Miranda vocabulary forms the essential foundation for Miranda comprehension and subsequent decisions to exercise or waive Miranda rights. The purpose of the current study is the development of the Miranda Vocabulary Scale (MVS), designed to evaluate key vocabulary words found in Miranda warnings and waivers across American jurisdictions. A preliminary list of MVS words was refined by expert ratings and by each word’s discriminability between failed and good Miranda comprehension. Miranda and other measures were collected at multiple sites on 376 pretrial defendants. With further refinements, the MVS is composed of 36 words with excellent scale homogeneity and interrater reliability (r = .99). It also demonstrated good convergent and discriminant validity for cognitive abilities and psychological impairment.  相似文献

Solid-phase microextraction (SPME) followed by gas chromatography-mass spectrometry (GC-MS) is a simple, reliable technique for the recovery and analysis of many organic explosives. However, this technique is impractical for the analysis of ammonium nitrate-type explosives due to the extreme polarity, low molecular weight, and high volatility of the amine moiety. This article describes an initial investigation of a derivatization process utilizing alkylchloroformates that converts ammonium nitrate and methylammonium nitrate into a form suitable for recovery by SPME and analysis by GC-MS.  相似文献

We examined blame attribution as a moderator of perceptions of hate crimes against gay, African American, and transgender victims. Participants were 510 Texas jury panel members. Results of vignette-based crime scenarios showed that victim blame displayed significant negative, and perpetrator blame significant positive, effects on sentencing recommendations. Also as hypothesized, victim and perpetrator blame moderated the effect of support for hate crime legislation. Interaction patterns suggested that both types of blame attribution influence sentencing recommendations, but only for participants disagreeing with hate crime legislation. Three-way interactions with victim type also emerged, indicating that the effects of both types of blame attribution show particular influences when the victim is gay, as opposed to transgender or African American. Implications for attribution theory, hate crime policy, and jury selection are discussed.  相似文献

This study examines whether parents have the prerequisite knowledge about police interrogation that would allow them to compensate for youths’ knowledge deficits, protect their interests, and buffer against their vulnerability to coercion. A racially diverse urban/suburban convenience sample of 77 11- to 13-year-olds, 46 14- to 15-year-olds, and 47 16- to 17-year-olds and their parents completed a semi-structured interview on knowledge of legal rights and police practices. Results show that parents know more than younger adolescents about components of the Miranda warning and its behavioral implications but do not necessarily know more about police strategy or the parameters of parental protection. Age and socioeconomic status were associated with youths’ risk for poor knowledge. Among parents, IQ, race, and the child’s age predicted risk classification. Parent IQ, socioeconomic status, and youths’ justice experience, race, and age predicted whether families were classified as at risk for poor knowledge. The results question legal assumptions about parents’ capacity for protecting youths’ interests without intervention.

ABSTRACT

Restorative justice is an approach to incidents of harm involving a high level of support and accountability for people who cause harm. To date, there is neither federal regulation nor commonly applied standard of care for re-entry to campus by a student who has been found responsible for sexual misconduct. Restorative justice re-entry circles represent a promising approach to the reintegration of students, taking into account the needs of the individual survivor, the student who violated policy, and the safety concerns of the campus community. Using a case study, this article outlines an example of a re-entry circle at a university in the United States and discusses the lessons learned with regard to concerns about the student’s mental health status, issues of race and racism on campus, and the role of a trauma-informed approach to circle practice in incidents involving a complex interplay of mental health, social status, and race on campus.  相似文献

ABSTRACT

Few studies have examined police interrogation strategies from suspects’ perspectives, yet assessing suspects’ views about interviewer approaches could provide important insights regarding confession decision making. The current study is the first American survey to assess a diverse sample of adult jail inmates’ views on police interrogation tactics and approaches. The study explored US jail inmates’ (N?=?418) perspectives about how police should conduct interrogations. Potential dimensionality among 26 survey items pertaining to police tactics was examined using exploratory factor analysis. Group differences according to demographic and criminological variables were also explored. Four factors emerged, conceptualized as Dominance/Control, Humanity/Integrity, Sympathy/Perspective-Taking, and Rapport. Respondents most strongly endorsed Humanity/Integrity and Rapport strategies and were unsupportive of approaches involving Dominance/Control. Gender differences emerged for Dominance/Control and Humanity/Integrity, and Black respondents were more likely to value strategies related to Sympathy/Perspective-Taking. Suspects endorsed interrogation strategies characterized by respect, dignity, voice, and a commitment to the truth; they reported aversions to the false evidence ploy and approaches involving aggression. Overall, results from this incarcerated sample suggest that interviewees may be more responsive to rapport-building, non-adversarial strategies.  相似文献

Due to their high polarity and low vapor pressure, most amine salts of amphetamine-type drugs are not directly amenable to headspace recovery using solid-phase microextraction (SPME). Described in this article is a simple vapor-phase procedure for the conversion of solid drug salt samples into their free bases by the use of triethylamine. This process can be conducted simultaneously with headspace SPME, the outcome being that solid drug salts can be sampled directly for GC-MS without the need for dissolution and chemical processing. Potential applications for this methodology include the noninvasive recovery of drug traces from objects such as banknotes and garments. This new process for recovery of amphetamine-type drugs has been combined with on-fiber derivatization using alkylchloroformates. This extra step was included to improve the chromatographic performance of analytes and allow for the resolution of drug enantiomers.  相似文献
