《民法通则》是新中国第三次起草民法的重要成果,是商品经济的发展、经济建设和改革开放的需要,它反映了当时改革开放时代的发展要求,所以也促进了我国改革开放和社会主义经济建设以及精神文明建设的健康发展,标志着以政策手段调整民事关系为主的时代基本结束,又预示着我国正规的、大规模的民事立法的开始,在新中国民事立法史上具有重大的里程碑意义。回顾它制定的背景,可以从中总结出对我国现今的民法典编纂有益的、众多的经验和教训。 相似文献

How large a benefit is partisan control of the redistricting process? Do legal constraints on redistricting—such as the preclearance requirement of the Voting Rights Act—alter this benefit? Are institutions designed to reduce the benefit to partisan control—such as redistricting commissions—effective? To measure the effects of partisan districting on the electoral fortunes of the parties, we collect data on the partisan composition of state government, House election outcomes, and moderating institutions over an 80-year period. Our results suggest that over time, both parties have benefited from unified control, with the effects largest in states where voters were evenly divided among the parties and smallest in states where the controlling party had a large advantage in the electorate. The effects have changed over time, with both parties having equally benefited from control during the middle of the 20th century, the benefit largely disappearing in the late part of the century, and the Republican Party seeing a moderate advantage from control in the current century. The benefits of partisan control were not diminished in states with redistricting commissions. The preclearance requirement appears to have hurt the Democratic Party except when its vote share was very low. The aggregate effects of partisan redistricting are moderate in magnitude—in the modern period, this effect has typically been less than 10 House seats, with the last election where control of the House would have flipped in expectation occurring in 1954. 相似文献

《异议复议规定》第30条作为预告登记权利人提出案外人异议的审查依据,因其中"排除异议"及"符合物权登记条件"在解释上易生歧义,致实务适用意见不一。依执行理论,除所有权外,何种权利始可排除强制执行,应依实体法之性质、效力及执行目的或方法确定。经预告登记之权利并非实体权利,其性质应为兼具物权性、债权性及从属性的请求权。目前,我国预告登记在强制执行中的效力,立法未臻明确,但结合我国预告登记实体法之"再处分禁止效力"及"不动产登记簿冻结效力",藉由目的解释,应将《物权法》第20条第1款之"处分"进行扩张,使其效力覆盖强制拍卖、变卖等"处分"性执行措施。而案外人据以《异议复议规定》第30条提出异议的,法院不应适用于商品房预售合同备案登记、网签及受让物权预告登记以外的其他预告登记之情形,其"符合物权登记条件"之确认,应参照预告登记转本登记之理论,采实务通说之标准,具化为满足合法有效的商品房买卖合同,已办理预告登记及支付全部价款或依约定支付价款之要件。 相似文献

本文基于上海市五个大型居住社区(以下简称"大居")的问卷调查与实地走访,梳理了上海"大居"现有就业机会、服务资源的配置情况以及居民需求状况。调查显示,上海"大居"在社区商业设施配套、公共交通设施、文体娱乐活动、物业管理服务以及教育资源等公共服务配套方面仍存在供需失衡问题,尚不能满足居民更高层次的需求。因而,要通过加快优质公共服务资源的导入,扭转"大居"弱势群体集聚的薄弱态势,推动人口结构优化,带动市场化资源的注入,培育"大居"社区内生增长动力,将"大居"建成多阶层、多群体共荣共享的高品质社区。 相似文献

Inclusive growth is contested yet adopted by the World Bank to reduce poverty and inequality through rapid economic growth. Research has tested inclusive growth in sectors including agriculture, but few studies apply it to tourism which is significant for many developing countries. The paper interrogates tourism-led inclusive growth: supply chains, economic linkages/leakage, ownership, employment and expenditure. It draws from fieldwork in Vietnam where tourism has rapidly developed with partial economic benefits for local communities, but does not appear to fall within the inclusive growth paradigm. It is unclear if tourism-led growth will become any more inclusive in the short-to-medium term. 相似文献

Little has been done to quantitatively establish the connection between the middle class and a specific regime type. In an
effort to fill in the gap, this study uses Asian Barometer survey dataset to examine the attitudes and orientation of China’s
rising middle class. We find that the Chinese middle class does show higher democratic orientation than those we categorize
as lower class, but only if class is defined by occupation or by self-identification, and not by income level. We interpret
this result to mean that economic development offers new life experiences with the creation of new types of professions and
enhances people’s agreement with modern democratic values by arousing people’s consciousness of their new social class status.
