This article posits that biographical writing on High Court judges generates insights that may otherwise be overlooked in explorations of national history and politics. Firstly, the article addresses the relative scarcity of such biographies in Australia. It then explores themes common to the existing works and the ways in which they are evoked. The article canvasses some possibilities inherent in judicial biography, expanding briefly on the themes of national and gender identity, before surveying some of the minor controversies of the genre, including the question of who is best qualified to write it. The discussion concludes with the suggestion that the development of this genre would provide nuanced material for legal scholars, historians and political scientists alike.  相似文献

This article analyses the formation, presentation and reception of two seminal exhibitions: Australian Painting: Colonial, Impressionist, Contemporary (1962–1963) and Canadian Painting 1939–1963 (1964). The presentation of these exhibitions at London’s Tate Gallery reflected the institution’s support for “old dominion” Commonwealth members. The exhibitions also highlight the differing visions of the Canadian and Australian governments concerning the relationship between art, diplomacy and politics during the Cold War. In Canada, Vincent Massey (Governor General 1952–1959) played a key role in ensuring that all forms of Canadian art were promoted internationally. Massey wanted to connect with the European and American avant-garde and to be part of a multiracial Commonwealth. This contrasted with the rather “old-fashioned” views of the Australian prime minister, Robert Menzies, and the Commonwealth Art Advisory Board. They supported a Commonwealth dominated by the “white dominions” and the initial exhibition plan for Australian Painting recalled previous British Empire art shows. The British response to the Canadian and Australian exhibitions is also discussed. British critics preferred the nationally identifiable “exotic” art found in Australian art to the transnational forms of international abstraction in Canadian art. Eventually, Australia “caught up” with Canadian cultural policy following the establishment of the Australia Council.  相似文献

This article outlines recent debates over nuclear energy and wind farms in an age of growing concern about climate change. Proponents of these technologies have used “trade‐off” frames to promote these technologies in the face of current and potential opposition to them. This article examines the nature and limits of the trade‐off frames being used and their probability of success. We argue that using the language of trade‐offs is generally a suboptimal framing strategy: trade‐off frames remind the public of the costs associated with particular policies, and therefore play into the hands of policy opponents. However, policy advocates may turn to them when the costs of a technology are well known and are perceived as high. In such cases, trade‐off frames may help to justify controversial policy solutions. Like any frames, the trade‐off frames used in the debate over climate change solutions both illuminate and obscure the deeper issues involved in energy policy reform.  相似文献

Semaan et al. (J Forensic Res, 2020, 11, 453) discuss a mock case “where eight different individuals [P1 through P8] could not be excluded in a mixed DNA analysis. Even though … expert DNA mixture analysis software was used.” Two of these are the true donors. The LRs reported are incorrect due to the incorrect entry of propositions into LRmix Studio. This forced the software to account for most of the alleles as drop-in, resulting in LRs 60–70 orders of magnitude larger than expected. P1, P2, P4, P5, and P8 can be manually excluded using peak heights. This has relevance when using LRmix which does not use peak heights. We extend the work using the same two reference genotypes who were the true contributors as Semaan et al. (J Forensic Res, 2020, 11, 453). We simulate three two-donor mixtures with peak heights using these two genotypes and analyze using STRmix?. For the simulated 1:1 mixture, one of the non-donors’ LRs supported him being a contributor when no conditioning was used. When considered in combination with any other potential donors (i.e., with conditioning), this non-donor was correctly eliminated. For the 3:1 mixture, all results correctly supported that the non-donors were not contributors. The low-template 4:1 mixture LRs with no conditioning showed support for all eight profiles as donors. However, the results from pair-wise conditioning showed that only the two ground truth donors had LRs supporting that they were contributors to the mixture. We recommend the use of peak heights and conditioning profiles, as this allows better sensitivity and specificity even when the persons share many alleles.  相似文献

The MMPI has been used extensively in the selection of law enforcement personnel. Because police officer candidates have been preselected, however, individuals with obvious mental disturbance have been screened out of the candidate pool before evaluation. It is necessary to search for more subtle variables to serve as predictors of unsatisfactory future performance. The L scale is a subtle variable which can suggest potential for problematic behavior. Neighborhood conservation is an objective widely espoused byAmerican cities. But movement from advocacy of conservationto allocation of funds for specific neighborhoods involves difficultpolitical choices for local officials who must respond to neighborhoodscompeting for scarce resources. The experience of Rochester,New York, the state's third largest city, closely parallelsthe national experience—shifts away from renewal and clearanceactivities to conservation and rehabilitation of marginal urbanneighborhoods. Over the first six years of the CDBG program,Rochester officials changed from a general, inclusive approachto neighborhood conservation to a more targeted approach. Thesechoices were shaped in response to local economic, demographicand political factors, including a well-organized network ofneighborhood organizations.
