ABSTRACT

When confessions are entered into evidence in criminal courts, issues of coercion and voluntariness are important and often contested matters. Occasionally, defense attorneys proffer expert witnesses to testify about the coercive pressures of an interrogation and the risk of a false confession. Such testimony is often ruled inadmissible on the grounds that it does not inform the jury beyond its common knowledge. In our effort to test this judicial assumption about common knowledge, we surveyed jury-eligible laypeople (n?=?67) and social scientists specializing in interrogation and confessions (n?=?54) regarding their opinions about the coerciveness of prohibited interrogation tactics, maximization techniques, minimization techniques, and suspect risk factors and compared their ratings with a set of independent t tests. Laypeople gave lower ratings to the coerciveness of all sets of items representing interrogation techniques, and lower ratings to the vulnerabilities associated with suspect risk factors, as compared to social science experts. The disparities between laypeople’s and experts’ perceptions of coercion in interrogations demonstrate that such issues are not fully within the common knowledge of prospective jurors, and suggest the need to provide jurors with expert witness guidance when tasked with evaluating confession evidence.  相似文献

Megaprojects continue to play a prominent role in promoting economic development, and have proliferated rapidly worldwide. But, as they have grown larger in number, size, and complexity, their planning, implementation and ultimate success become increasingly problematic. Most encounter unexpected difficulties and seldom achieve their original objectives. This article addresses the reasons for this state of affairs by focusing upon the relevance of the Rational model of decision making to the case of the new Denver International Airport. It traces its evolution and considers the extent to which the Rational model explains the major events. It concludes that this model has only limited explanatory power because it does not incorporate political elements which play a major role in megaprojects. The Rational model can be successfully applied to an entire project only where the political system permits a powerful agency to design and implement the project. This condition is rarely met in democratic societies, especially in the U.S. Furthermore, its applicability is limited by the new environment in which planning takes place, an environment that is marked by the emergence of new actors and increasing turbulence and uncertainty. Accordingly, recognition of the role of power suggests that the utility of the Rational model is limited and that alternative planning approaches that emphasize consensus building and flexibility need to be developed for megaproject planning.  相似文献

Democratic transition and institutional change do not necessarily guarantee greater political inclusion, particularly when it comes to the policy influence of civil society groups. Rather, political inclusiveness requires strategic adaptation among societal actors. Actors need to seize upon opportunities endemic to political change. This article provides a comparative analysis of health care reform in democratizing Taiwan and South Korea, focusing on two social movement coalitions, the National Health Insurance Coalition in Taiwan and Korea's Health Solidarity. Both movement coalitions were critical in shaping welfare reform trajectories in Taiwan and South Korea during the late 1990s, despite having been shut out from earlier episodes of health care reform. I argue that these groups (1) strategically adjusted their mobilization strategies to fit specific political and policy contexts, (2) benefited from broad-based coalition building, and (3) effectively framed the issue of social welfare in ways that gained these movements ideational leverage, which was particularly significant given the marginal place of leftist ideas in the postwar East Asian developmental state model. Throughout the developing world, Non Governmental Organisations (NGOs) are involved in various aspects of an increasing number of policy interventions. The donor community has lent considerable support to this strategy. One of the key assumptions behind the strategy is that the greater involvement of NGOs in policy processes will result in more resources being distributed to the poor, and will also facilitate the establishment of a policy process which is more inclusive and egalitarian. Here the involvement of NGOs in an important land redistribution policy initiative is used to examine both these assumptions. While there is strong evidence that more land was redistributed to the poor as a result of NGO involvement, the actual mechanism or process for deciding the distribution of land was not found to be all inclusive or completely egalitarian. This ambivalence serves as a timely critique to the naive optimism and simplified assumptions underpinning development thinking and practice. Copyright © 2002 John Wiley & Sons, Ltd.  相似文献
