全面推进依法治国视域下的人权保障

人权保障不等于人权,它来源于人权理论。它们的重心已悄然地发生着变化,即由以人作为人权的主体转换成了以国家作为人权保障的主要实施主体。视域是一种与主体有关的能力,是"精神的观"。而我国的人权发展进程也历史地注定了我国人权保障视域的独特性。当下,它的时代含义是:国家以保障人权为目标,更好地发挥法治的引领和规范作用。     

试析公共安全危机中的谣言

当今社会,各种公共安全危机事件频频发生,严重影响了社会的稳定。而谣言作为舆论的一种畸形形态,无疑诱发和加剧了这种危机状况,其危害性不言而喻,因此对公共安全危机情景下谣言的研究是十分必要的。本文分析了公共安全危机下谣言产生的机理和影响因素,并针对性地提出了抑制谣言的建议性对策。     

“混”:一个本土概念的社会学探索

本文将"混"作为一个可以用来反映特定行动与生活状态的"本土概念",从社会学视角予以探索。通过对各种文献材料的梳理,离析出四种类型的"混",即江湖之混、生存之混、应付之混和经营之混。并对"混"这一社会行动进行界定,即"行动者对于自身或者环境的非正当状况的顺应,这种顺应往往伴随着超越价值的缺失"。文章以游戏理论建立对"混"产生的条件进行分析的理论框架。最后以一个文学作品中的案例分析"混"在日常生活中的展开。     

What matters the most in curbing early COVID-19 mortality? A cross-country necessary condition analysis

COVID-19 represents a turbulent problem: a volatile, uncertain, complex, and ambiguous crisis, in which bounded-rational policymakers may not be able to do everything right, but must do critical things right in order to reduce the death toll. This study conceptualizes these critical things as necessary conditions (NCs) that must be absent to prevent high early mortality from occurring. We articulate a policy-institution-demography framework that includes seven factors as NC candidates for high early COVID-19 mortality. Using necessary condition analysis (NCA), this study pinpoints high levels of a delayed first response, political decentralization, elderly populations, and urbanization as four NCs that have inflicted high early COVID-19 mortality across 110 countries. The results highlight the critical role of agility as a key dimension of robust governance solutions—a swift early public-health response as a malleable policy action—in curbing early COVID-19 deaths, particularly for politically decentralized and highly urbanized countries with aging populations.     

变迁语境下人民监督员制度的反思与深化——解读《最高人民检察院关于实行人民监督员制度的规定》

人民监督员制度在历经7年的试行后得到了全面推行。然而,改革并非一劳永逸,制度的规范性文件、选任主体、监督程序以及监督效力等制约人民监督员制度发展的深层次因素仍然存在。在借鉴试点实践的经验和域外制度的基础上,推进人民监督员制度的法制化、确立独立的选任主体、形成正当的监督程序、强化监督的程序性效力是值得我们期待的发展方向。

处置群体性事件应关注微博因素

微博的快速发展和普及使其在舆情和群体性事件的转移扩散中扮演着重要角色。群体性事件的频发呈现出明显的微博因素,微博参与应对群体性事件具有角色优势。因此,必须从充分利用官方微博;培养微博意见领袖;与传统媒体有效互动;提高公职人员媒介素养等方面入手,提升运用微博应对群体事件的能力。     

对侵犯知识产权犯罪案件中“违法所得”的确认

＂违法所得＂是知识产权刑法及司法解释中的常见词语,但理论、实践界对＂违法所得＂的理解不尽相同,有的将其与＂销售金额＂联系起来,有的认为是扣除一定成本的利润;就是利润本身也存在不同的解释,如销售利润、净利润等。法律上的不确定给侦查办案增添了难度,因此,在法律层面必须明确＂违法所得＂的真正内涵,在不同案件中的具体核算方法。公安机关办理相关案件,取得＂违法所得＂证据的过程中,要重点注意现场处置;有价值会计资料信息提取;针对性的讯问及从交易双方获取＂违法所得＂记录等等。     

Inter-rater reliability of dynamic risk assessment with sexual offenders

Abstract

This paper describes the inter-rater reliability of the Structured Assessment of Risk and Need (SARN, formerly known as Structured Risk Assessment). The SARN is a structured framework for identifying sexual offenders’ dynamic risk factors. The SARN comprises 16 dynamic risk factors, categorized into four domains: Sexual Interests, Distorted Attitudes, Socio-Affective Functioning and Self-Management. Two studies, utilizing three samples, are reported. Study 1 examined the inter-rater reliability of four SARN cases with a sample of seven expert raters. Results indicated high inter-rater reliability amongst these participants. Study 2 examined the reliability of SARN with two samples who had received training before supplying inter-rater data (N=88). Results provided some support for the reliability of SARN. However, strength of reliability was dependent upon the method of analysis applied (percentage agreement, Cohen's Kappa, intra-class correlation coefficients). These results are discussed in terms of their clinical and methodological implications.     

Russia,NMD and the ABM treaty: The dangers of American unilateralism

In order to consolidate its strategic bilateral relations developed in Africa over the past 14 years, South Africa must choose five key ‘hubs’ (regional powers) in each of Africa's five sub-regions. In addition, South Africa should pick two additional ‘spokes’ (influential actors) in each sub-region. These 15 strategic partners can increase South Africa's engagement on the continent in the areas of diplomacy, conflict management, and trade relations. South Africa's bilateral relations would thus resemble a gigantic bicycle, with five hubs and ten spokes. The five hubs are Mozambique, Nigeria, the Democratic Republic of the Congo (DRC), Ethiopia, and Algeria. The ten spokes would be Zimbabwe, Angola, Burundi, Rwanda, Ghana, Côte d'Ivoire, Sudan, Tanzania, Egypt and Libya. It is around these countries that South Africa can build solid strategic bilateral relationships in Africa.
