Abstract. The authors describe a logic programming approach to the representation of legislative texts. They consider the potential uses of simple systems which incorporate a single, fixed interpretation of a text. These include assisting in the routine administration of complex areas of the law. The authors also consider the possibility of constructing more complex systems which incorporate several, possibly conflicting interpretations. Such systems are needed for dealing with ambiguity and vagueness in the law. Moreover, they are more suitable than single interpretation systems for helping to test proposed legislation and for helping to give citizens advice.  相似文献

What effect do pro‐market economic policies have on labour rights? Despite significant debate in policy and academic circles about the consequences of economic liberalisation, little is known about the labour rights effects of pro‐market policies. Extant literature has focused only on the possible outcomes of market‐liberalising policies, such as trade and investment flows, rather than directly assessing market‐friendly policies and institutions. Moreover, this line of research has found mixed results on how these outcomes influence labour conditions. To provide a comprehensive assessment of this linkage, this article combines data on five distinct policy areas associated with economic liberalisation with data on labour rights for the period 1981–2012. The results indicate that pro‐market policies – except the ones involving rule of law and secure property rights – undermine labour rights. Thus while there are some positive economic and political outcomes associated with market‐supporting policies, economic liberalisation comes at the cost of respect for labour rights.  相似文献

In orthodox moral thinking in the West, animals count for something but human interests take precedence. It is argued that this moral orthodoxy or animal welfare position is flawed. It fails to take into account that some animals, like humans, are persons and that some, so-called 'marginal' humans lack personhood. More importantly, although it is likely that animals do not have an interest in liberty for its own sake and have less of an interest in continued life than humans, there is little justification for the animal welfare claim that an animal's suffering should be regarded as less important morally than that of a human. It is concluded that the adoption of a 'sentiency position', whereby animals have a right not to suffer, has radical implications for the way animals are treated, ruling out intensive forms of animal agriculture and those scientific procedures that inflict suffering as morally illegitimate.  相似文献

Depression is the most common mental illness and its profound impact on cognition and decision-making has implications for political judgement. However, those implications are unclear in the case of referendums offering a choice between status quo and change. On one hand, one component of depression is the kind of life dissatisfaction associated with voting for change. Yet cognitive models also portray depression sufferers as biased towards the status quo: they are less inclined to research change, more pessimistic about its benefits and more likely to exaggerate its potential costs. In this paper, we use data from Understanding Society to examine the impact of those cross-pressures on support for Brexit. Prior to the referendum, while life dissatisfaction and generally poor health predicted support for Leaving the European Union (EU), those diagnosed with depression were disproportionately likely to support Remain. Supporting our claim that the latter was a sign of status quo bias, this difference disappeared once the result was in and leaving the EU had become the widespread expectation. The study highlights the unexplored importance of mental health for political judgements, emphasises the multidimensionality of conditions like depression and illustrates the psychological role of status quo bias in referendum voting.  相似文献

This article traces the evolution of the international governance of agriculture as a sequential process, in which the negotiation of new trading and enforcement rules interacts with legal disputes over the interpretation of existing rules. The interaction between negotiation and litigation has produced a governance trajectory from vague to precise commitments and a strengthened dispute settlement process. We contest standard histories, which identify the Uruguay Round Agreement on Agriculture as the singular event that established agriculture for the first time under the auspices of the World Trade Organization and which claim this represents the legalization of the agricultural trade regime. The case of agriculture contains important lessons for broader debates on international governance by articulating: (1) dynamic feedback processes, challenging the view that bargaining and enforcement aspects of international agreements are concluded simultaneously, and (2) key mechanisms underlying the greater precision of institutional commitments that tend to emerge over time.  相似文献

The Republic of Serbia's Ministry of Defense (MoD) is attempting to implement a program‐oriented, multi‐year budgeting system in 2010. This paper reveals several challenges that threaten the success of this initiative. First, we find that the proposed budget system confuses organizations and programs. Second, there does not appear to be a centrally coordinated effort to implement program budgeting, leading to significant disparities in comprehension, organization, and implementation amongst the subordinate commands in MoD. Finally, there is a distinct lack of communication within the MoD regarding the necessity of a program budget and how the process should move forward. These issues inhibit the implementation of program budgeting in the MoD and diminish the possible gains associated with the multi‐year, programmatic allocation of defense resources.  相似文献

Although law enforcement agencies arrest criminal group leaders to dismantle organized crime, few studies have assessed whether such interventions produce adverse effects. Through a mixed‐method comparative case study of the Latin Kings and 22 Boys street gangs in Chicago, this article examines the consequences of arresting a gang's leader. Using violent crime data, I show that a spike in violent crime took place in the first month after the arrest of the 22 Boys gang leader. In contrast, the arrest of the Latin Kings gang leader produced no change in violent crime. Using several qualitative data sources, I show that the arrest of the 22 Boys gang leader temporarily led to the gang's withdrawal from its territory, which spurred violent aggression from rival gangs in adjacent territories. In contrast, the Latin Kings gang continued its operations because the gang's prison leaders quickly appointed new leadership. The results suggest that criminal group embeddedness (or the social relations between criminal groups) can contribute to adverse effects in interventions targeting gang or other criminal group leaders.  相似文献
