Goodbye to All That? The Rule of Law,International Law,the United States,and the Use of Force

The attitude of past United States administrations to public international law, particularly but not exclusively governing the use of force, has often seemed ambivalent, or sometimes decidedly hostile (where the conduct of the United States itself was called in to question). This paper considers the attitude of many of those with power or influence in the Bush administration (particularly that of the 'neo-conservatives'), and the implications of their often thinly disguised contempt for public international law which might seek to constrain the exercise of United States power. The conclusion is that while the academic arguments which seek to justify this American 'exceptionalism' are worthy of serious examination, they are ultimately inadequate and in the interests of neither the rest of the world, nor, finally, the United States itself.     

The 50th Anniversary of The Civic Culture

This article traces the origins of the concept of political culture within the study of comparative politics. After revisiting the circumstances under which it developed, the article highlights some of the key factors that set it apart from other studies in its era – its theoretical exploration of stable democracy, its systematically comparative focus and its use of sample surveys of public opinion. The article shows how these factors were refined and improved in subsequent work on political equality. Overall, it concludes that the basic formulation of The Civic Culture – of congruence between mass attitudes and the type of political system – will be retained and will continue to make a mark upon the future trajectory of comparative research on public opinion.     

Well-informed? Well Represented? Well Nigh Powerless? Victims and Prosecutorial Decision-making

This article provides a brief overview of the ways in which prosecutors must engage with victims in the course of their work in criminal proceedings and what formal roles victims can assume in criminal proceedings. Besides exploring what rights victims have per se in criminal proceedings, analysis is provided as to what it means to be an additional prosecutor or a private prosecutor in several European criminal justice systems. A brief analysis of the effects these rights and the use of prosecutorial discretion has on victims is provided.     

Viorel Virgil Tilea and the Origins of the Second World War: An Essay in Closure

The 'Tilea Affair' of March 1939 is among the most contentious of the short-term events leading to the Second World War. V.V. Tilea, the Romanian minister in London, brought information to the British Foreign Office, about an alleged German threat to his country. The guarantee to Poland soon followed and, in turn, the outbreak of the war. This article examines the evidence offered by contemporary British witnesses, the ensuing historical controversy - bringing to bear a variety of new revelations, including materials derived from the author's acquaintance with Tilea - and the present state of historical knowledge. It concludes that closure can be applied to most aspects of the 'Tilea Affair'.     

Different cases,different faces: Chinese investment in Central and Eastern Europe

Chinese investment in Central and Eastern Europe (CEE) is booming. As China’s investment pattern has emerged so far, it appears to have little to do with Chinese firms’ preferences for liberal policy regimes, tolerance for corruption, or reliance on communist-era networks. This article documents the current size and shape of Chinese firms’ efforts to internationalize in this economic space, demonstrating an important difference between Chinese investment behavior in CEE and in the EU-15, namely the region’s much more active use of greenfield activity (and lighter use of M&A and strategic alliances). Case studies of each mode (greenfield, M&A, and strategic alliances) reveal little evidence of a “China, Inc.” approach and much evidence that Chinese firms are more motivated by market access than by technology or management assistance.     

Adolescent parricide and psychopathy

Most cases of juvenile parricide are believed to be the result of child abuse, yet the vast majority of abused children do not kill their parental abusers. This study explored the role of psychopathy in 10 adolescent parricide offenders tried in adult court who were referred for pretrial psychiatric evaluation. In addition, psychopathological findings, crime-related behaviors, and judicial outcomes are described. Diagnostic and Statistical Manual of Mental Disorders diagnoses, most commonly posttraumatic stress disorder, and chronic, severe child abuse were prevalent. Psychopathic traits were not found to have played a role in the traumatized youths' parricidal behavior. Killings occurred in the family homes, usually through a surprise attack with parent-owned firearms. There was an average of 1.7 victims per event, with fathers being the most likely victim. Bodies were commonly covered or wrapped and moved postmortem. Confessions were often incredible in quality. One half received sentences of 40+ years, and the modal sanction was a life sentence, despite 90% premorbidly described as good youth. Further studies of adolescent parricide are needed to better understand this unusual population.
