This article explains the development of international crime as a legal category. I argue that states’ pursuit of political rights claims empowers international lawyers to develop new legal categories to grant states new tools to pursue their interests. At the same time, lawyers have a stake in defending the autonomy of law from politics, thus pushing for the development of legal norms and institutions that go beyond the original state intent. States’ turn to law thus begets more law, expanding the legal and institutional tools to solve international problems while simultaneously enforcing a commitment to principles of legality. To demonstrate the plausibility of the theory, the article studies the construction of the concept of an international crime in the interwar period (1919–1939). In response to the Allies’ attempt to prosecute the German Emperor, international lawyers sought the codification of international criminal law and drafted enforcement mechanisms. The interwar legal debate not only introduced international crime into the legal and political vocabulary, it also legitimized a new set of institutional responses to violations of international law, namely, international criminal prosecution.  相似文献

Children exposed to intimate partner violence (IPV) are likely to develop behavior problems, but findings are mixed regarding whether girls and boys are differentially affected. Bem (Journal of Personality and Social Psychology, 31, 634–643, 1975) argued that gender role is an important predictor of mental health, and this relationship may differ for males and females due to societal gender norms. Given the gendered nature of IPV, we examined whether gender role interacted with gender to predict behavior problems in IPV-exposed children (n = 176). Among four-year-old children, gender-typed gender roles were a risk factor for girls but not boys, and androgynous gender roles were protective for both boys and girls on average. However, post hoc analyses indicated the amount of IPV exposure mattered; androgynous girls exposed to chronic IPV had more behavior problems. Results illustrate the importance of societal and family gender norms in determining children’s risk for behavior problems following exposure to IPV.  相似文献

Recognising that the stance of investigators could make a major impact on the quality and/or interpretation of development-study findings, a small investigation to explore researcher positions and roles was implemented. This was a subsidiary component of a larger health-development study which aimed to explore the evidence base for psychosocial and mental-health policy formulation and implementation in two conflict-affected, low-resourced countries. Five of the research team were interviewed by a sixth member in an open, semi-structured interview format, and the data were analysed thematically. The primary learning for the team, with wider implications for others in development research and practice, is that if the aim is to produce credible findings from investigations of this nature, it is important to exhibit a high degree of transparency regarding the role and position of each researcher, and an explicit attempt to be reflexive in relation to the associated challenges.  相似文献

Abstract. Using public opinion surveys conducted in the member states of the European Union, this paper seeks to provide a systematic understanding of public support for the EMU project and European–level monetary policy authority. We develop models of support for EU monetary policy that incorporate a utilitarian component and elements of multilevel governance that is emerging within the EU. These models are tested at the aggregate level of survey respondents. The results show that variations in attitudes to the common currency are driven by collectively–based considerations of the costs and benefits associated with the common currency project as well as the interaction of European–level politics and the domestic politics of the member states.  相似文献

  • Active citizen participation is increasingly being recognized as essential to effective public policymaking. A key challenge for public administrators is how to effectively engage constituents' diverse viewpoints in sound deliberation that will likely result in coherent, agreed judgments. This paper investigates one such public deliberation process, Australia's first Citizens' Parliament, which brought together 150 randomly sampled Australian citizens charged with the task of formulating concrete policy proposals to be considered by the Federal government. One unexpected outcome of this initiative, especially given Australian ambivalence about nationalism, was the emergence of a shared identity among participants that appeared to bridge cultural and geographical divides. We explore linkages between salient elements of the deliberative process, the emergence of a sense of ‘being Australian’, and the final agreed list of policy recommendations that indicated an understanding of and commitment to the ‘common good’. If the emergence of a shared identity is acknowledged as a key to the development of a coherent public voice, then further examination of these linkages will be critical to the efficacy of future public deliberations. Moreover, given the heterogeneous nature of the Australian electorate and the challenges inherent in the country's federal governance structure, the findings have significant implications for policymakers in similar constituencies, notably the EU and the USA.

