With prison, jail, and probation caseloads overloaded, financial penalties appeal as alternative sanctions. Using probation data for cases sentenced in municipal courts, this paper presents regression analyses suggesting that judges tended to employ rational discretion in imposing economic sanctions, for monetary assessments without jail were most likely to be given to low-risk offenders and assignment of probation alone and jail terms was most strongly influenced by offense. The amount of the financial sanction was also significantly related to the type of crime. Controlling for individual attributes and offense, the odds of subsequent arrest and incarceration were significantly less for those given a financial penalty than for those receiving a jail sentence. 相似文献

Abstract While much is known about the relationship between Congress and regulatory agencies, there has been little examination of the role state legislatures play in the activities of state regulatory bodies, particularly those activities related to timely, salient policy issues. This article explores the relationship of state legislatures to medical boards, which are increasingly becoming more policy active. We find that state legislative involvement and influence are the most important determinants of policy‐active state medical boards; institutional elements play a secondary role. Major changes in the private health care delivery system affect legislative involvement and play an indirect role in predicting policy activism. As public resources become scarcer, private donations for capital projects and public services may become increasingly important. Modern donors, using the new philanthropy philosophy common now in the nonprofit sector, may desire more control over the use of their funding than in the past. This research examines the effects of private donations on capital decision making, and explores the balancing act required by public officials between best practices and private norms in this process. The study uses the city of Omaha, Nebraska case, where corporate and individual donors have made significant financial contributions for the construction of a convention center/arena and a baseball stadium. Findings include both costs and benefits of this approach, and may be beneficial for theory‐building related to this relatively unexplored topic, as well as for practitioners faced with similar needs and demands. 相似文献

This paper presents a model of police response to changes in crime frequencies and a criminal response model characterizing the deterrent effects of police arrest behavior. These models are estimated for data taken from police department records in the city of St. Louis. The underlying theoretical conception is that arrests constitute communication to criminals in general in addition to the specific deterrence achieved through the arrest it see Disaggregation in both space and time enables identification of the statistical models through measurement rather than through statistical manipulation. The models are estimated for burglaries under varying demographic conditions and using data organized through aggregation in time (by weeks) and space (by census tracts). Under some demographic conditions, both police response and deterrent effects on criminal behavior are enhanced. Under other demographic conditions, these effects are suppressed. Enhancements and attenuations arising from specific demographic conditions for both the police response and criminal response models have a similar pattern, consistent with the underlying communication hypothesis. 相似文献

Three theoretical models of the interrelations among associations with delinquent peers, delinquent beliefs, and delinquent behavior are examined. The socialization model views delinquent peers and beliefs as causally prior to delinquent behavior, whereas the selection model hypothesizes that associations with delinquent peers and delinquent beliefs are a result of delinquent behavior. The interactional model combines aspects of both the socialization and the selection models, positing that these variables have bidirectional causal influences on one another over time. Data to test for reciprocal causality are drawn from three waves of the Rochester Youth Development Study. Results suggest that simple unidirectional models are inadequate. Associating with delinquent peers leads to increases in delinquency via the reinforcing environment of the peer network. Engaging in delinquency, in turn, leads to increases in associations with delinquent peers. Finally, delinquent beliefs exert lagged effects on peers and behavior, which tend in turn to “harden” the formation of delinquent beliefs. 相似文献

Attempts to integrate the two predominant spatial theories of crime, social disorganization and routine activity theories, may benefit from examining empirical relationships at units of analysis smaller than the relatively large units characteristic of most ecological research (cities, SMSAs, census tracts, multiple city blocks). Small units of analysis, specifically, face blocks (both sides of a city block between two intersections) are analyzed in a study of street robbery within a medium-size southeastern U.S. city. Models of street robbery and street-robbery "potential" suggest a crime diffusion process. Several interaction effects between variables of social disorganization and routine activity theory are found, which may form the basis in future research for successful theoretical integration. 相似文献

The City of Mississauga is located on the western boundary of the Greater Toronto Area (GTA) in Ontario, Canada. As a municipality it is undergoing rapid urban growth, pressure from citizens to keep the taxes down, political pressure to reorganize the surrounding municipal areas, rapidly changing technology, increasing competition for economic development and increasing demands for high level services from its citizens. This article will indicate how, in the face of the challenging demands of the '90s, the city is making a significant shift in the ‘culture’ of the organization. The City is moving from a traditional style of management emphasizing control to one that stresses leadership and empowerment of the workforce. It involves changing from a hierarchical bureaucracy to an organization that is more flexible, responsive, innovative and creative with a strong customer focus. To meet the demands of this shifting culture there needs to be a highly skilled workforce. There are a number of initiatives in the City to accomplish this ‘cultural shift’. This article deals with the continuous learning aspect called Capability Development, focusing on Team Effectiveness, Continuous Improvement and Customer Service. We developed two phases for the learning. Capability Development Phase I outlined the concepts and tools for managers at all levels to be able to support the learning required to accomplish the ‘cultural shift’. Phase I included the City Strategic Plan, Management Strategy and Human Resources Vision and practical management tools. Phase II was designed for front line staff working in their ‘intact teams’. It incorporates the concepts and tools from Phase I and is being delivered by trained volunteer facilitators within the City. The characteristics of participatory institutions can be articulated in three main dimensions: input, process and output. The common assumption is that a dependency relationship exists, with process serving as a mediator between input and output. This paper puts the model to a rare empirical test drawing on a unique dataset of 70 Spanish advisory councils. Through a combination of exploratory factor and path analyses, we analyse the dimensionality of input, process and output and investigate the direct and indirect impact of inputs on process and outputs. Our analysis provides evidence that input factors have a direct impact on the output factor transparency, but their impact on effects on policy and participant satisfaction is mediated by the process factor deliberation. Further, the capacity of the public administration to steer the advisory council (wardship) mediates negatively the impact of input variables on transparency. The analysis provides a nuanced account of how different input and process design characteristics of participatory institutions have profound direct and indirect effects on their outputs. 相似文献
