This article discusses issues that restorative justice programs may face during implementation and lessons learned from an exploratory study. We examined various perspectives of multiple participants who experienced a Victim-Offender Mediation (VOM) program in a mid-sized Midwestern city in the U.S. The primary data source comprised 34 interviews with 37 participants including adult crime victims, juvenile offenders and their parents, mediators, and representatives from referring agencies. Observations complemented the interview data. Findings revealed patterns of victim marginalization during the processes used: victims were not prepared appropriately; were at times pressured by mediators to behave in certain ways; and, occasionally felt intimidated by offenders and/or their families. We discuss some factors that may have influenced the emergence of these patterns. This study revealed gaps between the guiding principles of restorative justice theory and field practices, particularly sensitivity toward victims to meet their needs. We suggest that restorative justice programs should consider using a monitoring system to ensure that the processes used remain consistent with the values and principles of restorative justice. 相似文献

This survey of three hundred and twenty undergraduate students attempted to determine their knowledge of crime and punishment in North Carolina. Respondents answered a series of open- and closed-ended questions regarding various legal topics, such as statutory rape and the legal ages for tobacco and alcohol use. The participants were also asked to list punishments for various offenses, such as possession of marijuana, driving while intoxicated, and rape. They were then asked to define certain legal terms such as larceny. The results indicated that most students were unable to provide correct corresponding punishments for many offenses. They were also unable to accurately define various legal terms, such as robbery or rape. The implications for stronger education in the area of criminal justice are discussed. 相似文献

ABSTRACT While collaboration among individuals, work groups, and organizations is central for understanding the performance of public agencies, most studies have focused on collaboration between organizations or sectors. We develop a model that focuses on two types of collaborative behavior: between persons (both horizontal and vertical) and between work units. We empirically test our hypotheses using data on work collaboration and perceptions of public agency performance from the United States federal government. We introduce a method for estimating the impact of different types of collaborative behavior that also accounts for nonlinear effects and a dependent variable that takes ordered values. We find that intra-organizational collaborative behavior has a large impact on organizational performance and that horizontal collaborative behavior between workers has the greatest impact among the specific types. 相似文献

One of the main assumptions of empirical studies conducted on the influence of goal ambiguity in public management is that goal ambiguity relates negatively to performance. However, this relationship has rarely been tested at the program level because common goal ambiguity and performance measures for disparate government programs have been scant. The availability of Program Assessment Rating Tool (PART) results for a number of federal programs provides the opportunity for an analysis testing the foregoing assumption. Measures of program goal ambiguity—target, timeline, and program evaluation—are shown to have negative relationships with different program performance scores, taking into account alternative influences or biases on performance. This analysis extends the theory of goal ambiguity by providing the first analysis of large‐sample federal programs. The sharp rise in U.S. incarceration rates has heightened long‐standing concerns among scholars and policymakers that lengthy incarceration permanently harms the future labor market outcomes of prisoners. If true, then lengthy prison sentences will not only punish criminals for crimes committed, but will also make it far more difficult for ex‐prisoners to reenter society as productive citizens. To investigate this claim I examine how increase in duration of incarceration affects subsequent earnings and employment. Comparing long‐serving prisoners with short‐serving ones in the Illinois state prison system, I find that the length of incarceration is positively associated with earnings and employment, even though these effects attenuate over time. The positive effects are stronger for individuals convicted of economically motivated and less violent crimes (such as property‐ and drug‐related offenses) than for those convicted of violent crimes (such as person‐related offenses). The effect is also stronger for prison entrants with self‐reported drug addiction problems. The deterrent effect of lengthy incarceration and rehabilitation during incarceration are possible reasons for this positive effect. However, because this paper analyzes men who served less than four years in Illinois prison and excludes the population of men who served their terms exclusively in jail, readers should be cautious about generalizing findings of this paper. © 2011 by the Association for Public Policy Analysis and Management. 相似文献
