Birchall and Benwell. Murder in a Canadian swamp

On 21 February 1890, two woodsmen working in densely wooded Blenheim Swamp in southern Ontario, Canada, stumbled upon the dead body of a young Englishman who had been killed by two gunshot wounds to the head. He was identified as Frederick Benwell by a married couple, the Birchalls, who had traveled with him and another man, Pelly, from England to New York City by ship about 1 week before. The Birchalls lied regarding Benwell's subsequent movements. Questioning Pelly revealed to Detective John Murray that both Pelly and Benwell had replied separately to Birchall's advertisement for young men of means to become partners with him in a large Canadian farm, a deposit first being required. Birchall had been observed taking Benwell from Buffalo, New York, to Blenheim Swamp, for in reality there was no farm. There he had shot Benwell, leaving the body partially exposed. He then tried unsuccessfully to lure Pelly to his death in Niagara Falls. The Birchalls were arrested. Reginald Birchall was tried, convicted, and hanged. His attempt, including murder, to turn the so-called farm pupil colonization scheme to his own benefit had been frustrated by the dogged work of the master Canadian detective Murray.     

Presbyterian Hospital of Dallas v. Harris: a dubious consequence of piecemeal health care legislation

For almost forty years, legislators have advocated comprehensive measures designed to assure Americans quality health care. Instead of implementing an integrated health care plan, Congress has intermittently enacted statutes which address specific health care delivery problems. At times the judiciary has stretched the ambit of existing health legislation in response to particular plaintiffs' urgent claims. This Case Comment examines the dilemma of piecemeal legislation and judicial policymaking as exemplified by Presbyterian Hospital of Dallas v. Harris, a Fifth Circuit Court of Appeals health care financing decision whose outcome Congress has flatly rejected.     

State-Local (Chicago) Relations in Illinois: The Harold Washington Era, 1984

Since Harold Washington became mayor of Chicago in 1983, relationsbetween the city and the state have changed significantly. Forone, the mayor is no longer the power-broker in state politics.The perception that Richard J. Daley controlled state governmentmay have been a myth, but today—after the mayoraltiesof Bilandic and Byrne, and with Washington now in office—eventhe myth no longer prevails. The continuing conflict in thecity council, with Washington's forces being in the minority,has also contributed to the change in state-local relations.The city council divisions carry over to a divided legislativedelegation in Springfield. Underlying the present situationare maneuvers by the various potential candidates for the 1987mayoral election. Some clues as to the outcome can be seen inthe election returns for U.S. Senator in the 1984 contest betweenincumbent Charles Percy and Congressman Paul Simon. Black votersdeserted Charles Percy in 1984; in the past, they had stronglysupported him.     

Sidney Kaye, Ph.D. Internationally renowned forensic toxicologist

The importance of Dr. Sidney Kaye's contributions in the field of forensic science cannot be over-emphasized. He can be called a pioneer in the field of forensic science and forensic toxicology because of the many contributions he has made to analysis, the literature and poison control, as well as activities in alcohol and drug analysis. He has been fortunate in being a part of history through his relationship, as a student, to Dr. Alexander Gettler, the founder of modern-day forensic toxicology, and by working with Dr. Gradwohl in Saint Louis, Missouri in the 1950s, when the American forensic sciences were being organized. Dr. Kaye is one of the founders of the American Academy of Forensic Sciences, the foremost and largest forensic science organization in the World. It is for these reasons that he received the Alexander O. Gettler Award by the Toxicology Section of the American Academy of Forensic Sciences, for outstanding analytical achievements in forensic toxicology, at the annual meeting of the American Academy of Forensic Sciences, in Las Vegas, Nevada, on February 14, 1985.
