Early Women Law Students at Cambridge and Oxford

This article examines the hitherto neglected history of the twelve women who studied law at Cambridge and Oxford in the years up to 1900. It concludes that the reason why so little has been written about them is, first, because women's experience has been routinely ignored in accounts of legal education (and in history generally) and, second, because their entry to the university law schools was accomplished with very little fuss or opposition. This in turn was due not only to the fact that the law professors were generally sympathetic to higher education for women but also because the women themselves did not challenge university traditions or the men's curriculum.     

Choice,Privacy and Publicly Funded Legal Advice at Police Stations

Section 58 of the Police and Criminal Evidence Act 1984 confers on all suspects held in police custody a right to consult a solicitor in private. The free legal advice which suspects arrested for certain minor offences can request is restricted to telephone advice from a call‐centre operated by CDS Direct. It is lawful for the Legal Services Commission to restrict the delivery of legal advice in this way. Empirical research, however, reveals that there are police stations that lack the facilities for suspects to speak by telephone with legal advisers secure in the knowledge that what is said will not be overheard. It is unlawful and incompatible with the European Convention on Human Rights to expect suspects to speak by telephone to a legal adviser under such conditions.     

Geschlechtsspezifische Lohnungleichheit in Betrieben, Berufen und Jobzellen (1993–2006)

Whereas educational inequalities between women and men and differences in labor market participation shrinked or even diminished during the last decades, the gender pay gap remained stable over time. This is remarkable because the pay gap has attracted much more attention as the main target of anti-discrimination policies. Using data from the IAB (Institute for Employment Research), we analyze whether the average pay gap between women and men working full-time can be explained by their employment in different industries, occupations, and firms. As the smallest level of analysis we focus on occupations within firms (job cells). This strategy of analysis yields the best possible approximation to the concept of “within-job wage gap”. The results show that women with equivalent training and occupational experience earn wages that are 12 percent less than the wages of men in such job cells. Even though the educational participation of women rose to that of their male counterpart, the gender composition of labor market participation changed and the pressure of equal employment policies grew, the gender wage gap does not decrease within our observation period (1993–2006). In conclusion, we discuss theoretical and methodological reasons for this finding.     

Prospective Links Between Ethnic Socialization,Ethnic and American Identity,and Well-Being Among Asian-American Adolescents

Ethnic socialization and ethnic identity have been related to positive outcomes, but little research has examined these associations longitudinally. This three-wave study prospectively linked socialization messages at Time 1, ethnic identity and American identity at Time 2, and self-esteem and depressive symptoms at Time 3 in 147 (58 % female; 25 % first-generation) Asian-American adolescents. The results indicated positive links between cultural socialization messages and ethnic and American identity, though the latter association was significant only for females. Ethnic identity was positively related to self-esteem, and mediated the positive effect of cultural socialization on self-esteem. The promotion of mistrust was positively linked to self-esteem and negatively related to ethnic identity, though this latter association was significant for foreign-born youth only. Our findings highlight the importance of elucidating prospective links in identity development, and examining gender and generational differences within them.     

Law and the Power of Feminism: How Marriage Lost its Power to Oppress Women

In Feminism and the Power of Law Carol Smart argued that feminists should use non-legal strategies rather than looking to law to bring about women??s liberation. This article seeks to demonstrate that, as far as marriage is concerned, she was right. Statistics and contemporary commentary show how marriage, once the ultimate and only acceptable status for women, has declined in social significance to such an extent that today it is a mere lifestyle choice. This is due to many factors, including the ??sexual revolution?? of the 1960s, improved education and job opportunities for women, and divorce law reform, but the catalyst for change was the feminist critique that called for the abandonment (rather than the reform) of the institution and made the unmarried state possible for women. I conclude that this loss of significance has been more beneficial to British women in terms of the possibility of ??liberation?? than appeals for legal change and recognition, and that we should continue to be wary of looking to law to solve women??s problems.
