The Echo of a Sentimental Jurisprudence

This article revisits what the poet Samuel Taylor Coleridge termed the ‘rage of metaphysics’, the grand intellectual engagement that defined the late eighteenth and early nineteenth century Enlightenment. It does so in order to retrieve an alternative jurisprudence, one that described itself as much in terms of sentiment as of sense. It is suggested that one of the most striking expressions of this jurisprudence can be found in Adam Smith's Theory of Moral Sentiments. This attempt to retrieve a sentimental jurisprudence chimes with a wider intellectual movement, headed by the likes of Richard Rorty and Martha Nussbaum, which seeks to reinvest a ‘new’ humanism in both domestic and trans-national legal and political order. It speaks more particularly to recent debates surrounding the nature of human and civil rights, and enjoys an added resonance in the context of recent attempts to fashion a jurisprudence of ‘reconciliation’ in South Africa and elsewhere. Hemolysis and hyperkalemia complicate malignant hyperpyrexia during anesthetic death

A healthy, 15-year-old male received a thiopental, nitrous oxide, oxygen, enflurane anesthetic for appendectomy. Cardiac arrest, following succinylcholine administration, was associated with marked hyperkalemia (potassium levels 8.7 to 11.6 meq), hemolysis (hematocrit fall from 41.7 to 26.6%, plasma hemoglobin 27 mg/dL), and creatine phosphokinase (CPK) elevation (8900 units). Vigorous resuscitative therapy including dantrolene was unsuccessful. The diagnosis of malignant hyperthermia was made by the marked CPK elevation on blood samples drawn during resuscitation and analyzed by the Medical Examiner's Office.     

Finkelhor's precondition model of child sexual abuse: A critique

Abstract

This paper critically discusses an extremely influential multi-factorial theory of child molestation, Finkelhor's Precondition Model. This model was one of the first comprehensive theories of the sexual abuse of children and represents a significant achievement. It provides a clear framework for approaching the study of men who have sexually abused children and has lead to both clear treatment goals and clinical innovations. It has rarely, however, been systematically critically examined and the cogency of its core constructs evaluated. Our analysis suggests that alongside its strengths, Finkelhor's Precondition Model has some conceptual problems. It suffers from vagueness; contains overlapping constructs; and a rich array of vulnerability factors that require teasing out and clarification. The model's attempts to provide a taxonomy highlight the diversity inherent in child sexual abuse, but it has not yet provided a structure to adequately inform treatment.     

Is ABCM Destined for Success or Failure in the Federal Government?

The days of ballooning federal budgets are over. Today, both the president and Congress continue to strive for a balanced budget, while encouraging federal agencies to improve service delivery of the various programs and entitlement benefits provided to their customers. Stakeholder involvement and public opinion about how agencies run their "businesses" are increasingly scrutinized. Trends such as competition for service delivery through franchizing, privatization, and outsourcing are causing an entirely new way of looking at how support and program services are managed. This article explains how the success or failure of activity-based costing management (ABCM) is dependent upon its ability to link the resolution of these external factors with internal business needs, while providing government managers with a better understanding of how to use ABCM to steer their organizations into the future. We also describe the current and future status of ABCM installations at various federal entities where ABCM was recently introduced and where interviews, conducted a year ago, were updated to describe how ABCM is helping these entities align external factors to internal needs. These federal entities are the Immigration and Naturalization Service, the Financial Management Service, and the Veterans Benefits Administration.     

The early use of radio for political communication in Australia and Canada: John Henry Austral, Mr Sage and the Man from Mars

The comparative study of electioneering is an emerging field. One of its driving concerns has been to chart the "Americanisation" or convergence of campaigning methods employed in very different settings. Sometimes the assumption is made that this convergence began with the recognition - first in the USA - that winning elections demands the skilful use of television. A comparison of the early use of radio in election campaigns in Australia and Canada demonstrates that the "Americanisation" of campaigning pre-dates the advent of television. There are clearly gaps in what is known about the early use of the wireless for political broadcasting in Australia. However in 1923-24 E.R. Voigt visited the US and, on his return, urged the NSW Trades Hall to establish 2KY for propaganda purposes. In the 1930s the NSW Labor leader Jack Lang was quick to adopt the "fire-side chat" formula devised for Franklin Roosevelt. In the 1940s R.G. Menzies, the founder of the Liberal Party, also came to see radio as a powerful weapon after observing its political use in USA. Not surprisingly the 1949 Liberal campaign which returned Menzies to power made extensive use of radio. It is often remembered for its "John Henry Austral" radio ads which are claimed as a breakthrough, but which appear to imitate earlier US and Canadian election campaigns - notably the Canadian Tories "Mr Sage" broadcasts of 1935.     

El Título en la Mano: The Impact of Titling Programs on Low‐Income Housing in Texas Colonias

This article analyzes the impact of The Community Resources Group Receivership Program undertaken from 1998 to 2002 that provided clean property titles to residents in several informal housing colonias (subdivisions) in South Texas. Survey data were gathered from 260 low‐income households comprising two populations: those who had secure title from the outset, and those who were beneficiaries of the land titling program. Focus group interviews were conducted to explore how the beneficiaries construct the meaning of ownership before and after title “regularization.” Formal titling consolidates understandings of absolute property relations in comparison with de facto rights born of use (legal or not), which strengthens people's sense of self‐esteem and potential for political involvement. We found that, contrary to conventional wisdom, title provision per se appears to have little direct impact either upon home improvement or upon residents' receiving enhanced access to credit and financial services. We also found evidence that informality and illegality is likely to reemerge as owners die intestate, and as they revert to informal land market property transfers.     

Women in Television in the Multi-Channel Age

This article explores the impact of structural and technological change on women's employment in the UK television industry. It looks at the challenges faced by women in working in what has become since the mid-1980s a largely freelance industry where short-term contracts, informal recruitment procedures and long, unpredictable work schedules mean that women find it increasingly difficult to combine a career and family. Through case studies of individual careers, of a women's magazine programme for S4C Digital and a survey of women's credits on a selection of the newer channels (Sky One, UK Living and Channel 5), it argues that technological advances in digital transmission and production will not improve working conditions and opportunities for women's participation in all areas of the industry if they continue to replicate existing practice.
