Conservatives—both political and religious—are more likely than liberals to support laws regulating traditional or religious morality. The current study applies a moral psychological framework to argue that the association between conservatism and moral regulation law support can be explained in part by binding morality, or a moral orientation that privileges group needs above individual needs and includes concerns about absolutism, collectivism, and purity. Binding morality may directly promote support for moral regulation laws, which enforce traditional rules, discourage deviance, and require adherence to customs regarding bodily and spiritual purity. Binding morality may also indirectly promote support for moral regulation laws by motivating perceptions that “immoral” behaviors are harmful to innocent victims. I test these hypotheses using three analytic samples drawn from the General Social Survey (N = 3669, 7120, 369). Results show that, as expected, binding morality (especially purity) mediates the effects of political and religious conservatism on laws regulating pornography, marijuana, abortion, and euthanasia. Additional analyses exploring views about pornography show that binding morality (especially collectivism) is associated with perceptions of immorality as harmful, which in turn is associated with support for regulation.  相似文献

Studying public attitudes toward rehabilitation is not a new phenomenon. However, not much research is available on this topic from Asian countries. The present study explores public attitudes among Taiwanese people toward rehabilitation efforts in general, and the Rehabilitation and Protection Act (RPA) in particular. Using a sample of N?=?333, we asked Taiwanese residents age d18 and older about their support for the RPA, and their support for rehabilitation initiatives for three types of criminals: drug offenders, violent offenders, and sex offenders. Using a univariate model, we found that only two variables??age and stereotypical knowledge??had a statistically significant effect on whether an individual supported rehabilitation initiatives. Findings also indicate overwhelming support for the RPA and rehabilitation in general. We discuss these findings in a cultural context, and make recommendations for future research.  相似文献

In this introductory essay to the Special Issue, I argue that both family law and disability rights law scholars should examine a key point of intersection across areas: legal capacity or the law's recognition of the rights and responsibilities of an individual. For example, parental termination proceedings center on parental fitness and functional capabilities. I contextualize the articles in the Special Issue by Leslie Francis and Robyn Powell on the role of reasonable accommodations for parents with disabilities in parental termination proceedings. In addition, I call upon legal scholars, family law courts, and practitioners to reimagine governing legal standards in family law according to principles of universal design to shift the baseline capabilities associated with parenting and parental fitness.  相似文献

Existing theories of global civil society are problematical for two reasons. First, they assume that transnational organisations can assist world-wide democratisation without questioning either the representativeness of such organisations, or their accountability, or the potentially negative ramifications of their actions for international political equality. Second, despite placing new emphasis on political agency outside of the state, many accounts of global civil society ultimately reproduce statist discourse by reducing action in global civil society to a struggle for rights. This misrepresents global civil society since arguments for rights are, inter alia , arguments for the state, whereas the agency of global civil society immanently questions the legitimacy of the state.  相似文献

This study focuses on a series of legal, extralegal, and systemic variables presumed to affect the workings of criminal-justice systems. These variables are employed first to analyze the decision of the court to refer defendants for presentence investigation when such a referral is not mandatory, then to examine how these referrals, once made, influence disposition. The relationship of legal representation to disposition is also explored.The findings contradict conventional wisdom regarding the advantages to defendants of legal representation and of presentence reports. Lawyers do not appear to influence either referral or sentencing. The presentence reports are requested by judges seeking to individualize their sentencing decisions, but this process of individualization is as likely to result in harsher sentences as in greater leniency.  相似文献

In cases of partial or poor print recovery and lack of database/suspect print, fingerprint evidence is generally neglected. In light of such constraints, this study was designed to examine whether ridge density can aid in narrowing down the investigation for sex identification. The study was conducted on the right‐hand index digit of 245 males and 246 females belonging to the Punjabis of Delhi region. Five ridge density count areas, namely upper radial, radial, ulnar, upper ulnar, and proximal, were selected and designated. Probability of sex origin was calculated, and stepwise discriminant function analysis was performed to determine the discriminating ability of the selected areas. Females were observed with a significantly higher ridge density than males in all the five areas. Discriminant function analysis and logistic regression exhibited 96.8% and 97.4% accuracy, respectively, in sex identification. Hence, fingerprint ridge density is a potential tool for sex identification, even from partial prints.  相似文献

This article explores the implications of Giorgio Agamben's genealogy of government for our understanding of critique. Agamben argues that the providential government of the world of Christian theology has bequeathed to the West an ontology of will and command. Replacing the pantheistic world of Stoic late Antiquity, the Christian world must be other than it is. The lack that this introduces is central to Agamben's account of nihilism, as it was also for Nietzsche. But what does this mean for critique? Does critique belong to the nihilistic tradition of the West; occupying the still-warm seat of God inasmuch as it finds the world wanting as if from the outside? Does this mean we are left only with affirmation—passively acceding to the world as we find it? Or is this alternative of world-rejection/world-affirmation a false one? Agamben's concept of use seeks a way out of it.  相似文献
