This article explores the role of Children's Contact Services (CCSs) in protecting children's right to express, and have heard, their wishes in contact disputes. The findings presented are drawn from the Australian Children's Contact Services Project and were based on 142 interviews with representatives from the government, the courts and legal profession who refer families to CCSs, service staff, as well as the parents and children who use the services. An analysis of client data from 396 families who had used one of six contact services in Victoria and Queensland during the month of August 2003 was also conducted. The findings suggested that CCSs successfully engaged children in a “dynamic self‐deterministic” process where children were able to explore their own wishes in relation to contact visits over time as their relationship goals changed. This analysis examines supranational constitutionalism in the European Union (EU). In particular, the study focuses on the role of the European Court of Justice in the creation of women's rights. I examine the interaction between the Court and member state governments in legal integration, and also the integral role that women's advocates—both individual activists and groups—have played in the development of EU social provisions. The findings suggest that this litigation dynamic can have the effect of fueling the integration process by creating new rights that may empower social actors and EU organizations, with the ultimate effect of diminishing member state government control over the scope and direction of EU law. This study focuses specifically on gender equality law yet provides a general framework for examining the case law in subsequent legal domains, with the purpose of providing a more nuanced understanding of supranational governance and constitutionalism. 相似文献

New media technologies, such as the internet and email, have been seen as providing opportunities to reinvigorate representative democracy and parliamentary institutions. This article examines the use of new technologies by Australian Members of Parliament (MPs). It looks at the growth and function of MPs' websites and assesses how far such technologies might facilitate changes in their electorate, party and parliamentary roles. We analyse what factors persuade MPs to move online and how they then use the technologies. The results indicate that while websites amongst legislators are growing, they are used primarily as supplementary, administrative tools. Overall, technological innovation in the Australian Parliament is still relatively rare and it appears there are systemic barriers that limit the potential of information communication technologies (ICTs) in the representative process. 相似文献

Over the last 25 years, voters in 20 California counties approved “local transportation sales taxes” to pay for transportation projects. A growing source of revenue, they generate roughly $2.5 billion per year. Four features explain their popularity: they require direct voter approval; funds are raised and spent within the counties that enact them, so voters experience benefits directly; most automatically expire; and they usually specify the improvements to be financed. These taxes are an important revenue source, but tend to favor capital investments over operations and maintenance. They have enhanced local governments' decision‐making authority, but may have made regional transportation planning in multicounty regions more difficult to achieve. 相似文献

How individuals respond to innovative technologies depends on how motivated they are by an array of internal and external factors and the informational and cost barriers they face. To better understand technology adoption decision making we (i) assess changes in intent to purchase plug‐in vehicles in response to reductions in their price and (ii) identify motivators that incline new car buyers toward plug‐ins under status quo and reduced vehicle cost scenarios. We find that individuals already inclined toward alternative vehicles have a higher interest in plug‐ins under a reduced‐cost scenario than individuals who favor conventional vehicles. We also find that individuals who shift their vehicle preference from conventional gasoline to plug‐in vehicles are motivated by material factors and fears relating to the innovative technology, whereas those shifting preferences between less to more innovative technologies are likely to be motivated by a mix of material and nonmaterial factors. 相似文献

This study examines in-depth interview data from thirty male juveniles incarcerated in a private correctional facility in the Midwest. Comparing the perceptions and experiences of 14 white male youth with 8 Native American, 4 black, and 4 Latino participants, white privilege was reflected in responses involving perceptions of the self as a ‘criminal’. Youth of all races described the effect of correctional facilities on their self-identification as a ‘criminal’ and youth of color were more likely than white youth to report the feeling that other community members viewed them as criminal before and after being arrested. Overall these findings demonstrate the ‘clean slate’ that white youth begin with compared to youth of color. Ultimately, time spent in a correctional facility appears to liken white youth’s perception of themselves as criminals to the self-identification of youth of color. Policy implications include implementing alternatives to incarceration, such as community service requirements to reintegrate youth into the community and avoid the negative effect of incarceration on the identities of juveniles. For youth of color, reducing racial discrimination is necessary to end the self-fulfilling prophecy and the sense of being labeled a criminal by the community prior to incarceration. 相似文献
