It is an intriguing puzzle that women lawyers, despite less desirable working conditions and blocked career advancement, report similar satisfaction as men lawyers with their legal careers. The paradoxical work satisfaction reported by women and men lawyers obscures a more notable difference in their depressed or despondent feelings. Using a panel study of women and men lawyers practicing in Toronto since the mid-1980s, we find at least three causal pathways through which gender indirectly is connected to job dissatisfaction and feelings of despondency. The first path is through gender differences in occupational power, which lead to differential despondency. The second path is through differences in perceived powerlessness, which directly influence job dissatisfaction. The third path is through feelings of despondency that result from concerns about the career consequences of having children. The combined picture that results illustrates the necessity to include measures of depressed affect in studies of dissatisfaction with legal practice. Explicit measurement and modeling of concerns about the consequences of having children and depressed feelings reveal a highly gendered response of women to legal practice that is otherwise much less apparent. Women are more likely to respond to their professional grievances with internalized feelings of despondency than with externalized expressions of job dissatisfaction. That is, they are more likely to privatize than publicize their professional troubles.  相似文献

Trust is essential to successful business relations, particularly to the efficient operation of law firms. Trust fosters productive working relationships, favorable reputations, and a lucrative clientele. This paper contributes to research on law firm development through a consideration of social dynamics within law firms beyond traditional emphases on trading relationships and community solidarity. We introduce a social capital perspective on the evolution of trust and its consequences for commitment to the law firm. We argue that trust, specifically in the form of perceived distributive justice, is created and nurtured through social integration among law firm members. Yet, for women, who continue to be denied full access to these social networks and professional rewards, trust is undermined. Exclusion and emerging distrust prompt women to contemplate leaving their respective firms. This paper examines the bases of differential levels of trust and their impact on lawyers'intentions to leave practice.  相似文献

Relationships between children, parents and the state do notremain the same over time and are not necessarily consistentat any one time across policy arenas. These relationships, though,can remain unexamined and individually negotiated until theyare highlighted by major policy change. Such a change has recentlyoccured in Scotland, where the Antisocial Behaviour etc. (Scotland)Act 2004 has extended Antisocial Behaviour Orders (ASBOs) tochildren and introduced Parenting Orders (POs), which can requireparents to attend counselling or guidance sessions. ASBOs shiftstate intervention from focusing on children’s welfareand needs to focusing on their behaviour. The welfare-basedchildren’s hearing system will no longer be the primarydecision-making forum as the court is the decision-maker forboth these new orders. POs emphasize parents’ responsibilityfor controlling their children. POs provide a direct route forparents to receive support, which they did not have before,but only through a compulsory order. The Murray–Darling Basin incorporates Australia’s three longest rivers and spans four states and one territory. It is important for an agricultural industry worth more than AUS$9 billion per year, but is also the life source and the spirit of the Indigenous Yorta Yorta people. Here, we address whether the interests of the Yorta Yorta people can encompass the common interest of the wider community in the Basin, and how the colonial legacy and climate change of the past century continue to influence the realization of the common interest moving forward. We find that shared regional governance with an agreed outcome supports the ongoing sustainability of the country and its people, but because of the legal history of Australia since colonization, recognition and mutual respect are no less important. Further, we note that the increasing climatic variability and changing climatic mechanisms that now exemplify the southeast of Australia corroborates the need for adaptive planning with longer time horizons. These lessons are supported by the customary law and practice of the Yorta Yorta people.  相似文献

Largely overlooked in Fabian historiography and absent from major works of biographical reference, Emma Brooke (c1844-1926) was an early Fabian and successful novelist whose analysis of ‘the woman question’, and especially the sex question, significantly predates the better known critique by H. G. Wells. This posthumously published article examines Brooke's thinking over time, drawing on personal correspondence and literary representations, and offers further insights into the relationship between feminism and socialism in the 1880s and 1890s.  相似文献

This article examines the compelling enigma of how the introduction of a new international law, the North American Agreement on Labor Cooperation (NAALC), helped stimulate labor cooperation and collaboration in the 1990s. It offers a theory of legal transnationalism—defined as processes by which international laws and legal mechanisms facilitate social movement building at the transnational level—that explains how nascent international legal institutions and mechanisms can help develop collective interests, build social movements, and, ultimately, stimulate cross‐border collaboration and cooperation. It identifies three primary dimensions of legal transnationalism that explain how international laws stimulate and constrain movement building through: (1) formation of collective identity and interests (constitutive effects), (2) facilitation of collective action (mobilization effects), and (3) adjudication and enforcement (redress effects).  相似文献
