The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) is extremely complicated. Adding to this complexity is the near impossible task of predicting how settlements will be credited. In most tort cases, courts use the pro tanto approach and give the remaining defendants a dollar-for-dollar credit for settlement amounts received by the plaintiff. However, the trend in CERCLA cases is to forego the pro tanto approach and give the remaining defendants credit for the settling defendants’ proportional, or pro rata, share of the liability. Ethnic civil wars tend to spread to adjacent countries, yet the processes whereby diffusion takes place remain obscure. Quantitative studies point to a wide range of factors and dynamics that drive ethnosectarian conflicts across international borders with no consensus regarding the causal potency of these variables or the ways in which they interact with one another. Surveying the most influential theories that have been advanced so far clarifies the logic of disparate arguments and offers hypotheses that can be tested against particular cases. The civil war in Syria represents one notable instance in which fighting along ethnosectarian lines provoked a revival of political violence in a neighboring state, the Turkish Republic. Established as a distinct academic discipline at the end of the second world war, International Relations has above all been concerned with analysing relations between sovereign states - in the first instance, the causes of war between them and alternative forms of cooperation. Throughout its history, IR has been dominated by 'realism', an approach based on a juridical totalizing concept of the state. This denies the relevance of factors located within polities and societies and stresses the primacy of security issues in inter-state relations. More recent work in the field has sought to analyse the interaction of the domestic and the international and to explore the interaction of security with other, most evidently economic, factors. The relation of 1R to political science is defined by the shared concern with the 'pertinence' of the international; that is, how far specific political and social systems are, and are not, affected and determined by factors beyond their frontiers and how these forms of international influence are changing in the contemporary world. 相似文献

Since Mancur Olson's Logic of Collective Action (1965), it is impossible for political scientists to conceive of political participation without reference to his powerful argument linking numbers of participants, public goods, and participatory outcomes. What is puzzling is the poor empirical support for this argument in the domain where it should work best, namely explaining business political activity. Olson thought his arguments principally applicable to economic groups, and for the empirical development of his arguments Olson drew heavily on business interests, the most active segment of the interest group community. We explore these arguments with business political activities data by examining the statistical performance of various measures of market structure in determining business political activity, and find little empirical support. We do offer an alternative basis for business behavior lodged in both private and collective goods that preserves business rationality and also helps explain not only the amount of business political participation but the modes of business participation . 相似文献

During recent decades, various versions of market practices have, in most nation states, diffused into the public sector. We analyse variations in the adoption of market ideologies and examine plausible explanations for these variations. Four managerial ideal types are constructed, based on their attitudes towards two dimensions of market ideology. Managerial attitudes and perceptions are conceived as embedded in a global process of diffusion highly affected by varying institutional preconditions.
