Nondemocratic nonplanning: The French experience

During the de Gaulle and Pompidou regimes, the French executive claimed that its Economic and Social Development Plan fitted an ideal model of democratic planning. It was democratic in both process and substance, devised after wide consultations, and designed to pursue the welfare of the nation as a whole. It also met the standards of planning, outlining a coherent set of actions which could realistically be taken during each planning period, and which were rationally calculated to further carefully-defined long-term aims. An analysis of the preparation process and of the quality of the Plan as written and executed, however, indicates that it did not meet the standards of either democracy or planning. The conclusion of the paper expresses serious doubt about the possibility of ever achieving the ideal of democratic planning in France.This article was written while the author was an Assistant Professor of Political Science at the University of Connecticut. Public management and productivity towards an appraisal of the productivity of alternative forms of public service delivery

Although independent administrative units are used worldwide as alternate forms of public service delivery, only limited systematic knowledge is available as how to apply these organisational forms with the maximum positive effects. This paper aims to explore the productivity gains achieved by administrative units increasing their degrees of independence, shifting from organisational independence to budgetary and legal independence. Focusing on self-operating decentralised units, on public law enterprises and on publicly owned private law enterprises, this appraisal reveals that continuously increasing independence is accompanied by productivity gains, but, depending on varying service delivery conditions--in terms of divergent service concepts or notions of productivity--this may be in terms of quality of output, technical efficiency or allocative efficiency.

Consequently, in order to make the best possible organisational choice, a contingency model has to take into consideration that alternative forms of service delivery find their maximum positive effects not only under varying task contexts but equally in the pursuit of different productivity targets.     

The Expected Impact of State Immigration Legislation on Labor Market Outcomes

In response to the dramatic rise in the number of unauthorized immigrants to the United States, every state has passed some form of immigration legislation. These laws appear to be predicated on a belief that unauthorized immigrants impose greater costs than benefits to state and local communities, including the labor market. The purpose of this paper is to examine some evidence on what workers should expect if the immigration legislation is successful in eliminating undocumented workers from states' labor markets. © 2012 by the Association for Public Policy Analysis and Management.     

On Naturalizing Jurisprudence: Some Comments on Brian Leiter’s View of What Jurisprudence Should Become

In a series of powerful and challenging articles emerging since the mid-1990s, Brian Leiter has argued that certain theoretical strains in contemporary legal philosophy are ‘epistemologically bankrupt’, in virtue of their reliance on misguided argumentative devices: analysing concepts, such as the concepts of law and of authority; and doing so by appealing to intuitions regarding the correct way to understand the concepts in question. In response to this state of affairs, Leiter advocates that jurisprudence ought to attempt to catch-up with ‘naturalistic’ developments which have influenced the direction of other branches of philosophy – such as epistemology, philosophy of mind, and moral philosophy – in the last few decades. This article offers a critical analysis of some of Leiter’s proposals for what Jurisprudence should become, in light of his views on the relevance of naturalism for this discipline.     

Examining a Strategy for Improving Candidate Perceptions of Test Fairness

Candidate perceptions of test fairness have significant consequences for organizations. However, little attention has been directed toward interventions that may promote favorable reactions, despite recognition that the identification of such management practices is important. The current study investigated a strategy designed to improve candidate reactions—field vetting of items. This strategy involves comprehensive test item review sessions with a variety of applied subject matter experts. The extent to which the field vetting process resulted in more favorable reactions among police officers vying for promotion was investigated using a naturally-occurring quasi-experimental design. Results showed support for the field vetting process to improve reactions to high-stakes tests.
