This essay investigates the interconnections between early Greek cosmology and legal theory. In particular, it demonstrate that spatial and legal concepts developed hand in hand, and that it would be mistaken to assume that legal terminology in cosmology, and/or spatial terminology in legal texts, are best read metaphorically. This state of affairs may be contrasted with contemporary legal theory, which often employs spatial terms metaphorically. The principal authors I␣consider are Solon, Anaxamander, Heraclitus and Parmenides. The essay concludes that justice and space/place were, for the Early Greeks, often equated—that distinct differing meanings for the two were not yet clearly established, and so, in a sense, there was both a spatial component to law, and a legal component to space. 相似文献

The article explores the textual construction of gender categories in the political discourse of Simón Bolívar by means of a close critical reading of his seminal writings made public between 1812 and 1820. The historical and political processes known as Latin American independence constitute a moment of radical transformation. It was during this period that the questions of political rights, nationality and citizenship were most open to debate throughout the continent. The article shows how the category woman is constructed ambiguously in Independence/anti-colonial discourse, how gender is employed to create hierarchical systems of social organization to legitimate the exercise of power by an elite of white creole men and how myth is deployed in order to reinforce gender hegemonies. It will be shown that in Bolívar's writings colonial relations are recast as family relations and political independence from Spain legitimated in terms of sexual difference and masculine domination. 相似文献

This study investigates the effects of federal policy and budgetchanges during the Reagan years as well as the revenue strategiesof governmental and private, nonprofit agencies in Stamford,Connecticut. Systematic examination of agency budgets and interviewswith agency directors in 1982 found widespread anxiety aboutpossible revenue decline, but few departures from traditionalrevenue strategies. In Stamford, federal changes produced revenueproblems for only a few agencies, most of which went about "businessas usual" and did not experience a budget crisis. The recent debate about the Transatlantic Trade and Investment Partnership (TTIP) has triggered widespread opposition to the trade agreement in Germany. It is not clear, however, what factors drive public attitudes toward transatlantic trade. This article explores the role of anti-Americanism in predicting attitudes toward TTIP among the German public. It argues that the impact of anti-Americanism depends on the extent to which political elites frame the TTIP proposal as a basic conflict between American and European values. Using data from two national representative surveys, it is found that attitudes toward America strongly predict support for the TTIP agreement. The results further demonstrate that the effect of national resentment is moderated by issue awareness, with citizens with a strong anti-American sentiment being significantly more likely to oppose the agreement if they follow the elite debate more closely. Taken together, the results suggest that national resentments are more important for the explanation of TTIP preferences than traditional factors such as partisanship, ideology and material concerns. 相似文献

In contrast to the findings of other studies, we conclude that human rights play a significant and substantive role in determining the distribution of U.S. foreign aid. We find that the foreign aid program relates aid to the need of recipient nations, rewards nations for furthering human rights, does not discriminate on the basis of race or religion, and responds to national security interests of the U.S. The finding that the program does what most people assert it should do provides a new explanation for the rigidity of distributions over time. 相似文献

This paper presents a case study of policy introduction, implementation and termination. It demonstrates how the coupling of a well-defined problem with a workable solution by advocates can generate policy change, even in an area where there has previously been scant governmental interest. It also reveals that increased public funding associated with policy implementation can provide administrators with the legitimacy and authority to advance reform.