Differences between public and private management have been studied extensively by comparing sectors, but not within cross‐sectoral collaborative arrangements. As participants in such arrangements have actually experienced both management styles, examining their perceptions of how these styles differ may contribute innovatively to existing literature. This paper compares such perceptions between public and private sector project members (N = 63) involved in four PPPs in the Netherlands. We assess (1) to what extent and under which conditions these project members view public and private management differently and (2) how they evaluate these differences. By triangulating quantitative and qualitative interview data, we examine Boyne's classical hypotheses and find that more than two‐thirds of the statements making reference to these hypotheses offer support for them; more so, the vast majority of such statements evaluate sectoral differences negatively. Intriguingly, type of PPP is a stronger determinant of perceived differences than the manager's sector of origin.  相似文献

Employees’ organizational commitment is associated with a number of positive outcomes, such as employee motivation, job satisfaction, productivity, and retention. But previous research has suggested that there may be important sector differences in both commitment and its explanations, yet results are very mixed. We study sector differences in affective organizational commitment among 1,043 public and private office workers who perform very similar tasks across sectors, testing the influence of factors thought to explain commitment and expected to vary between the sectors. We propose that the mixed results are due to different variables mediating the relationship between sector and organizational commitment. Conducting a multiple mediation analysis, we find that more hierarchy negatively mediates the relationship between public sector employment and organizational commitment. On the other hand, the relationship between public sector employment and organizational commitment is positively mediated by public service motivation and participatory management. This highlights the importance of not only studying simple sector differences, but also including relevant individual and organizational-level variables that can explain the mechanisms behind such differences.  相似文献

The present study embedded a qualitative substudy within a randomized controlled trial of housing services for child welfare-involved families to examine housing decisions made in the face of homelessness and child protection. Participants included a representative sample of caregivers (n = 19) randomized to receive the Family Unification Program—a permanent housing intervention for inadequately housed families under investigation for child abuse or neglect—or child welfare services as usual. Qualitative interviews 12 months after randomization assessed housing decision-making processes involved in keeping families safe and stable. Results indicated a push–pull dynamic that constrained housing choices regardless of whether permanent housing was made available. Caregiver housing decisions were constrained by time limitations, affordability, and access to services, whereas child and family safety was perceived as less important. Findings emphasize the need for housing-informed child welfare services to ensure the long-term safety of children in families experiencing homelessness.  相似文献

In most countries of Western Europe including Norway, the last decades have transformed the population as a whole to become both more secular and more religiously plural. This has had consequences on many levels, and is still being processed. For state institutions and for the civil society including faith communities, it has clearly entailed legal, political, and social changes. The growing plurality has also challenged alleged mono-cultural perceptions of religions, and established many new discourses on religion, values, and diversity as such. In this essay I will first briefly discuss the present situation in Norway regarding religious pluralism and relate it to interpretations of secularity particularly relevant to the Norwegian context. Then I will go more thoroughly into the concept of interreligious dialogue and ways to understand this phenomenon as one of faith communities’ responses to religious plurality. As a social practice that may provide insight in how religious plurality is negotiated in a dialogue – it may be described as a practical exploration of religious plurality from the inside - but also how it may project positions towards various understandings of secularity. Peter Berger’s concept of “The two pluralisms” and his request for theorizing on plurality rather than secularity opens up further exploration of interreligious relations such as interreligious dialogue, and it may provide researchers working empirically in this field with new insights in their studies. This contribution will not contest Berger’s suggestion of “the two pluralisms” but rather explore it further through empirical studies and suggested models of interreligious dialogue.  相似文献

What might be gained by learning to live with ‘the problem’ of irregular migration, rather than attempting to solve it? This article engages two senses of ‘the problem’ at stake: first, the ongoing nature of displacement and migration and second, the contested justice claims that sit behind different policy perspectives. The second sense of the problem (its political dimension) is rarely addressed explicitly in public debate. Yet direct engagement with the political dimension offers the potential to unlock debate from a polarised impasse. To make this argument, I first diagnose debate on irregular migration in terms of three archetypal positions and examine their implicit justice claims. I then argue for a more ambitious debate that pushes contending justice claims to their logical extensions. Debate of this kind requires a more coherent defence of justice claims, whether they are based in communitarian, cosmopolitan, anti-capitalist or hybrid values with respect to citizenship and political community. The article concludes with an illustration of how this approach can generate momentum for less circular, more sustainable and politically achievable policy responses. The argument is made with reference to illustrative examples from Australia and Europe but holds for a variety of contexts where ‘the problem’ is framed in similar ways.  相似文献
