Intellectual property and white-collar crime: report of issues,trends, and problems for future research

This research examines the association between intellectual property (IP) and whitecollar crime (WCC), and identifies future research that might benefit policymakers; federal, state, and local agencies; and the general public. Research methods include a review of literature, a review of information and data in IPR violations and WCC, and inquiry in areas that directly deal with IP laws and enforcement practices, such as law enforcement agencies, IP-based industries and private law firms.     

Continuities and Discontinuities in German Legal Thought

How does the history of your country and its legal traditions affect your identity as a citizen, researcher, teacher? In case you happen to be from Germany, how do you live with the memory of national crimes - and the fact that legal academia identified in significant numbers with the Nazi regime? Are there affinities in German legal traditions to anti-liberal ideologies and authoritarian mentalities? How did post-war Germany face its past? The essay does not try to address these questions systematically but through a narrative which seeks to trace the biographical impact of the German history.

     

From Suicide and Strain to Mass Murder

Mass media explanations and criminological profiles of mass shootings focus on the perpetrator’s individual psychological traits in their search for motive and meaning behind such horrific events. We consider the broader social context to better understand mass shootings. We focus on three recent high profile mass shootings in the United States – Aurora, CO, Newtown, CT, and Santa Barbara, CA as examples of people responding to various experienced strains with violence, and conclude with some ideas to help prevent such occurrences from happening again.     

Constraining a Shadowy Future: Enacting APAs in Parliamentary Systems

Single‐party parliamentary governments often have no institutional checks on their authority. Such governments can pass and implement policies constrained only by the need to maintain party loyalty and win elections. Literature on delegation suggests that such governments would never adopt reforms such as Administrative Procedures Acts (APAs) that are designed to constrain this freedom. Nevertheless, such governments do pass APAs: Greece, Portugal, Romania, Spain, and Sweden have all done so in the past 30 years. We argue that the possibility of losing power motivates parliamentary governments, both single‐party and coalition, to trade current policy loss for future gain with APAs.     

The Private Interests of Public Officials: Financial Regulation in the US Congress

Legislators' private financial holdings affect policy decisions. Due to financial self‐interest, we theorize that legislators whose personal investment portfolios include equities from firms affected by proposed policies vote for legislation that benefits those firms. We also theorize that legislators with greater personal exposure to equity investments support policies that benefit equities markets generally. We create a novel data set of legislators' personal stock investments and examine major congressional actions since the 1990s on financial deregulation and market intervention. US House members who own stocks in firms who benefit from financial deregulation vote for deregulation. House members with greater exposure to financial and automotive stocks support the financial and auto bailouts, respectively. General exposure to equities markets is also associated with support for key legislation boosting markets. The normative implications are significant, as legislators' private interests influence decisions in the public sphere.
