Enforcing trust judgments within the European Union: European Enforcement Orders

New rules have been introduced for enforcement of judgmentsin European Member States. Since 21 October 2005, for judgmentsdated after 20 January 2005 it has been possible to use a newenforcement system called the European Enforcement Order aswell as the old system of registering foreign judgments. Thisarticle examines the new rules as they apply to judgments intrust cases.

A Cross‐National Analysis of Party Switching

Though instances of party switching have been widely documented, there is little cross‐national research on this phenomenon. The prevalence of switching is therefore unknown, and the factors influencing this behavior remain unclear. Using the most comprehensive dataset on party switching ever constructed, we illustrate both that interparty movement is more common than previously assumed and that there are substantial differences in its prevalence across parties. To explain this variation, we examine the relationship between legislators' motivations, institutional arrangements, and switching. We find that motivational explanations are correlated with interparty movement and that institutional arrangements exhibit only limited direct influence on switching.     

Risk,Credit Constraints and Financial Efficiency in Peruvian Agriculture

Based on a panel data set, we use a two-stage analysis to evaluate the effects of access to formal credit on financial efficiency of farms in northern Peru. The first stage uses non-parametric data envelope analysis to estimate farm-specific measures of financial efficiency; 28 per cent of farmers are financially inefficient and credit constraints reduce profits of these farmers by an average of between 17 and 27 per cent. The second stage uses Tobit regression to evaluate the determinants of financial inefficiency; the results point to uninsured risk as a key determinant of financial inefficiency and suggest that policies to strengthen agricultural insurance markets would likely pay large dividends in rural Peru.     

Economic Governance on Trial: High Courts and Elected Leaders in Argentina and Brazil

Beginning in the 1980s, social and political actors across Latin America turned to courts in unprecedented numbers to contest economic policies. Very different patterns of high court–elected branch interaction over economic governance emerged across the region, with crucial implications for economic development, democratic governance, and the rule of law. Building on both institutional and strategic accounts of judicial politics, this article argues that high court “character,” a relatively stable congeries of informal institutional features, channels interbranch struggles into persistent patterns. Two case studies illustrate the argument. In Argentina, the high court's political character encouraged a pattern of court submission to elected leaders marked by periodic bouts of interbranch confrontation over economic governance. In Brazil, the high court's statesmanlike character induced interbranch accommodation. This study demonstrates that even in politically unstable settings, institutional features can shape law and politics.
