new spaces of deliberation between the state and the citizenry. The final section examines the limitations of Barcelona's model of local governance in enhancing local democracy. The key finding is that the predominant role of the local council in facilitating citizen participation has as many strengths as it has weaknesses. Over the last decade the issue of transitional justice has attracted considerable media and academic attention. Diverse countries including such high profile cases as Chile, South Africa and the former East Germany have attempted to grapple with the complex question of how to respond to human rights abuses committed under a previous regime. Transitional justice generally surfaces as an issue during democratic transition. It is less common for this issue of past human rights abuses to be raised when democratic transition has been completed and democracy is fully consolidated. The subject of this article, however, is Spain, where the human rights abuses committed during the 1936–39 civil war, and the long Francoist dictatorship that followed, have only recently come to the fore, a full quarter of a century after the transition to democracy. The article argues that the current struggle to recover the bodies of the disappeared, and their historical memory, represents a significant case which not only provides new insights into the particular democratization process in Spain but also provides more general lessons for other countries grappling with similar problems. 相似文献

AbstractPrompted by the rise of the emerging economies and the growing importance of the G20, the OECD has formally announced its intention of establishing itself as a key actor in global policy coordination. As part of this ambition, it has embarked on cultivating closer relations with five G20 countries it designated as key partners through the so-called “Enhanced Engagement” programme: Brazil, China, India, Indonesia and South Africa. This article mobilizes concepts from the policy transfer literature to explain why the OECD’s attempts to increasingly involve all five countries in its policy have fallen short of its original ambitions, and also why the transfer of its policy work has been uneven across policy and country issue. 相似文献

Social values and status cause diverse obstacles for escaping abuse (e.g., belief in the sanctity of marriage vs. financial
necessity to stay for survival). India provides a unique opportunity to explore the interplay of status and corresponding
patriarchal values in relation to the incidence of domestic violence and how it is viewed, coped with, and psychologically
impacting native women. Sixty-four women of Tamil Nadu, India were surveyed. Women of higher status were found to be less
likely to acknowledge abuse as a societal problem, accurately identify abuse events, and seek help or report abuse. Women
who had more realistic conceptions of abuse were more likely to seek help but also likely to experience more severe psychological
distress. All of the women surveyed had symptoms of post-traumatic stress disorder that were exacerbated by unsuspected variables.
The implications of these findings are discussed in light of public health strategies. 相似文献
