In this article we develop a new model of bodily integrity that we designate ‘embodied integrity’. We deploy it to argue that non‐therapeutic interventions on children should be considered within a decision‐making framework that prioritizes embodied integrity. This would counter the excessive decision‐making power that law currently accords to parents, protecting the child's immediate and future interests. Focusing on legal responses to genital cutting, we suggest that current legal understandings of bodily integrity are impoverished and problematic. By contrast, adoption of an ‘embodied integrity’ model carves out a space for children's rights, while avoiding these negative consequences. We propose that embodied integrity should trump competing values in any best‐interests assessment where a non‐therapeutic intervention is requested. Drawing on Drucilla Cornell and Joel Feinberg's theories we argue that protecting a child's embodied integrity is essential to guarantee his/her right to make future embodied choices and become a fully individuated person.  相似文献

This paper explores the motivations for and processes of a unique multi‐stakeholder collaboration aimed at the long‐term sustainable development of a region. The region is that of Australasia's largest lake, Lake Taupo, New Zealand. Lake Taupo has geographic features that have not only enabled the development of a strong economy based on tourism, forestry and agriculture but have also generated particular environmental problems. The findings of the case study present highly innovative solutions that are premised on collaboration and on a ‘business case’ for sustainability. From extensive interviews with a wide range of stakeholders, the case confirms extant literature that looks at the roles of leadership, stakeholder engagement, and first movers in bringing about change, but it also highlights further findings that include the surprisingly important role of fringe stakeholders, the difficulties presented by uncertain regulation, and the need to innovate in tailoring solutions to fit the peculiarities of a specific problem. Lobbyists frequently join forces to influence policy, yet the success of active lobbying coalitions remains a blind spot in the literature. This article is the first to test how and when characteristics of active coalitions increase their lobbying success. Based on pluralist theory, one can expect diverse coalitions, uniting different societal interests, to signal broad support to policy makers. Yet, their responsiveness to this signal (i.e., signaling benefits) and contribution incentives within the coalition (i.e., cooperation costs) are likely to vary with issue salience. This theory is tested on a unique data set comprising 50 issues in five European countries. Results reveal a strong moderating effect of salience on the relationship between coalition diversity and success: On less salient issues, homogenous coalitions are more likely to succeed, whereas the effect reverses with higher salience, where diverse coalitions are more successful. These findings have implications for understanding political responsiveness and potential policy capture.  相似文献

Xenotransplantation - the transfer of living tissue between species - has long been heralded as a potential solution to the severe organ shortage crisis experienced by the United Kingdom and other 'developed' nations. However, the significant risks which accompany this biotechnology led the United Kingdom to adopt a cautious approach to its regulation, with the establishment of a non-departmental public body - UKXIRA - to oversee the development of this technology on a national basis. In December 2006 UKXIRA was quietly disbanded and replaced with revised guidance, which entrusts the regulation of xenotransplantation largely to research ethics committees. In this article we seek to problematize this new regulatory framework, arguing that specialist expertise and national oversight are necessary components of an adequate regulatory framework for a biotechnology which poses new orders of risk, challenges the adequacy of traditional understandings of autonomy and consent, and raises significant animal welfare concerns. We argue for a more considered and holistic approach, based on adequate consultation, to regulating biotechnological developments in the United Kingdom.  相似文献

While reasons for returning to abusive partners have received considerable attention in research on intimate partner violence, few studies have examined the reasons why victims fail to follow through with the protection order process, regardless of whether or not they return to their abusive partners. Fifty-five women who were in the process of withdrawing a protection order against a male intimate partner were surveyed in the present analysis. Recognizing that reasons given for withdrawing a protection order often follow common themes, individual responses were organized into several “domains,” or groupings of such reasons. The most commonly cited domain involved a “concrete change” on behalf of the victim or defendant, which made the protection order less necessary in the victim’s view. This was closely followed by the domain addressing emotional attachment to the abuser. Implications for future research and policy are discussed.  相似文献

Sommaire: La proximité du ministre pour les directeurs de cabinet ministériel, leur accès à des informations stratégiques et sensibles et leur possibilité d'influencer le ministre ainsi que les hauts fonctionnaires sur des décisions de nature politique ou administrative, sont parmi les facteurs qui expliquent l'importance des rôles qu'ils peuvent jouer dans la gestion des ministères et organismes gouvernementaux. Pourtant, on trouve relativement peu d'écrits sur le sujet et les études sur le personnel politique datent de plusieurs années. À partir d'une enquête et d'entrevues réalisées avec des directeurs de cabinet du gouvernement du Québec ainsi qu'avec des sousministres, cette étude trace un portrait des principales caractéristiques des directeurs de cabinet ministériel. Elle examine la façon dont ils assument leurs fonctions et la nature des relations qu'ils entretiennent avec le ministre, le personnel du cabinet qu'ils dirigent et l'administration. Abstract: Proximity to the minister, access to strategic and sensitive information, and the ability to influence the minister and senior public servants in decision‐making are among the factors that explain the importance of the role of chief of staff to the minister in the management of ministries and government organizations. The literature on the subject, however, is relatively limited, and available studies on political staff are several years old. Based on a survey and interviews with chiefs of staff and deputy ministers in the Quebec government, this study describes the main characteristics of chiefs of staff. It examines the way they carry out their functions and the nature of the relationships they have with the minister and the staff that they manage.  相似文献
