While the pages of Criminal Justice Matters frequently examine and assess criminal justice policies and often make recommendations on how to reform the system, this edition takes a more reflexive approach. Rather than focus on the nature of criminal justice reforms, this issue of cjm shines a spotlight on the reformers.

Suicide Missions as Witnessing: Expansions,Contrasts

Studies of suicide missions usually focus solely on attacks. They also have highlighted the performative character of suicide missions as acts of witness. By extending surveys to suicidal acts that embrace no-escape attacks, theatrical assassination, defensive suicide, and suicidal protest, one gains further insight into the motivations of individuals and organizations. Illustrative studies, notably the assassination of Mahatma Gandhi and Sadat as well as Tamil Tiger operations, generate a typology that underlines the benefits of such extensions. The Japanese and Tamil contexts reveal the profound differences in readings of sacrificial acts of atonement or punishment by local constituencies. Norman Morrison in Washington in 1965 and Jan Palach in Prague in 1969 did not have such beneficial settings and the immediate ramifications of their protest action were limited. Morrison's story highlights the significance of a societal context of individuated rationalism as opposed, say, to the “pyramidical corporatism” encouraging martyrdom operations in the Islamic world.

Dyadic Variability in Mother-Adolescent Interactions: Developmental Trajectories and Associations with Psychosocial Functioning

Dyadic variability is considered to be a key mechanism in the development of mother-adolescent relationships, and low levels of dyadic flexibility are thought to be associated with behavior and relationship problems. The present observational study examined heterogeneity in the development of dyadic variability in mother-adolescent interactions and associations with psychosocial functioning. Dyadic variability refers to the range of emotional states during interactions of mother-adolescent dyads. During five annual home visits, 92 mother-adolescent dyads (M age T1 = 13; 65.2 % boys) were videotaped while discussing a conflict, and they completed several questionnaires on adolescents’ aggressive behavior and adolescents’ and mothers’ perceived relationship quality. Two types of dyads were distinguished: low variability dyads (52 %) and high decreasing variability dyads (48 %). Over time, high decreasing variability dyads were characterized by a broader emotional repertoire than low variability dyads. Moreover, these two dyad types had distinct developmental patterns of psychosocial adjustment. Over time, high decreasing variability dyads showed lower levels of adolescents’ aggressive behavior, and higher levels of perceived relationship quality than low variability dyads. These findings suggest that over time more dyadic variability is associated with less adjustment problems and a more constructive development of the mother-adolescent relationship. Adaptive interactions seem to be characterized by a wider range of emotional states and mothers should guide adolescents during interactions to express both positive and negative affect. Observing the dyadic variability during mother-adolescent interactions can help clinicians to distinguish adaptive from maladaptive mother-adolescent dyads.     

Caring for the Disabled? New Boundaries in Disability Discrimination

The scope of the disability-related less favourable treatment provisions of the Disability Discrimination Act 1995 has been reduced by the House of Lords in a housing case, London Borough of Lewisham v Malcolm , while the European Court of Justice has taken a broad approach to disability discrimination and carers within the EC Framework Directive in Coleman v Attridge Law . In discussing both cases, this note suggests that the pre- Malcolm approach to identifying the comparator in disability-related discrimination claims should prevail in the employment context, in view of the obligations under the EC Framework Directive.     

Pre-Trial Defence Rights and the Fair Use of Eyewitness Identification Procedures

This paper sets out the normative basis of a claim to procedural rights concerning the fair use of eyewitness identification procedures. It is argued that there are two aspects to suspects' procedural rights. The first aims to secure an opportunity for the suspect to participate in procedures where doing so might result in exculpatory evidence (a participatory right). The second is the state's obligation to take reasonable measures to prevent wrongful conviction on the basis of mistaken identification by providing the suspect with a satisfactory degree of procedural accuracy (a protective right). This normative analysis provides the basis of a claim that Article 6 of the European Convention on Human Rights provides a suspect with similar rights. The final part of the paper considers whether domestic procedure is compatible with these putative rights, and whether it could be said to provide an effective remedy if they were to be breached.
