Electronic banking and how courts approach the evidence

Banking systems are so complex, that it is essential for a court to fully understand the weaknesses to be able to assess the evidence when faced with dealing with disputed transactions involving ATMs and on-line banking. A bank will make every effort to restrict the amount of evidence it has to provide to prove its case, but it is for the judge to be aware of the characteristics of electronic evidence, so that a fair trail can be conducted. This article considers the burden of proof in banking cases, and argues that not every court has succeeded in providing a claimant with a fair trial of the evidence.     

Intimate partner violence, social support, and employment in the post-welfare reform era

This prospective study used 3 years of longitudinal data to explore relationships among intimate partner violence (IPV), perceived emotional and material social support, employment stability, and job turnover among current and former female welfare recipients in the immediate post-welfare reform era. Higher levels of current IPV and lower levels of current social support predicted less stable future employment; however, current employment stability did not predict either future IPV or future social support. Current social support did not predict future IPV, and perceived social support did not mediate the relationship between IPV and employment stability during a 3-year period.     

Identity and its verification

The European Commission's eJustice Strategy seems to contemplate that all lawyers will be issued with an ‘identity card’ card, perhaps intended to include a key for making digital signatures. The Council of Bars and Law Societies of Europe (CCBE) is proposing to introduce such a card. The purpose of this article is to clarify what ‘identity’ is and what is involved in verifying it, and to offer some general observations about identity cards. Although written with the eJustice proposals in mind, nevertheless the purpose of this article is to address the topic in its widest sense, which means it affects identity and its verification, whatever the circumstances.     

Are people who cooperate ‘rational altruists’?

In experimental games, as in natural situations, people are often observed acting to the benefit of others even at considerable cost to themselves. Such behavior is contrary to the assumption of selfish behavior, but it is not necessarily contrary to the assumption of rationality: People cooperating under these circumstances could be ‘rational altruists’ who base their decision on the magnitude of the external benefit, as well as on the costs to themselves. We test that proposition using a prisoners' dilemma experimental paradigm. If it is correct, we should observe higher levels of cooperation as the external benefit in such games increases. But we do not — whether external benefit is measured in terms of number of individuals benefiting from a cooperative choice or the total dollar benefit produced. Cooperation must be explained otherwise.     

Talking Cop: Discourses of Change and Policing Identities

This paper presents empirical and theoretical analysis of the enactment of New Public Management (NPM) within the UK police service. It draws on empirical material gathered in a two-year study that explores the ways in which individual policing professionals have responded to, and received, the NPM discourse. Theoretically informed by a discursive approach to organizational analysis, the paper focuses on the new subject positions promoted within NPM that serve to challenge traditional understandings of policing organization and identities. The paper examines the implications of this for policies that promote community orientated policing (COP) and increased inter-agency partnership. The paper argues that the promotion of a more progressive form of policing, based on community orientation and equality principles, may struggle to gain legitimacy within the current performance regime that legitimizes a competitive masculine subjectivity, with its emphasis on crime fighting.
