COMMENTARY ON WARSHAK'S "BLANKET RESTRICTIONS: OVERNIGHT CONTACT BETWEEN PARENTS AND YOUNG CHILDREN"

In a previous issue of this journal, Richard A. Warshak provided a summary of the developmental literature as it bears on overnight restrictions during custody arrangements. Here, the authors comment on points of agreement and disagreement with Warshak based on their reading of the theoretical and empirical literature on development. Particular reference is made to Warshak's interpretation of attachment theory and research. Points of agreement include the importance of fathers and all caregivers in the infant/young child's life as well as the overstatement in the literature of the significance of separation experiences and a "sensitive period" for attachment. Points of clear disagreement include what the author contends is an erroneous review of the empirical literature on overnights with other caregivers. Based on their review of the data on overnight visitation, the authors conclude on a more cautious note.     

Celebrating Kate: The Criminal-Celebrity of Sydney Underworld Figure,Kate Leigh

Combining historical study with cultural criminology, this paper analyses the criminal-celebrity of Sydney underworld figure Kate Leigh. It seeks to demonstrate how the three main factors of public resonance—crime type, context and image—created the celebrated criminality of Leigh. Without public resonance, Leigh would have simply remained another criminal within society. An important element of Leigh's celebrated criminality was her ability to manage a public image that was accepted within the impoverished, working-class communities of eastern Sydney. Leigh became a criminal icon through an entrepreneurial style based on the anti-authoritarian and egalitarian values of working-class life in eastern Sydney. Criminal-celebrity theory provides a framework for understanding the factors enabling the celebration of criminals in society. It also informs historians about the ways in which criminals can manipulate their public image in an effort to legitimise their activities and gain acceptance in the community.     

A rapid wire-based sampling method for DNA profiling

Abstract: This paper reports the results of a commission to develop a field deployable rapid short tandem repeat (STR)‐based DNA profiling system to enable discrimination between tissues derived from a small number of individuals. Speed was achieved by truncation of sample preparation and field deployability by use of an Agilent 2100 Bioanalyser^TM. Human blood and tissues were stabbed with heated stainless steel wire and the resulting sample dehydrated with isopropanol prior to direct addition to a PCR. Choice of a polymerase tolerant of tissue residues and cycles of amplification appropriate for the amount of template expected yielded useful profiles with a custom‐designed quintuplex primer set suitable for use with the Bioanalyser^TM. Samples stored on wires remained amplifiable for months, allowing their transportation unrefrigerated from remote locations to a laboratory for analysis using AmpFlSTR^® Profiler Plus^® without further processing. The field system meets the requirements for discrimination of samples from small sets and retains access to full STR profiling when required.     

EC Competition Policy: Is the Role of the Substantial Part of the Common Market in Determining Jurisdictional Subsidiarity Redundant?

The importance of the principle of subsidiarity lies in its role in drawing the demarcation line between EU and member state responsibility for policy formulation and implementation. In theory, the application of the principle of subsidiarity appears relatively straightforward based on the scale and effects of the action in question. The reality is somewhat more complex, at least in respect of two competition policy instruments—Article 102 EC and the ECMR. At the heart of this complexity is the little understood notion of a substantial part of the common market which, relative to competing jurisdictional subsidiarity tests, can fail to assign cases to the appropriate jurisdiction. This leads to the conclusion that the substantial part test is superfluous as the affects trade criterion and the distinct markets test perform the allocative role more effectively in relation to Article 102 and the ECMR respectively.     

Hyperthermia,Thermal Injuries,and Death from a Forced Convection Heat Source: A Case Report and Experimental Model

Heat‐related deaths of children are most often encountered in the context of enclosed vehicles in summer months. Deviating from this, a 16‐month‐old boy was found unresponsive in a stroller that was placed adjacent to a space heater during mid‐winter. The cause of death was hyperthermia and thermal injuries. Manner of death determination was difficult due to alleged surrounding circumstances. To understand the time‐course of this child's injuries, a child death scene investigation was performed; the stroller and space heater were recovered. In a re‐enactment of the events, a slaughtered pig approximating the child's size was warmed using a water bath and placed in the stroller beside the space heater. Cutaneous temperature measurements showed rapid initial temperature rise with subsequent steady increases. Tanning of the skin was seen on periodic direct observations. Internal temperature monitoring illustrated steady increases. This experiment was essential in classifying the manner of death as homicide.
