This paper seeks to make a contribution to the study of personhood in EU free movement law by linking a historical and doctrinal analysis with the internal transformation of the homo economicus in economic liberalism. It is argued that a shift can be observed in the government of mobility from “freeing up” the ability of the worker as a relatively passive subject tied to external economic mechanisms to the targeting of the individual him/herself as a responsible, active bearer of economic capability or “human capital”, whereby past socio‐economic conduct and prospective economic activity serve as the thresholds for the entitlement to rights. The essence of the “new” homo economicus of EU free movement law is situated at the intersection of the social and economic, serving as a rational frame for the government of the European mover on the basis of a mutual responsibility between the Union citizen and his/her host Member State towards social and economic activity, self‐sufficiency and integration.  相似文献

Competing models of antisocial personality disorder have important consequences for mentally disordered offenders and their management in the criminal justice system. In order to provide a fresh perspective on these enduring diagnostic problems, we conducted a prototypical analysis on 250 adult subjects' perceptions of psychopathy from a set of criteria, which included DSM-II, DSM-III, DSM-III-R, and Psychopathy Checklist (PCL) scores. Through principal components analysis we identified four factors: (a) impaired relationships and deception, (b) aggressive behavior, (c) nonviolent delinquency, and (d) frequent sexual relationships not attributable to mental illness/substance abuse. These factors appear to be more closely allied with PCL and two new proposals for DSM-IV than the current DSM-III-R model.We appreciate the efforts of David Di Giuseppe and Ireneusz Celejewski in data entry and management as well as the cooperation of the Ontario Science Centre in making this study possible.  相似文献

This article assesses the contributions of studies in the rational choice (RC) tradition to scholarly understanding of Latin American politics. It groups some representative works according to their use of RC assumptions, and also reviews some of the major works in the institutionalist tradition. It argues that works in the RC tradition have neither forced a major rethinking of established theories nor filled major lacunae, although they have illuminated some phenomena that were only partly understood. The RC approach works best for narrow questions in which power relations and structural constraints are stable, whereas its essential assumptions become untenable in questions that involve shifting power relations among social groups and the state over time.  相似文献

Sommaire: La politisation des administrations publiques par les partis fait l'objet dun débat permanent qui s'amplifie à chaque alternance du pouvoir. Elle est tantôt réprouvée comme une perversion dangereuse du modèle occidental d'administration, tantôt accueillie comme une forme plus moderne de gouvernement. Ce débat éthique campe bien les dimensions du probléme, il ne permet pas de l'analyser. Les ééléments d'analyse proposés dans cet article s'organisent autour de la distinction entre deux objectifs de politisation. 1) On peut politiser l'administration dans le but de placer directement ses resources et ses effectifs à la disposition des appareils de partis. L'administration devient alors un instrument de patronage ou de clientélisme. 2) On peut chercher à rendre un plus grand nombre de fonctionnaires politiquement solidaires des élus, de sorte que l'administration devienne un instrument plus efficace de con-crétisation des politiques gouvernementales. L'auteur discute des implications stratégiques de ces deux objectifs de politisation et soutient que, sans étre contradic-toires, ils se concilient difficilement. Abstract. The politicization of public administrations by the political parties is subject to increasing controversy each time there is a change of government. Sometimes rejected as a dangerous subversion of the western model of government, politicization is at other times welcomed as a more modern form of administration. Although this ethical debate quantifies the problem, the latter cannot be analyzed as a result. The analytical elements proposed in this article are based on a distinction between two objectives of politicization: 1) the administration may be politicized in order to place its resources and staff directly at the disposal of the party apparatus; governments thus become an instrument for patronage or special interests; 2) an attempt could be made to render a greater number of civil servants politically supportive of the elective representatives, so that the administration will become a more effective tool for implementing government policy. After discussing the strategic implications of these two politicization objectives, the author argues that, while not contradictory, they are often difficult to reconcile.  相似文献
