Virtual war and repolitization in visual culture

This article discusses Andrew Hill's book Re-imagining the war on terror with a special attention to the unconscious mental dimension of the conflict. Clarifying this symbolic, signifying dimension can help us to traverse the fantasies that we are so easily trapped in. Thus it opens the way for introducing a moral and political position in the War on Terror and in visual culture in general.     

Ethical aspects of scientific progress

Ethics and science are much more closely connected than some people assume. Erroneous perceptions of the nature of ethics are the probable cause of this. Ethics is an intrinsic and productive component of scientific work, not some external or retrospective obstruction of “real” scientific research. The ethical component is positively influenced by a thorough knowledge of the discipline it belongs to. Science thrives in a climate of freedom, but this must not be used as an alibi to circumvent social responsibility and ethical concern. Ethical science has a direct bearing on science policy. Giving due attention to the ethical aspect of scientific work leads to several tangible results. It increases interdisciplinary openness, it promotes the communicability of science, and, ideally, it demonstrates the difference between knowledge and wisdom. Shells and Bones: A Forensic Medicine Study of the Association of Terrestrial Snail Allopeas micra with Buried Human Remains in Brazil

Little is known regarding the scavenger fauna associated with buried human corpses, particularly in clandestine burials. We report the presence of 20 shells of the terrestrial snail Allopeas micra, within hollow bones of human remains buried for 5 years, during the process of collecting DNA material. The fact that a large number of shells of A. micra had been found in the corpse and in the crime scene supports the assumption that there was no attempt to remove the corpse from the area where the crime occurred. Despite this, our observations cannot be used to estimate the postmortem interval because there is no precise knowledge about the development of this species. This is the first record of a terrestrial snail associated with a human corpse and its role in this forensic medicine case.     

Generating a Corpus of Mobile Forensic Images for Masquerading user Experimentation

The Periodic Mobile Forensics (PMF) system investigates user behavior on mobile devices. It applies forensic techniques to an enterprise mobile infrastructure, utilizing an on‐device agent named TractorBeam. The agent collects changed storage locations for later acquisition, reconstruction, and analysis. TractorBeam provides its data to an enterprise infrastructure that consists of a cloud‐based queuing service, relational database, and analytical framework for running forensic processes. During a 3‐month experiment with Purdue University, TractorBeam was utilized in a simulated operational setting across 34 users to evaluate techniques to identify masquerading users (i.e., users other than the intended device user). The research team surmises that all masqueraders are undesirable to an enterprise, even when a masquerader lacks malicious intent. The PMF system reconstructed 821 forensic images, extracted one million audit events, and accurately detected masqueraders. Evaluation revealed that developed methods reduced storage requirements 50‐fold. This paper describes the PMF architecture, performance of TractorBeam throughout the protocol, and results of the masquerading user analysis.     

Das Erste Gesetz zur Änderung des Bundesnaturschutzgesetzes – Ein Ende der Debatte um den europäischen Artenschutz?

Zusammenfassung  Mit der letzten Novellierung des Bundesnaturschutzgesetzes verfolgte der Gesetzgeber die Intention, die vom Europ?ischen Gerichtshof angemahnten Defizite bei den artenschutzrechtlichen Vorschriften im Bundesnaturschutzgesetz zu beseitigen. Dieses Ziel hat der Gesetzgeber im Ergebnis erneut verfehlt. So besteht auch nach der Novellierung weiterhin erhebliche Rechtsunsicherheit bei der Realisierung von Vorhaben und die Bundesrepublik Deutschland l?uft überdies Gefahr, erneut durch den Europ?ischen Gerichtshof verurteilt zu werden. Der Beitrag stellt zun?chst die artenschutzrechtlichen Anforderungen der FFH- und Vogelschutzrichtlinie dar, um sodann anhand der neuen artenschutzrechtlichen Vorschriften im Bundesnaturschutzgesetz Defizite bei der Umsetzung des europ?ischen Artenschutzes in das deutsche Recht aufzuzeigen.     

Disobedience and Criticism. The Ethos of Ombudsman's Institution and the "East-European Revolution of Human Rights"

The commissioners of human rights in the Parliament aim at ensuring the protection and formation as well as the development of the culture of human rights with their activities in Hungary and all over the world. What else could be done by the citizens practising their disobedience during the non-violent revolutions in 1989 after Mahatma Gandhi, Martin Luther King and the American Henry David Thoreau? At a first glance, it perhaps seems to be strange to put the following question: what is the connecting link between the role of political law of a public state and the citizens breaking the rules in order to protect the constitutional rights? What will be the result of this comparison? I think, the result is that we can recognize the role of both functions more thoroughly in operating the constitutional state suitably in order to protect the culture of constitutional rights (reactive role) and to develop them (proactive role).     

Constitutional Law in Twenty Years from Now

The principles of constitutional law as those of many other disciplines seem to develop and to be replaced by new paradigms in the light of globalization. The present article using the genre of constitutional futurology attempts to determine whether this change is real or an illusory impression, and to predict the future of constitutional law and of scholarship reflecting on constitutional issues. A mighty forecast emerges from the interplay of opposing forces. While the withering away of the constitutionalist paradigm is unlikely partly because of the lack of a new generation of legal scholars following new patterns of thinking, partly because there is no reason to assume that the prevalent socioeconomic order would cease to exist , the essay maps a number of possible challenges like genetic engineering or personal computers interconnected in the World Wide Web , which constitutionalists shall expect to face in theory and in practice alike.
