Abstract

Is the harmonization of financial regulatory regimes possible in East Asia? Focusing on corporate governance, which many see as a critical part of the 1997 Asian financial crisis, and which is also seen as unresponsive to calls for change, this paper argues that such harmonization is possible, but that it will not be according to the standards advocated by the International Monetary Fund, World Bank, Organisation for Economic Co-operation and Development, and other international organizations. At present, actors generally feign compliance with these international rules and standards. The pattern of noncompliance is reflective of two types of regulatory models at work in East Asia, which correspond to democratic and nondemocratic regimes. The manner by which these political institutions mediate the influence of key actors determines corporate governance outcomes. Three cases illustrate the key dynamics: Singapore (nondemocracy), South Korea (democracy), and pre- and post-World War II Japan (change from nondemocracy to democracy). By identifying the key actors that determine regulatory outcomes, this paper points to a more realistic regulatory framework. This alternative framework is a compromise between the standards advocated by international organizations and the domestic political realities of East Asia.  相似文献

The present paper discusses issues arising from the use of an interactive digital software tool to analyse multimodal communication. The focus is on the ways in which such technical resources and associated techniques enable the analyst of social semiosis to apply different types of analysis, and provide the site for critical reflection upon the results of such analyses. The aim is to present an argument for the use of an interactive digital software application as a meta-semiotic tool. Three major challenges for scholars engaged in multimodal social semiotics are addressed in pursuing this aim, specifically with reference to the development of digital interactive analytical resources. Firstly, scholars are faced with the task of not only accounting for an increasing range of semiotic resources, but also for the way different semiotic phenomena interact to produce meaning. Secondly, the multimodal semiotician has a broad range of analytical approaches potentially relevant to any task to draw upon. Thirdly, the nature of contemporary media forms offer challenges themselves in terms of access, analysis and presentation of analysis.  相似文献

The EU Distance Selling Directive that was implemented in UK law in the Consumer Protection (Distance Selling) Regulations 2000 has provided guidelines for the protection of consumers undertaking distance transactions. The following paper discusses the provisions of the Directive with particular reference to e-commerce via the Internet, highlighting some possible areas for further consideration. Articles within the Distance Selling Directive are examined for problems of legal interpretation and implementation. There is discussion of: Article 2 (Definitions) and difficulties with its fundamental concepts of 'supplier' and 'consumer'; unnecessary exemptions in Article 3 (Exemptions); the 'local taxes' headache (and others) in Article 4 (Prior Information) and using e-mail under Article 5 (Written Confirmation of Contract). Under Article 6 (Right of Withdrawal), the 'cooling off period', exempted goods and services, refunds and reclaiming goods, and for Article 7 (Performance) substitute goods and contract law implications, are investigated. This article provides a perspective on strategic trends in the NATO alliance and the broader transatlantic relationship. It evaluates the extent of NATO's successes and failures over the last 15 years in the areas of the Balkans, NATO enlargement, and the international campaign against terrorism. The central conclusion is that, while NATO's members have significant technical reforms available that could help to reinvigorate the institution, none is likely to come to fruition without a major change in strategic concepts on both sides of the Atlantic.  相似文献

Dependency theory has cast new light on the workings of the international political economy, and on the relations between more and less developed countries. Insofar as dependency theory aims at specifying generalsystemic constraints on the behavior of Third World states, its ability to explain/predict how particular Third World states respond to these constraints is limited. Our concern is with the foreign policy responses of the LDCs. The comparative foreign policy approach to this question has attempted to account for cross-national variation in foreign policy responses of LDCs with variation in theirdomestic features, i.e., attributes, capabilities, and regime types. Here we suggest that an understanding of the foreign policies of the LDCs can be enhanced by adding an explicitly dyadic perspective to dependency and comparative foreign policy approaches, conceptualized as a form of patron-cliency.  相似文献
