Abstract This paper explores the thesis that the main impact of the new constitutional Charter of Rights on the Canadian system of government is to increase the role of the judiciary in deciding how fundamental social and political values should be affected by public policy. The first part of the paper. by reviewing the significant role which trial and appeal courts already play in shaping public policy, aims at overcoming a tendency to exaggerate the change in our system of government resulting from the Charter. The second part identifies the factors which will influence the judicial response to the Charter and the policy areas in relation to which judicial interpretation will be most significant. The analysis shows that the Charter's major impacts will likely include much greater judicial supervision of police activity and centralization of policy-making under the leadership of the Supreme Court on questions of social justice and minority-language rights. It concludes that, while the Charter will increase Canadians' understanding of judicial policy-making, it represents a retreat from reliance on the political process to resolve divisive social issues. Le présent article examine la thèse selon laquelle le principal effet de la nouvelle Charte des droits constitutionnels sur le système de gouvemement canadien sera d'accroître le rôle du pouvoir judiciaire dans la détermination de la façon dont les valeurs sociales et politiques fondamentales devraient être affectées par les politiques publiques. La première partie de l'article passe en revue Ie rôle important que jouent déjà les tribunaux et les cours d'appel, ainsi que l'influence que ces institutions exercent sur la politique publique, ceci afin de neutraliser une tendance à exagérer les changements qu'apporterait la charte à notre système de gouvernement. La seconde partie identifie les facteurs qui pourront influencer la réponse judiciairs à la charte ainsi que les domaines politiques où l'interprétation judiciaire de cette charte aura le plus d'importance. L'analyse démontre que l'adoption de la charte entraînera des conséquences importantes, qui comprendront probablement une surveillance judiciaire des activités de la police beaucoup plus développée et une centralisation, sous la direction de la Cour suprême, de l'élaboration de politiques en matière de justice sociale et de droits linguistiques des minorités. L'auteur conclut que bien que la charte permettra aux Canadiens de mieux saisir le rôle de la Cour dans l'élaboration des politiques, elle représente un recul du recours au processus politique en ce qui concerne la résolution des questions sociales contentieuses.  相似文献

A mobile and fast, semi-automatic ultrasound (US) system was developed for facial soft tissue depth registration. The system consists of an A-Scan ultrasound device connected to a portable PC with interfacing and controlling software. For 52 cephalometric landmarks, the system was tested for repeatability and accuracy by evaluating intra-observer agreement and comparing ultrasound and CT-scan results on 12 subjects planned for craniofacial surgery, respectively. A paired t-test evaluating repeatability of the ultrasound measurements showed 5.7% (n = 3) of the landmarks being significantly different (p < 0.01). US and CT-scan results showed significant differences (p < 0.01) using a Wilcoxon signed rank test analysis for 11.5% (n = 6) of the landmarks. This is attributed to a difference in the volunteer's head position between lying (CT) and sitting (US). Based on these tests, we conclude that the proposed registration system and measurement protocol allows relatively fast (52 landmarks/20 min), non-invasive, repeatable and accurate acquisition of facial soft tissue depth measurements.  相似文献

Traditionally, toolmark test exemplars are produced by applying a tool's working surface to a piece of soft metal such as lead. Soft, pliable metals are primarily used for this purpose because they will replicate the microscopic grooves present on a tool's working surface without damaging the tool. In this paper the authors present an alternative material for the preparation of test toolmarks. Jewelry modeling or carving waxes are utilized in this study. These waxes are designed for the jewelry modeling industry to create very fine, highly detailed wax models of jewelry pieces that will be cast in various metals utilizing the lost wax casting method. Jeweler's waxes have been found to be ideal for preparing test toolmarks from exemplar tools. The test tool's working surface is applied to a piece of the appropriate wax in a manner consistent with the tool's design. The replicas obtained are exact, highly detailed, 1:1, negative impressions of the exemplar tools working surface, have a long shelf-life, and are suitable for use in toolmark examination and comparison cases.  相似文献

PENDULUM--a guideline-based approach to the interpretation of STR mixtures   总被引:2,自引:0,他引:2  
Several years ago, a theory to interpret mixed DNA profiles was proposed that included a consideration of peak area using the method of least squares. This method of mixture interpretation has not been widely adopted because of the complexity of the associated calculations. Most reporting officers (RO) employ an experience and judgement based approach to the interpretation of mixed DNA profiles. Here we present an approach that has formalised the thinking behind this experience and judgement. This has been written into a computer program package called PENDULUM. The program uses a least squares method to estimate the pre-amplification mixture proportion for two potential contributors. It then calculates the heterozygous balance for all of the potential sets of genotypes. A list of "possible" genotypes is generated using a set of heuristic rules. External to the programme the candidate genotypes may then be used to formulate likelihood ratios (LR) that are based on alternative casework propositions. The system does not represent a black box approach; rather it has been integrated into the method currently used by the reporting officers at the Forensic Science Service (FSS). The time saved in automating routine calculations associated with mixtures analysis is significant. In addition, the computer program assists in unifying reporting processes, thereby improving the consistency of reporting.  相似文献

The rapid further development of computed tomography (CT) and magnetic resonance imaging (MRI) induced the idea to use these techniques for postmortem documentation of forensic findings. Until now, only a few institutes of forensic medicine have acquired experience in postmortem cross-sectional imaging. Protocols, image interpretation and visualization have to be adapted to the postmortem conditions. Especially, postmortem alterations, such as putrefaction and livores, different temperature of the corpse and the loss of the circulation are a challenge for the imaging process and interpretation. Advantages of postmortem imaging are the higher exposure and resolution available in CT when there is no concern for biologic effects of ionizing radiation, and the lack of cardiac motion artifacts during scanning. CT and MRI may become useful tools for postmortem documentation in forensic medicine. In Bern, 80 human corpses underwent postmortem imaging by CT and MRI prior to traditional autopsy until the month of August 2003. Here, we describe the imaging appearance of postmortem alterations--internal livores, putrefaction, postmortem clotting--and distinguish them from the forensic findings of the heart, such as calcification, endocarditis, myocardial infarction, myocardial scarring, injury and other morphological alterations.  相似文献
