司法除了应该及时保护社会外,还需要包涵以下目标:使得加害人在情感层面上了解犯罪所造成的损害不止发生在被害人一个人身上,与被害人有关的每个人都会受到伤害;确定加害人生活中的哪些不和谐因素导致了犯罪,并且为加害人努力塑造其他各种关系来减少重复犯罪的可能;寻求途径使得加害人和被害人双方都能摆脱受损的关系,因为在犯罪发生后他们都被束缚在了受损关系上.可见,关系模式中对加害人的惩罚和刑事司法制度中的惩罚,二者基础不同.后者的基础是与犯罪行为的社会危害性程度相适应的刑罚,而不考虑加害人对自身罪行的理解和悔罪程度.而在关系模式中,惩罚的重点在情感层面,惩罚的基础是悔罪.一旦用关系的视角看待犯罪,便开始重新审视西方刑事司法系统的一些基本理念,它们没有我们一直以为的那样精致.

This article describes the process of building network organizations that support and foster broad-based economic and social development. Coverage includes phases in the development process, approaches to devising action steps, the nature of network organizations, and action research required to support network development.     

Toward a psychological ecology of affirmative action

Research-based knowledge of the effects of affirmative action has been little help to policy makers. That is the case because there has been no means through which to organize into a policy-relevant whole the findings that have come from a variety of disciplinary sources. A heuristic schematic of the psychological ecology of affirmative action is proposed as a step toward developing a conceptual framework that can reduce this problem. A psychological ecology of affirmative action consists of the mutual relations between policy interest groups and the procedures used to implement these policies. A critical point that the ecological framework leads to is that the nature of affirmative action procedures has a major influence on the material and subjective links between interest groups. Given that claim, the schematic is used to categorize, review, and critique the multidisciplinary research on affirmative action. From that overview, a set of general guidelines for the design of effective affirmative action programs is proposed. Finally, a call is made for a shift in the unit of policy analysis from a focus on group justice to relational justice.     

Affirmative action in American politics: Strength or weakness?

When Geraldine Ferraro was selected to be the Democratic Party's vice-presidential candidate, questions were raised about why she was chosen. Was her selection an outcome of affirmative action in the political arena? The research reported in this paper investigates whether the effect of Ferraro's candidacy on voting inclinations and behavior among college students was mediated by conceptions of the procedure of affirmative action. As predicted, conceptions of affirmative action (the difference between actual and threshold ratios) influenced changes in inclination to vote Democratic in response to the Ferraro candidacy. In turn, those inclinations affected voting behavior in the 1984 presidential election. The discussion focuses on the theoretical and practical importance of perceived procedural fairness in the political arena.     

Schadenersatz wegen im Prozess verz?gerter R?umung

Immer wieder kommt es vor, dass Bestandnehmer in R?umungsprozessen Einwendungen erheben, um die R?umung zu verhindern bzw hinauszuschieben. Dadurch k?nnen dem Vermieter Sch?den entstehen, die durch die prozessrechtliche Kostenersatzpflicht und Benützungsentgelte nicht gedeckt sind. In deswegen geführten Schadenersatzprozessen hat der OGH die Frage der Beweislast zum Verschulden bisher unterschiedlich beantwortet. Oftmals wurde der Vermutung, dass die Anrufung des Gerichtes gutgl?ubig erfolgt, Vorrang gegenüber der Beweislastregel nach § 1298 ABGB gegeben. Zu diesem Rechtsstandpunkt ?u?erte sich der OGH nun ausdrücklich in der nachstehend besprochenen Entscheidung 1 Ob 153/11y.     

Selection procedure and responses to affirmative action

Although it has been recognized that a large number of issues linked to the social policy of affirmative action are of a social psychological nature, research investigating such issues has not considered the social psychological importance of implementation procedures. Social policy analysts have differentiated implementation procedures on the degree to which they include relevant achievement criteria. In the present research this differentiation is couched within the theoretical framework of procedural justice and is utilized to critique the work of Austin et al. (1977). These researchers investigated the responses of individuals favorably treated in an affirmative action like situation and conclude that affirmative action is evaluated as absolutely unfair by these individuals. Based on the critique, a 2 (qualifications)×2 (history of discrimination)×2 (procedure) role play experiment was conducted. The results of the experiment unambiguously support the hypothesis that implementation procedure will greatly affect a variety of individual responses such as general affect, evaluations of procedural fairness, evaluations of outcome fairness, and evaluations of a relevant subunit of the involved institution.This article is based in part on a dissertation submitted to the Department of Psychology at the University of North Carolina in partial fulfillment of the requirements for the Ph.D. Special thanks are extended to the members of the dissertation committee, Drs.
