Trademarks as Sources of Market Power: Legal and Historical Encounters

Although the history of trademarks is well catalogued in various review articles and books in different jurisdictions, one particular missing link is whether trademarks are sources of market power—from a historical perspectives. This article addresses exactly that question, and presents some of the legal encounters that support the historical narrative that trademarks are sources of market power, by examining selected trademark cases—centuries apart in England and the United States. The overall purpose of these discussions is aimed at situating the law and policy of trademarks in the antitrust regime when significant historical trademark cases are brought into the equation and whether a prediction can be made that trademarks are increasingly heading into a clash with the antitrust regime.     

Charles Gavan Duffy's Ministerial Tour: Oratory,Electioneering and the Meaning of Colonial Democracy*

During 1871 and 1872 the Victorian Premier, Charles Gavan Duffy, led his minsters on a banqueting tour of the colony during which he made a series of speeches in defence of his Government. Little noticed since but controversial at the time, Duffy's tour called into question the centrality of parliament and the meaning of colonial democracy. Earlier interpretations, derived from the study of colonial New South Wales, paint Australian politics in this period as ideologically somnolent and unprincipled. Yet Duffy's tour and the associated hullabaloo reveal the intellectual vitality and vigour of democracy's brash antipodean form. Its significance has been overlooked by historians. However Duffy's oratory tour was undertaken almost a decade before Gladstone's 1879 apparently pioneering Midlothian campaign, and the electioneering practices he initiated in the early 1870s shaped elections in the years that followed.

Pathway to terrorist behaviors: The role of childhood experiences,personality traits,and ideological motivations in a sample of Iraqi prisoners

Radicalization to terrorism is a multifaceted process with no single theory or approach to explain it. Although research has focused on understanding the process, there is still a dearth of studies that examine an empirically driven pathway to terrorism behavior. This study examines a cross-sectional sample of incarcerated men convicted of terrorism in Iraq (N = 160). A questionnaire-guided interview included adverse childhood experiences (ACEs), conduct disorder (CD), antisocial personality disorder (ASPD), religious and political ideology, views about causes of terrorism, and the severity of terrorist acts. Path analysis was employed to examine the relationships between these factors and to identify the model with the best fit. After adjusting for age, employment, and location, results indicated that ACEs positively impacted CD, ASPD, religious guidance, and terrorism attitudes. ASPD positively affected political commitment and terrorism attitudes, but inversely affected current religious commitment. Political commitment inversely influenced terrorism attitudes. Religious commitment positively influenced the prioritization of religion in life, which subsequently impacted terrorism attitudes and behavior severity. Additionally, attitudes toward terrorism directly affected the severity of terrorism behavior. All paths in the final model were statistically significant at p < 0.05. Although these findings may be limited in generalizability due to the unique sample, results support the complex and interdependent nature of childhood and adult experiences on the development of both terrorism attitudes and the severity of terrorism behavior.     

Business Development Support and Knowledge-Based Businesses

Knowledge-based businesses are vital to the economic development and revitalization of many regions, especially areas that have experienced a decline in traditional industries. Notwithstanding the importance of KBBs to areas with marginal economies, little is known about the business development support requirements of these firms and the extent to which their support needs are being met. Through the use of a telephone survey, this empirical study investigates the demand-side perspectives and experiences of entrepreneurs in a peripheral region of Canada to determine the types and sources of support used at various stages of business development, and to identify potential support gaps. Findings indicate support used by KBBs differs from more traditional firms and that support needs change as firms move through the life cycle. There appears to be a low level of awareness among firms in the study region of available support services and a perception that support beyond the start-up stage is generally lacking. These findings have important implications for researches and for agencies with a business development support mandate.
