Deepwater or Troubled Water? Principal–Agent Theory and Performance-Based Contracting in the Coast Guard’s Deepwater Modernization Program

In the mid-1990s, the United States Coast Guard began planning a modernization effort known as the Deepwater program to replace an aging inventory of cutters, aircraft, and small boats. This effort involved a consortium of corporations to develop a “system of systems” to meet performance-based requirements and build the new equipment. This article examines the Deepwater program through the lens of multilayered principal–agent theory and evaluates the performance-based contracting (PBC) method used to alleviate strains linked to accountability from the principal–agent relationship. The findings help better understand the dilemmas prescribed from multilayered principal–agent theory and PBC by illustrating the accountability issues faced by smaller organizations when engaging in complex, large-scale procurement.     

Association for Conflict Resolution Guidelines for Eldercaring Coordinators

On November 6, 2014, the AFCC Board of Directors endorsed the Association for Conflict Resolution (ACR) Guidelines for Eldercaring Coordination, including ethical principles for Eldercaring Coordinators, training protocols, and court pilot project template. The collaboration between Task Forces created by ACR and the Florida Chapter of AFCC, composed of twenty U.S./Canadian and twenty Florida‐wide organizations, produced both an overarching guide to assist in the development of programs and a more detailed model addressing state/province‐specific needs and characteristics. Eldercaring coordination is a dispute resolution option specifically for high‐conflict cases involving the care, needs, and safety of elders.

Key Points for the Family Court Community:
• There are currently no dispute resolution options for parties involved in high‐conflict cases regarding the care, needs, and safety of an elder.
• The ACR Guidelines for Eldercaring Coordination address the discrepancies between dispute resolution options available for parents in conflict regarding their minor children and mature families with unresolved concerns about the care, needs, and safety of an elder.
• The ACR Guidelines for Eldercaring Coordination provide information regarding the ethical practice of eldercaring coordination including a specific definition, recommended qualifications, ethical practices, grievance procedures, training protocols, and a court pilot project template.
• The practice of eldercaring coordination will address the influx of court cases expected as baby boomers continue to age, reducing delays in court hearings, as parties will have the opportunity to resolve their concerns without continuous court attention.
• As of June 2015, five states began Pilot Projects on Eldercaring Coordination, which will be studied by an independent research group to enhance the progress of the process and to develop the best practices for initiating the programs elsewhere.

Squaring the circle: domestic welfare,migrants rights,and human rights

Domestic welfare reform and the management of international migration in Britain have been described by David Cameron as ‘two sides of the same coin’. Heightened conditions and sanctions for the benefit-dependent domestic population, both in and out of work, are being harnessed as a means of promoting labour market change and reducing demand for low-skilled migrants – often EU workers, whose own access to benefit is being curtailed. Arguments about the post-national expansion of rights and associated cosmopolitan debate implicitly measure migrants rights against a normative model of citizenship as the yardstick of full social inclusion, but with little attention to how far citizenship itself falls short of this promise. Taking Britain as a case study, this paper considers how the concept of civic stratification can further advance analysis of the link between domestic welfare, migration and human rights in a context of intensifying controls for both migrants and citizens.     

Adopting (in)equality in the UK: the Equality Act 2010 and its impact on charities

This article considers the relationship between the Equality Act 2010 and the Charities Act 2011 (in Scotland, the Charities and Trustee Investment (Scotland) Act 2005) in the context of adoption by same-sex couples and the complex exceptions to the Equality Act that charities may be able to rely upon in order to continue to discriminate. It concludes that the law is confusing to the point of opacity, to the detriment of those seeking to exercise their rights and those called on to adjudicate conflicts.
