There is little regulation of collaborative reproduction--the use of the eggs, sperm, or embryos of a third party to create a child biologically unrelated to at least one intending parent. This Article argues that the dearth of regulation should be assessed from a children's rights perspective and accordingly adjusted. After examining the effects of the experimental reproductive technologies, it concludes that traditional family law preferences and policies are undercut by the deliberate creation of collaboratively reproduced children. The lack of regulation might stem from constitutional protection afforded parents in the right of privacy and substantive due process cases. The author, however, contends that collaborative reproduction implicates the rights of children and requires a separate balancing of rights not contemplated in other cases. Collaborative reproduction also requires regulation because of its spill over effects on the acceptability of cloning. The Article concludes by offering several possible regulatory responses to the problems posed by collaborative reproduction. 相似文献

This paper considers two specific difficulties in developing a code of ethics for the public sector, the contested nature of the values to be expressed in a code of ethics and the organisational demands of a corporate managerialist framework which uses performance indicators. Using the example of the Western Australian public sector code of ethics, the authors conclude that a good strategy for developing a public sector code of ethics will recognise contestability, demonstrate philosophical integrity in the code, mesh the code with identified performance indicators and provide whistleblower protection. The strategy described provides a sufficient framework for any public sector bureaucracy to develop a justifiable code of ethics for use by public sector employees. 相似文献

Mixed electoral systems seek to combine elements from different voting methods so as to maximise the numbers of individually accountable constituency MPs, while achieving more proportional outcomes in terms of parties' representation. This paper looks in detail at two kinds of mixed systems: variants of the Additional Member System; and AV Plus (or SV Plus). We examine how they would have operated in British conditions during the 1990s—how ballot papers would be structured, how voters respond to them and what electoral outcomes would have resulted. Both approaches offer good prospects for achieving a consensus amongst electoral reformers on an alternative to first-past-the-post elections. We also show how the Jenkins Commission's proposals can be located within the broader development of 'British AMS' by the Labour and Liberal Democrat parties. In addition, we quantify the main impacts of the policy choices which the Commission made in designing the proposed system to be submitted to a referendum. The British case will be a key one for the wider debate in political science about the endogenisation of voting system changes within party systems. 相似文献

This study was divided into two parts. The first part consisted of an investigation of the frequency of television viewing among a sample of 2302 15-year-olds in 12 comprehensive schools. Subjects were divided into two groups, high and low frequency viewers, according to their own estimate of viewing time. The general picture which emerged (with some overlap of scores) was that high frequency viewers tended to be more neurotic and introverted; less intelligent; had less favorable attitudes to school; were less likely to think sport was important; were more likely to be bored in their leisure time; and possessed different social attitudes than low frequency viewers. The second part of the study investigated the program preferences of a subsample of over 900 subjects drawn from the main study. The article argues that the increase in crime and urban violence in Argentina, especially in Buenos Aires, can be explained as an outcome of the interaction of four factors: the new social relations established by neoliberalism; the incapacity of the state to resolve the social conflicts which have arisen from these new social relations; the failure to democratise the security forces; and the exclusion of a sector of society from the rights of effective democratic citizenship. This paper develops a simple econometric strategy to operationalise the United Nations Children’s Fund’s (UNICEF’s) conceptual framework for nutrition. It estimates the extent to which child stunting correlates with investments in water, sanitation, and hygiene (WASH) across population groups (poor and nonpoor) and residence (urban and rural). Moving away from estimating single intervention marginal returns, the empirical framework of intervention packages is tested in Tunisia, a country with notable but uneven progress in reducing stunting. A successful nutritional strategy will thereby require mapping the distinctive intervention packages by residence and socio-economic status, away from universal policies, that more strongly correlate with reduction in stunting. 相似文献
