Self-Regulation as Policy Process: The Multiple and Criss-Crossing Stages of Private Rule-Making

While there are many studies of self-regulation, they have not yet systematically analyzed the very process by which rules are developed and implemented. This article treats self-regulation as a process with sufficient autonomy and functional coherence to display identifiable stages, each of which deserves independent attention in turn. It draws from the literature on the stages of public policy processes and uses this as a template to identify and analyze the unique properties of private rule-making, while acknowledging the criticisms that have been made of excessive determinism and simplicity in some applications of the general idea of stages. The article shows that our understanding of self-regulation is significantly advanced by examining it as a process with stages but it emphasizes that the different stages of the self-regulatory policy process (agenda-setting, problem identification, decision, implementation and evaluation) are criss-crossed in numerous and interesting ways. It also shows that private rule-making often seeks to solve societal problems in domestic and international settings and is an important alternative to public regulation but self-regulation is rarely completely de-coupled from public authority. Instead, public authority is activated to solidify self-regulatory arrangements across the different stages of the policy process.     

Indigenous Australians and the rules of the social security system: Universalism, appropriateness and justice

Noel Pearson has recently argued that inclusion, over the last 30 years, in a 'passive' welfare system has been to the detriment of Aboriginal society. This article approaches the inclusion of Aboriginal people in the social security system from a slightly different perspective, while taking seriously Pearson's concerns. It argues that, despite norms and aspirations of universalism, rules within the social security system are social constructs derived from and intended for the particular social and economic circumstances of the dominant society. When those rules are applied to the very different social and economic circumstances of minority groups, such as Indigenous Australians, major issues of adaptation and interpretation arise. This article draws on research experience spanning 20 years on relations between Indigenous Australians and the social security system to illustrate the degree to which adaptation has occurred, in the pursuit of realism. However, it also argues that current relations between the social security system and Indigenous Australians are not just and fair because the rules of the system do not equally reflect Indigenous and non-Indigenous peoples' social and economic circumstances.     

The Changing Public-Private Infrastructure Mix: Economy-wide Implications

This article provides an economy-wide perspective on the changing role of the public sector in developing economic and social infrastructure in Australia. It analyses the scale and macroeconomic significance of the key economic and social infrastructure sectors — communication services, electricity, gas and water supply, transport, education, health and community services, government administration and defence. It then canvasses the major policy issues that have arisen in the progression from public to private infrastructure provision and considers why concerns about the trend fall in traditional public works spending may be misplaced in light of recent economic and institutional changes.
