INNOVATION IN DISPUTE RESOLUTION

This article reports on a study of the case settlement process used in the Connecticut Superior Court Family Division to resolve child protection and placement disputes. Key elements of the formally titled Case Status Conference are presented and evaluated for their effectiveness and efficiency through interviews with legal and judicial professionals familiar with the conferencing procedure.     

Development in the Commonwealth Caribbeans after a half-century of independence: insights from transnational and regional perspectives

After 50 years of formal independence in the anglophone Caribbean, this article suggests gains for both analysis and policy may be made by something of a paradigm shift towards a focus on transnational and regional relations. This is especially so for the myriad small, particularly island, states which have always been relatively ‘open’ especially as contemporary governance demands proliferate as indicated in the first section below. And it holds potential for island communities in the Indian and Pacific Oceans as well as the Caribbean, especially for those associated with inter- and non-state Commonwealth networks; these now include not only the original established ‘Dominions’ of Australia, Britain and Canada but also 2/5 BRICS, or 25% of the G20. A focus on the transnational and regional helps to transcend the old binary of ‘vulnerability’ versus ‘resilience’.     

Two heads are better than one? How to effectively use two interviewers to elicit cues to deception

Background. We examined the effect of a second interviewer's demeanour on cues to deception. We predicted that a supportive demeanour would be the most beneficial for eliciting verbal cues to deceit, as it would encourage truth tellers, but not liars, to say more. In addition, we examined the extent to which interviewees deliberately made eye contact with the interviewers. Liars take their credibility less for granted than truth tellers, and therefore have a greater drive to be convincing. Liars are thus more likely to monitor the interviewer to determine if the interviewer appears to believe them. Method. Participants appeared before two interviewers: the first asked all the questions and the second remained silent. The second interviewer exhibited either a supportive, neutral, or a suspicious demeanour. Results. Truth tellers provided significantly more detail than liars, but only in the supportive second interviewer condition. The effect of a second interviewer's demeanour on detail was perhaps remarkable given that the interviewees hardly looked at the second interviewer (less than 10% of the time). Liars displayed more deliberate eye contact (with the first interviewer) than truth tellers did. Conclusions. A supportive second interviewer has a positive effect on interviewing. We discuss this finding in the wider contexts of investigative interviewing and interviewing to detect deception.     

The development of the comprehensive health assessment tool for young offenders within the secure estate

Health inequalities are high among offending groups. The comprehensive health assessment tool (CHAT) is a semi-structured assessment developed to provide a standardised approach to health screening for all young offenders admitted to the secure estate. The four sections of the CHAT (physical health, mental health, substance misuse and neurodisability) were evaluated within a two-phased study of male adolescents (aged 15–18?years) within a young offenders institution in the north-west of England. Within Phase 1, a consecutive sample of 127 new receptions was assessed using the physical health, mental health and substance misuse sections of the CHAT against a range of reference standard assessments. Phase 2 of the study evaluated the neurodisability section on 93 male adolescents against reference standard tools. The four sections of the CHAT demonstrated fair to good convergent validity when compared against reference standard tools in male offenders. The diagnostic accuracy rate was 76% for mental health, 63% for physical health, 83% for substance misuse and 53% for neurodisability when compared against reference standard assessment tools. The introduction of the CHAT offers the opportunity to enhance existing reception screening practices and create an integrated approach to the assessment of health needs across the secure estate.
