Enforcement through eBay's VeRO scheme may be a groundless threat

On an interim injunction application to restrain an allegedthreat of infringement proceedings, the High Court held thatthe submission of an enforcement request through eBay's VerifiedRights Owner (VeRO) Program could constitute a groundless threatof infringement proceedings of a registered Community Design;the Court was concerned at the ability of a rights owner touse the VeRO program to ‘snuff out an avenue of the claimant'sbusiness’ where the proprietor of the designs in questionhad no intention of commencing proceedings in which the issuesof infringement and validity would be determined.     

Consideration of the probative value of single donor 15-plex STR profiles in UK populations and its presentation in UK courts

The adoption of new 15 locus STR multiplex systems into UK forensic science would be facilitated by agreed guidelines for reporting the strength of DNA evidence using likelihood ratios. To facilitate such an agreement, we present an analysis of previously published UK allele frequencies for white Caucasian, Afro-Caribbean and Indo-Pakistani populations and investigate their effect on likelihood ratios for single donor profiles. We consider the implication of the five additional loci and suggest a procedure for reporting likelihood ratios for 15-plex STR profiles.     

The evolution of criminal interrogation rules in China

This paper presents a historical analysis of Chinese legal theories and the evolution of criminal interrogation rules from the pre-Han to the reform era. A fuller understanding of the evolution of rules is doubtless relevant to the present day’s controversy in China’s legal reforms surrounding the right to remain silent during interrogation and the privilege against self-incrimination. The historical analysis reveals that the imperial social context which once morally legitimized judicial torture in Chinese criminal justice is very much alive even today. For future legal reforms in China, there are barriers in the current social context, which seem to be unconducive for the right to remain silent and the privilege against self-incrimination. But, traditional native resources are also available to legal reformers to ensure better protection of the rights of the suspect subject to police interrogation, and to eliminate police-coerced confessions.     

Protecting charities from terrorists … and counterterrorists: FATF and the global effort to prevent terrorist financing through the non-profit sector

What role has FATF played in the global effort to counter terrorist financing through the non-profit sector? How have advocates for the sector responded and what do these developments tell us about FATF’s operations and influence? This article reflects on the emergence and evolution of FATF Recommendation 8, initially introduced as Special Recommendation VIII after the terrorist attacks in the United States on 11 September 2001. We show how the breadth of that recommendation elicited a response in the form of a "transnational advocacy network" among those within the non-profit sector. The resulting process of dialogue and the recent change in the text of the recommendation provide important lessons for scholars and practitioners concerned about FATF's accountability and authority.     

An Unplanned Complex Suicide by Multiple Blank Cartridge Gunshots and Cutting

Blank firing guns are readily accessible in most countries due to an absence of legal regulations. These weapons are capable of causing lethal injuries. We report a rare case of secondary (unplanned) complex suicide committed with a knife and blank cartridge pistol. A 59‐year‐old man was found dead with three superficial incisions in his neck and a gunshot wound to the chest. The external examination revealed an entrance wound in the left chest region consistent with contact shooting. The appearance of a muzzle imprint suggested two discharges. The autopsy showed a slightly hemorrhaged but otherwise intact pericardium, blood in the pericardial sac, and a channel‐like defect in the anterior wall of the left cardiac ventricle. The cause of death was attributed to cardiac tamponade. To the best of our knowledge, this is the first reported case of unplanned complex suicide involving an unmodified blank firing gun.

Interpretation of repeat measurement DNA evidence allowing for multiple contributors and population substructure

Due to the circumstances in some forensic cases, very small amounts of DNA (<100 pg) may be obtained. This, in turn, may affect the reliability of the PCR process, and so it may be advisable to repeat the amplification process for confirmatory purposes. Gill et al. [Forensic Sci. Int. 112 (2000) 17] proposed a method for the statistical evaluation of the PCR replicate information. In this paper we formalize the method proposed by Gill et al. [Forensic Sci. Int. 112 (2000) 17], and extend it to allow for cases involving mixed stains and for population substructure.     

Bias in Conditional and Unconditional Fixed Effects Logit Estimation: A Correction

In a recent paper published in this journal, Katz (2001) comparesthe bias in conditional and unconditional fixed effects logitestimation using Monte Carlo Simulation. This note shows thatwhile Katz's (2001) specification has "wrong" fixed effects(in the sense that the fixed effects are the same for all individuals),his conclusions still hold if I correct his specification (sothat the fixed effects do differ over individuals). This notealso illustrates the danger, when using logit, of includingdummies when no fixed effects are present.     

Bureaucracy,organization culture and development

The first part of the paper discusses the concept of organizational culture and highlights its value as an aid to understanding the way organizations work. Using four basic models of organization culture (power, role, task and person) the paper then goes on to describe a questionnaire survey of cultures in development organizations. The questionnaire required two sets of responses: firstly an indication of preferred organization culture and secondly the respondents' perception of the way their organization actually works. Whilst the vast majority of respondents prefer task-orientated cultures, most actually perceive themselves to be operating in a role culture (bureaucracy), whilst a large minority perceives a power (political) culture. These results demonstrate an inherent tension in many people's working lives. They also indicate the necessity of taking into account the political environment of work when designing training courses; few organizations appear to operate in the rational way upon which many development techniques and practices are posited. In the final part of the paper there is discussion of the need to make a modification to the basic cultural models in order to make them particularly relevant to developing countries.
