On the Regulation of the Discretion of Environmental Administrative Punishment: Based on the Framework of the Modernized Environment Governance System

With the increasing environmental risks, the limitations of legislative regulation, negative judicial regulation and weak administrative regulation make it difficult to regulate the exercise of the discretion of environmental administrative punishment, which also increases the difficulty of the implementation of environmental administrative penalty decisions. The government, enterprises and the public three-dimensional main body structure constructed by the modern environmental governance system provides a new framework for the discretionary regulation of environmental administrative punishment. Based on the traditional theories of administrative Law, three regulation mechanisms can be formed,which include administrative self-control, negotiation regulation, and the social regulation. These three regulatory mechanisms working together in the whole process of environmental administration would regulate and restrict the exerting of discretion of environmental administrative punishment.

试论我国习惯的地位及与国家法的关系——以“合会”为中心的考察

通过对合会这一广泛存在的民间融资习惯的分析,初步探讨习惯在我国的地位及其与国家法之间的关系.首先分别阐述了合会在制定法上与实际生活中的地位,认为国家制订法应当认可习惯,而习惯由于传统外在权威的缺失去也需要国家法的确认.在此基础上从实然和应然的层面探讨了习惯和国家法之间的关系,指出从现实角度来看,在司法、执法环节,习惯被国家法默认;而从理想的角度来看,习惯应当被国家立法所认可.

女性参政是实现人的基本权利以及政治决策主流化的产物。文章以社会性别理论为视角，结合中国的公共政策理论，通过对于政策制定的主体、政策内容以及政策实施过程三个重要环节的具体分析，考察我国公共政策中的女性参政问题，探讨妇女参政与社会制度、公共政策之间的关系，进而提出全面构建“社会性别主流化”的设想及具体策略，为切实促进男女两性的和谐发展与和谐社会的构建搭建坚实的平台。     

The legacy of the Korean War: Impact on U.S.-Taiwan relations

If there had not been a Korean War, the Chinese Communists would probably have invaded Taiwan in 1950. After the outbreak of the Korean War, the United States began to reverse its hands-off policy toward the Chinese Nationalists on Taiwan. The Korean War first compelled the United States to grant military aid to Taiwan and then put the island under U.S. protection. The war forestalled the deterioration of the ROC’s international status, but the legal status of Taiwan became undetermined in the eyes of U.S. policymakers. U.S. economic aid prevented Taiwan from sliding into an economic depression in the 1950s, and greatly contributed to the island’s later economic takeoff. He is the author ofThe Taiwan Security Triangle (Taipei: Laureate Publishing Company, 1989).     

关于"税权"概念的法律思考--兼与张守文先生商榷

税权的主体、标的和内容不具有同质性,难以总结出一般的特性和共性,只能对税权的各项子权利作个别的描述,所以无法将"税权"定位为所有税法权利的上位概念,而只能在非严格的意义上将其视为税收权利的简称.对任何法学概念,不管是借用概念还是固有概念,都必须严格界定其内涵与外延,不根据本学科内在发展规律的需要随意移植其他学科领域、特别是政治宣传领域的名词与制度,会造成学科理论基础的不稳定以及体系的紊乱,有碍于本学科的长远发展.     

The evolution of party images and party system in Taiwan, 1992–2004

This article examines the evolution of party images in Taiwan between 1992 and 2004. It shows that party images are not immutable, as while the DPP gained more positive images, the other parties gained more negative images during the research period. The results show that the Taiwanese parties have quite distinct party images. Taiwanese voters often tend to use ethnic background and the cross-Strait relations to define the parties. Party images also play a significant role in Taiwanese voting behaviour, even when other variables are controlled. Voters tend to vote for the parties that they have favourable impressions of. The results also have implications for how political parties package themselves to attract more votes and on the development of the party system in Taiwan.
