SECRETARY OF STATE MARSHALL,GENERAL CLAY,AND THE MOSCOW COUNCIL OF FOREIGN MINISTERS MEETING OF 1947: A RESPONSE TO PHILIP ZELIKOW

This commentary challenges the major conclusion of a 1997 article which appeared in this journal. There, Philip Zelikow argued that previous treatments of the Council of Foreign Ministers 1947 meeting in Moscow erred in their characterization of the role of US Secretary of State Marshall. Earlier studies, in Zelikow’s view, failed to understand that Marshall, refusing to be constrained by the recently announced containment policy, made a serious effort to meet Soviet demands for reparations from current German output. It is contended here that a review of the evidence, especially materials from the John Foster Dulles papers and from British archives, does not support Zelikow’s conclusion.     

Network relationships and standard adoption: Diffusion effects in transnational regulatory networks

The soft law measures that transnational regulatory networks produce have become increasingly important in regulating cross-border market activity. However, domestic agencies vary considerably in terms of the rate by which these soft law measures are adopted, and the ways in which they spread across jurisdictions are not well understood. This article argues that existing theoretical explanations referring to socialization or power dynamics have a specific network-structural pattern associated with them, and that longitudinal network analysis can be used to test their hypothesized effects. In particular, we study the widespread adoption of the International Organization of Securities Commissions’ (IOSCO) Multilateral Memorandum of Understanding (MMoU). Based on a longitudinal dataset (2002–15) of the inter-agency relationships between securities regulators (n = 109), we use Stochastic Actor-Oriented Models (SAOM) to predict the rate at which transnational standards are adopted by domestic agencies. The results indicate that standard adoption is contagious in the network of securities regulators.

Verfassungsrechtliche Bedenken gegen die RHG Novelle 2009

Im Jahre 2009 wurde durch eine ?nderung des B-VG und des RHG die Kompetenz des RH zur Prüfung privatwirtschaftlicher Unternehmen auf Betriebe, welche durch den Bund „tats?chlich beherrscht“ werden, ausgeweitet. Der folgende Beitrag m?chte zeigen, dass es nicht m?glich ist, diesen neuen Tatbestand ausreichend abzugrenzen. Somit handelt es sich um einen unbestimmten Gesetzesbegriff, welcher Tatbestandsmerkmal einer Kompetenznorm ist. Dies stellt nach der hier vertretenen Ansicht einen Versto? des § 12 (1) RHG gegen Art 18 Abs 1 B-VG dar.     

An American Perestroika in Dutch Cities? Urban Policy in the Netherlands at the End of a Millennium

This paper discusses the implications of the recent adoption of interactive forms of governance in Dutch urban policy. Advocates of this new approach claim that interactive governance will have positive effects for (1) the quality of urban democracy and urban governability and (2) for the solution of the information problems inherent in coping with (wicked) urban problems. On the basis of an extensive evaluation of the implementation of the new policies in four of the 25 Dutch municipalities involved, these claims are critically assessed.
