This article explains why the Supreme Court's privacy jurisprudence has become deeply problematic for addressing emerging reproductive and sexual choice issues, focusing on abortion funding, minors seeking abortions, adults engaging in consenting homosexual sex, and pregnant women accused of abusing their fetuses. The article makes two arguments. First, it contends that what is private about the rights asserted in cases like Eisenstadt v. Baird and Roe v. Wade has never been fully articulated nor defended, leaving these central decisions conceptually unpersuasive. Second, the article shows that "privacy" is used in two very different senses in Supreme Court constitutional right-to-privacy decisions: one rooted in respect for marriage and the family, the other in notions of personal autonomy. Although both senses deserve to be protected, the court has tended to prefer the familial sense of privacy to the autonomy one, with serious consequences for privacy concerns that are not connected to family relationships or that are perceived as undercutting "family values."  相似文献

The socialization of children and adolescents is shaped by how they spend their time. This special issue maps the daily experience of white American 5th–9th graders, describing both the quantities of time they spend in different contexts and the affective states associated with these contexts. Each paper examines a separate segment of daily activity (e.g., schoolwork, talking, sports), employing data from a common study in which 401 participants provided experience sampling reports at random times during their daily lives when cued by a pager. The findings show substantial age and sex differences, indicating significant changes in the daily life space of girls and boys between preadolescence and early adolescence. Scotland's impact across the world undoubtedly stretched to the Antipodes particularly, but not only, in the colonial era. Under the “canopy of Empire”, Australia and Scotland were linked by migration, trade, capital movements and by cultural ties. But these were all two‐way ties. They did not simply colour the “Australian civilisation”. Rather there was a vital and shifting reciprocation between Scotland and Australia. The relationship between them has mainly been determined by their different economic trajectories. Today financial and skilled human capital move each way between the two countries with heightened velocity and efficiency. These flows, along with continuing cultural connections, enmesh two fully developed modern economies.  相似文献
