清代纪昀的《阅微草堂笔记》以其独特的话语方式用相当的篇幅讲述涉法故事,从直接宣传、借助鬼神信仰、与礼教相提并论三个方面宣传当时律例。其法律思想的特征为紧密结合儒家伦理精神,重视人情人欲,与传统的道德教化取向一致。     

Property and constitutional order: Land tenure reform and the future of the African state

The debate over land law reform in Africa has been framed asa referendum on the market – that is, as a debate pittingadvocates of the growth-promoting individualization of propertyrights against those who call for protecting the livelihoodsand subsistence rights of small farmers. This article arguesthat the prospect of land law reform also raises a complex bundleof constitutional issues. In many African countries, debatesover land law reform are turning into referenda on the natureof citizenship, political authority, and the future of the liberalnation state itself. The article describes alternative landreform scenarios that are currently under debate, and identifiesthe constitutional implications of each. The practical salienceof the issues is illustrated through reference to land reformpolitics in Côte d’Ivoire, Uganda, South Africa,and Tanzania.

超大型城市社会精细化治理现状分析与顶层设计——以上海市为例

城市治理问题的复杂性决定了治理模式的多样性,深入理解、系统把握超大型城市社会精细化治理的时代特征和内涵特点,探索基于现代信息技术的治理范式与机制路径,成为具有重要理论意义的实践课题。当前,上海市社会精细化治理成效明显,但仍存在顶层设计不足、数据平台分散、推进不均衡、感知度满意度较低等问题,其原因在于精细化理念和文化缺失的思想困境、缺位错位越位的治理主体困境、法制与监督不精密的制度困境,以及失衡与薄弱的技术手段困境。上海推进社会精细化治理,要按照“物联、数联、智联”三位一体原则,构建“线上线下融合、上下双向互动、流程驱动、科学决策、过程控制、法治保障”的社会精细化治理新模式,形成“两案三制一体”的治理体系。进一步,要更加注重人本主义,更加重视基层自治,更加关注多元主体诉求,更加彰显文化力量,充分运用现代科技,强化社会治理精细化本体建设和载体依托,优化超大型城市社会精细化治理流程和机制。     

公安行政问责制的完善

随着我国"问责风暴"向"制度问责"的转变,如何更好地完善公安行政问责制就成为一个紧迫而现实的课题。目前制约公安行政问责制功能发挥的因素主要包括:公安行政文化滞后、职权划分模糊、问责主体角色缺位、警务公开度有限和警察绩效评估机制不完善等。针对上述制约因素,营造公安行政问责文化、严格划分权责界限、强调异体问责、加强警务公开以及完善绩效评估机制就构成了完善公安行政问责制的基本思路。     

Shading,lines, colors: mapping ethnographic taxonomies of European Russia

This article explores the role of maps in the construction and development of ethnographic taxonomies in the mid-century Russian Empire. A close reading of two ethnographic maps of “European Russia” produced by members of the Imperial Russian Geographical Society, Petr Keppen (1851) and Aleksander Rittikh (1875), is used to shine a spotlight on the cartographical methods and techniques (lines, shading, color, hatching, legends, text, etc.) employed to depict, construct, and communicate these taxonomies. In doing so, this article draws our attention to how maps impacted visual and spatial thinking about the categories of ethnicity and nationality, and their application to specific contexts and political purposes within the Empire. Through an examination of Keppen’s and Rittikh’s maps, this article addresses the broader question of why cartography came to be regarded as such a powerful medium through which to communicate and consolidate particular visions of an ethnographic landscape.     

Public caseworkers' strategies coping with accountability demands

Public employees are required to manage multiple accountability requirements by investing in the relationship with those who demand accountability, making a commitment to the given tasks and anticipating what might happen. The purpose of the study is to explore how social caseworkers manage multiple accountability requirements compared to public managers. The analysis from child welfare caseworkers' interview data highlights a number of ways on how social caseworkers respond to multiple accountabilities. Although most of acts from caseworkers are exposed within the public managers' strategies, talking or discussing with coworkers and supervisors seems the caseworkers' contextual and endemic response. Discussions followed.
