North American first peoples: slipping up into market citizenship?

This article explores the nature of Aboriginal demands for a citizenship regime grounded in a substantive recognition of cultural difference and inherent rights in Mexico and Canada. It provides an overview of the different evolution of Aboriginal citizenship in each country but focuses on two recent development projects, the Puebla Panama Plan in Mexico and the Mackenzie Valley pipeline in Canada. These cases demonstrate the ways in which neo‐liberal globalism is reshaping the substantive recognition of Aboriginal cultural difference and inherent rights. While contemporary neo‐liberal rhetoric recognizes cultural difference, the models of development employed effectively separate territory from the ideas of self‐government, culture and identity. The article concludes that the neo‐liberal turn in the construction of Aboriginal citizenship undercuts potentially much richer conceptions of Indigenous citizenship offered by the First Peoples of North America.     

Modeling Judicial Federalism: Predictors of State Court Protections of Defendants' Rights Under State Constitutions, 1969-1989

Drawing on data collected by Barry Latzer and using a logisticregression model that employs pooled time-series, this articletests a variety of factors for their impact on state high courtdecisions to diverge from U.S. Supreme Court criminal proceduredoctrines from 1969 to 1989. Several factors predict the developmentof independent state doctrines protective of civil liberties,including popular-vote retention elections and longer termsof office for state court justices, high court reputations,state wealth, and regional distinctions (with western courtsmost likely to advance individual rights). This study representsonly a small step in understanding an area of judicial behaviorthat has been long ignored in the political science literature.     

Is the allocation of voting power among EU states fair?

It has often been claimed that the current allocation of votes among EU states is not fair. In this paper we verify this assertion by carrying out an evaluation of the distribution of power among the member states. The results show that the current distribution of votes for the qualified majority does not lead to a fair distribution of power whatever definition of the EU is considered. It can not be claimed however that the current voting process has a systematic bias in favor of certain states. We also present a simple method to derive voting weights which lead to a fair allocation of power.     

Agrarian structure,foreign investment in land,and land prices in Brazil

The recent global rush for farmland in Latin America has produced a dramatic increase in the level of foreign investment in land in Brazil. The current trend accentuates the ongoing process of foreignization of agriculture associated with the production of grains, sugar, ethanol and other commodities, increasing land prices. In response, the Brazilian government reestablished a legal mechanism for ‘controlling’ land-based foreign investment which has proven neither efficient nor effective in solving land concentration. This paper examines this issue by analyzing the causes of the increase in investment as well as the consequences of this process with respect to land prices, critically situating land-based investments and the government's policy response in a broader discussion of the demands of agrarian social movements.
