Legal context. Massively multiplayer online role-playing games(MMORPGs) are a craze that has swept the globe. Online gamershave been reported to spend 22 hours per week online playingtheir favourite games while there have been reports of playersspending up to 55 hours at a time playing. Not all gamers arehobby gamers, nor are they just teenagers having fun. A markethas grown around MMORPGs and a lucrative online market has emergedoutside the games for the sale of game characters and items.The value of this market has been estimated at US$880 million.At the heart of disputes concerning the sale of game charactersand items is the question of copyright ownership. Game providersclaim that the End User Licence Agreements (EULAs) give themintellectual property ownership and rights over any dealingswith the game characters and items. Many gamers on the otherhand are abhorrent at the assertion that they have no claimto characters and items that they have spent many hours developing. Key points. The first issue that needs to be considered is whethercopyright subsists at all in the game characters and items.The next question to be considered is who owns the copyrightin in-game characters and items. To answer the question, onemust look to the EULAs, but the EULAs do not provide all theanswers because issues such as moral rights cannot be governedby EULAs. Further, the practice of farming by companies runningdigital sweatshops complicates the relationship between gamersand game providers. Practical significance. There have been numerous disputes concerningthe game characters and items between game developers, gamers,and farming companies. This article examines the key copyrightissues at stake.  相似文献

The present study examined the risks and needs of status offenders in comparison to an at-large juvenile court sample, with specific attention paid to factors related to gender and ethnicity. Status offenders displayed significantly higher risk scores than the comparison sample in domains associated with both family and parenting concerns and educational concerns. In addition, females displayed higher risk levels than males and White youth displayed significantly higher risk levels than minority youth across a wide variety of risk domains. Further analyses were conducted regarding the participation of African American males and females in a program designed as an alternative to detention. For both groups, successful program completion was accompanied by little or no further court involvement, whereas failure to complete the program was related to a variety of negative outcomes. However, African American females and males successfully completing program requirements displayed different risks and needs at the outset of their participation.  相似文献

Wherever an impact mark is found, either on the surface or on the recovered projectile, it is important for forensic investigators to extract useful information in solving shooting-related cases. This article reviews a collection of works on examination of impact marks upon striking of projectiles on inanimate objects, emphasizing on the retrievable information from a shooting scene and their forensic significance in shooting event reconstruction. Literature suggested that impact marks on target surfaces and the degree of deformation on striking projectiles vary according to different combinations of ammunition and surface materials. It was noted that conditions in real-case scenarios further differed unpredictably in comparison with controlled studies, where forensic investigation should be treated as case-specific basis. Furthermore, the way forensic science is researched and applied operationally has to be reconsidered to reduce the gap via translational approach for more effective use of forensic evidence.  相似文献

Intraosseous T1-weighted (T1W) and short-tau inversion recovery (STIR) magnetic resonance imaging (MRI) signal intensity changes—so-called bone marrow edema—may be able to differentiate antemortem and postmortem fractures in human forensic imaging. The primary objective of this study was to investigate this hypothesis using an animal model. Three juvenile Landrace pigs were anesthetized and underwent MRI of both tibiae and both radii using a 1.5 T magnet. T1W, T2-weighted (T2W), STIR, and T2* sequences were included. Antemortem fractures were induced in both tibiae and postmortem fractures in both radii, and MRI was repeated. Two board-certified radiologists blinded to fracture group jointly evaluated the images for intraosseous and soft tissue signal intensity changes. Sensitivity (Se) and specificity (Sp) in identifying antemortem fractures were calculated based on intraosseous, soft tissue, and combined intraosseous and soft tissue signal intensity changes. Intraosseous and soft tissue signal intensity changes, when present, were hyperintense in all sequences. Intraosseous hyperintensity in T1W and T2W sequences yielded Sp of 100% for antemortem fractures. Regardless of sequence, soft tissue hyperintensity was comparatively more sensitive than intraosseous hyperintensity. Sensitivity for each sequence could be maximized by assessment of soft tissue and intraosseous hyperintense signals together; for the T1W sequence, such assessment optimized diagnostic utility yielding a Se of 100% and Sp of 83%. In summary, MRI—particularly the T1W sequence—can differentiate antemortem and postmortem fractures and may be a useful adjunct to the forensic analyses of fractures.  相似文献

