Ein Beamter hat kein subjektives Recht auf tats?chliche Erbringung der ihm an seinem Arbeitsplatz zugewiesenen Aufgaben. Eine im Beamtenverh?ltnis stehende Chirurgin hat daher auch keinen Anspruch auf die Betrauung mit der Durchführung von Operationen. Das vom OGH entwickelte Recht auf Besch?ftigung leitet dieser aus allgemeinen Rechtsgrunds?tzen ab. Auf ?ffentlich-rechtliche Dienstverh?ltnisse ist dies nicht übertragbar.     

Market structures,political surroundings,and merger remedies: an empirical investigation of the EC’s decisions

This paper aims to build and empirically evaluate a discrete choice model of merger remedies as a basis for policy analysis. The database consists of 229 merger cases accepted in Phase I or Phase II of the European merger process between 1990 and 2005. We focus on the following question: Which merging firms’ characteristics lead the European Commission to decide whether to require conditional acceptance? Although a lot of empirical studies have been carried out these last years, ours is distinguished by at least two original features. First, we explore determinant factors of the Commission’s decisions with a neural network model differentiating cases accepted with or without remedies (either structural or behavioral). Secondly, we implement three multinomial logit models. We find that variables related to high market power lead more frequently to a remedy outcome, no matter the phase. Innovative industries such as energy, transportation and communications positively affect the probability of a behavioral remedy. Lastly, former Competition Commissioner Mario Monti’s policy appears to be pro-remedy, i.e. seeking concessions from merging parties.

Gegen Entscheidungen der Bundeswettbewerbsbeh?rde in Angelegenheiten des AuskunftspflichtG steht die Berufung an den zust?ndigen Bundesminister offen. Dem steht nicht entgegen, dass der Leiter der Bundeswettbewerbsbeh?rde gem § 1 Abs 3 WettbewerbsG weisungsfrei und unabh?ngig ist.     

Time since discharge of rifles

The estimation of time since the latest discharge of rifles has been achieved by the SPME sampling technique and the GC-TEA analytical system. An unidentified compound, designated as the TEA2 compound, was detected in all the rifles investigated. The same compound was observed in shotguns and spent cartridges in our previous work. This compound escapes rapidly from the inside of rifle barrels, but can still be detected there one to two months after the shooting. The decrease of the TEA2 peak with time after shooting is non-exponential, and the curve-fitting procedure proposed for the estimation of time since discharge of shotguns can be applied also for rifles.

The results point to the decisive influence and the efficiency of dental methodology for identification of bodies that are burned or disfigured after an accident or a prolonged period in water.     

How Can Subnational Governments Deliver Their Policy Objectives in the Age of Austerity? Reshaping Homelessness Policy in Wales

This article explores how a devolved government in a small country, faced with external constraints beyond its immediate control, can deploy policy resources to shape a distinctive approach to public services. We analyse recent homelessness policy in Wales using the NATO (Nodality, Authority, Treasure, Organisation) typology of tools of government proposed by Hood and Margetts, and show how this can be applied usefully to understand the choices that governments must make in conducting relationships with other institutions. We conclude that a combination of Nodality and Authority provide powerful resources for a subnational government which has only limited formal powers and fiscal autonomy.     

Hooliganism under the Statistical Magnifying Glass: A Belgian Case Study

In Belgium the most important football matches are statistically recorded. Therefore this case is presented to demonstrate what can be learnt from statistics and other qualitative information in order to assess hooliganism: the number of hardcore elements, their size, their maximum capacity for mobilisation, the age groups involved, the degree of activism, the number and characteristics of the incidents involved, links with political crime and/or extremism, relationships and/or rivalries with other hardcore elements, the size of the police resources deployed in order to tackle them, and the impact of certain measures in the fight against hooliganism. A number of the characteristics of the phenomenon of hooliganism (renewal, adaptation and international relationships, in particular) mean that one has to go beyond the pure and simple canvas of a questionnaire with a statistical vocation. It is for this reason that the statistical information in Belgium has, from the very start (the 1991-1992 season) been backed up by telephone interviews with special witnesses from various Belgian hardcore elements.
