The United States and Canada regulate firearms, particularly handguns, quite differently. With only a few state and local exceptions, the U.S. approach emphasizes the ability of most individuals to purchase, possess, and carry handguns. By comparison, Canada has a form of restrictive licensing for handguns that places a premium on community safety. The authors first review the potential individual and community level harms and benefits associated with these differing fre-arm policies. Using this information, they explore the ethical dimensions of the U.S. and Canadian approaches through three major themes of autonomy, prevention of harms, and social justice. The authors conclude that the Canadian approach is consistent with respect for the autonomy of persons, fosters the prevention of harms, and more appropriately furthers social justice.  相似文献

In July 2013, the Australian State of Queensland established the first fixated threat assessment service outside Europe to specifically assess and manage lone, fixated persons. The Queensland Fixated Threat Assessment Centre (QFTAC) is a collaboration between the Intelligence, Counter-Terrorism and Major Events Command of the Queensland Police Service and Queensland Health’s Forensic Mental Health Service. It has been modelled on the original Fixated Threat Assessment Centre (FTAC) which has been operating in the United Kingdom since 2006, with modifications to reflect local needs and differing mental health and legal practices. This paper describes the background to the development of these services, the rationale for their expansion to the Asia Pacific region, and outcome data for QFTAC’s first 12 months of operations. These findings support the efficacy of proactive FTAC-style approaches to managing the threat posed by fixated individuals to public figures and the wider community.  相似文献

Abstract:  Imaging is an integral diagnostic tool in mass fatality investigations undertaken traditionally by plain X-rays, fluoroscopy, and dental radiography. However, little attention has been given to appropriate image reporting, secure data transfer and storage particularly in relation to the need to meet stringent judicial requirements. Notwithstanding these limitations, it is the risk associated with the safe handling and investigation of contaminated fatalities which is providing new challenges for mass fatality radiological imaging. Mobile multi-slice computed tomography is an alternative to these traditional modalities as it provides a greater diagnostic yield and an opportunity to address the requirements of the criminal justice system. We present a new national disaster victim/forensic identification imaging system—Fimag—which is applicable for both contaminated and non-contaminated mass fatality imaging and addresses the issues of judicial reporting. We suggest this system opens a new era in radiological diagnostics for mass fatalities.  相似文献

This article bridges the gap between two theories that attempt to explain the gender - crime relationship. Power-control theory posits that power relationships of parents in the public sphere are reflected in their relationship at home. Different kinds of households are thus distinguished by degrees of patriarchy. Differential socialization generates gender differences in crime across households. Gottfredson and Hirschi's general theory purports that low self-control explains all crime across all groups, yet little research explored the link between low self-control and crime both among, as well as between, genders. Linking low self-control and power-control theories, this study examined the relationships gender, power-control, self-control, and crime. Results indicated that while low self-control explained both male and female criminality, the effect of parenting on the development of low self-control was complex; males and females differentially responded to parents' control. The gender-based processes that impact the development of self-control should further be explored.  相似文献

The current study focuses on predominant predictors associated with men’s and women’s engagement in driving under the influence (DUI) in an attempt to determine whether gender-specific interventions would be more affective at reducing impaired vehicle operation. A male-only subsample (n?=?863) and a female-only subsample (n?=?975) from a survey administered at a large Southeastern university containing self-reported measures of DUI were used to evaluate gender differences in motivations and correlates of DUI behavior. A series of logistic regressions containing indicators drawn from theories of deviant behavior (e.g., Akers’ social learning theory (SLT) and Gottfredson and Hirshi’s low self-control (LSC) theory) yield results indicating that differential association and imitation, both factors associated with SLT, are significant predictors for both gender cohorts’ DUI behavior. Low self- control was a significant predictor within female-only models, but not the final male-only models. This suggests that peer associations and modeling may be targets of intervention generally, but that, as it relates to DUIs, women may particularly benefit from programs focused at limiting impulsivity and risk-taking behavior as these are components of Gottfredson and Hirschi’s LSC construct.  相似文献

Prosecutors’ broad discretionary power has long been of interest to scholars, yet little is known about discretionary choices after conviction. This study addresses the gap by exploring prosecutors’ willingness to assist with exonerations. Using data from the National Registry of Exonerations (N = 1,610), the author identifies factors that influence prosecutorial assistance. Results from generalized ordered logistic regression models demonstrate that avoiding uncertainty and maintaining workgroup relationships drives decision-making. Findings indicate that prosecutors are less likely to support exonerations involving law enforcement or forensic misconduct, violent offenses, and inadequate legal defense and more likely to support exonerations involving innocence organizations, guilty pleas, and black and Hispanic defendants. These findings suggest that prosecutors’ interest in protecting professional reputations, maintaining relationships, and optimizing efficiency influences discretion in the postconviction stage just as in earlier stages of case processing.  相似文献