Greater empirical attention directed toward gender-sensitive assessment strategies that concentrate on family-specific factors is thought to be both timely and necessary, especially with regard to outcome variables associated with mental health and substance abuse in at-risk adolescent populations. A sample of 2,646 court-involved adolescents was used to test two competing models regarding relationships among disruptive family processes, mental health (as both internalizing and externalizing problems), and substance abuse issues according to gender. The results of multiple group structural equation modeling procedures indicated that disrupted family processes were significantly associated with higher levels of internalizing problems, externalizing problems, and substance abuse in both male and female youth. For females, however, disrupted family processes were more related to internalizing problems and substance abuse than externalizing problems. Further, the relationship between disrupted family processes and substance abuse was not mediated by mental health issues, indicating a lack of support for the alternative model tested in this study. Together, the findings underscore the primacy of the family’s impact on issues related to adolescent development and well-being in tandem with the need for a more gender sensitive approach to the needs of court-involved males and females.

Her major research interests include gender and ethnic differences in risks and needs among court-involved youth, parent–adolescent relationships across cultures, and the influence of neighborhood settings on peer and family risks among juvenile delinquents. Courtney M. Yarcheck   is the Program Director at The Ohio State University Center for Family Research. She received her M.S. in Family Science from The Ohio State University. Her major research interests include gender-specific issues in the assessment of court-involved youth and the use of the Internet in training juvenile justice professionals. Jennifer M. Bostic   is the Program Manager at The Ohio State University Center for Family Research. She received her M.S. in Counselor Education from The Ohio State University. Her major research interests include the impact of gender and race on the mental health of court-involved youth. Scott D. Scheer   is an Associate Professor and State Extension Specialist in the Department of Human and Community Resource Development, and is Co-Director of the Center for Family Research at The Ohio State University. He received his Ph.D. in Family Studies from the University of Delaware. This study compared utilized coefficient of friction (COF) measured during nonslip pedestrian gait to estimated utilized COF values calculated using anthropometric (i.e., leg length) and stride characteristic data (i.e., impact angle, step length). Twenty healthy adults walked at slow, medium, and fast speeds with kinematic and kinetic data recorded simultaneously. Estimated and measured impact angle varied with walking speed, with greater angles evident with faster speeds (p < 0.001 and p < 0.05, respectively). The estimated impact angle was greater than the measured impact angle (p < 0.05). Estimated and measured peak utilized COF values varied with walking speed, with higher utilized COF values evident with faster speeds (p < 0.001 and p = 0.001, respectively). Estimated utilized COF values were 86, 118, and 131% greater than measured peak utilized COF values for slow, medium, and fast speeds, respectively (p < 0.001). Higher estimated utilized COF values varied moderately with increased measured peak utilized COF values (r = 0.522; p < 0.001). These data suggest that impact angle and step length alone cannot be used to accurately assess the utilized COF on level walking surfaces.  相似文献

Allele frequencies for the 13 CODIS STR loci included in the AmpFISTR Profiler Plus and AmpFISTR Cofiler kits (Applied Biosystems, Foster City, USA) were determined in a sample of 209 unrelated Chinese in Singapore. The combined random match probability for the 13 loci is about 6.6 x10(-15) and the overall probability of excluding paternity is 0.9999899. The results demonstrate that the loci are useful for forensic human identification and parentage testing for the Chinese population in Singapore.  相似文献

Quality assurance is one of the major issues in forensic analytical laboratories, where the need for a reference material (RM) has rapidly increased. RMs are very useful for method development and validation, internal quality control or proficiency tests. In the present study, we prepared a RM using drug-free hair for the determination of methamphetamine (MA) and its main metabolite, amphetamine (AP) according to the recommendations of ISO Guide 35. The concentrations of MA and AP were determined using two extraction methods, agitation with 1% HCl in methanol at 38 degrees C and ultrasonication with methanol/5M HCl (20:1), followed by gas chromatography/mass spectrometry (GC/MS) after derivatization with trifluoroacetic anhydride (TFAA). The assignment of values was conducted through the homogeneity study and characterization of the material. Furthermore, an internal proficiency test was performed with the prepared RM, of which the results were compared with those of the authentic hair RM prepared in our previous study. As a result, a hair RM containing MA and AP was prepared at the level of 4.86+/-0.69 ng/mg and 4.63+/-0.44 ng/mg, respectively. Most participants showed satisfactory performances in the internal proficiency test with the both RMs. The hair RM prepared in this study demonstrated its suitability for quality assurance in forensic laboratories.  相似文献
