Human Rights in the Scottish Courts

This article looks at the use made of the human rights legislation in the Scottish courts since the devolution of legislative and executive power to Scotland, based on research undertaken in all the ordinary courts, but excluding tribunals. It concludes that the incorporation of the Convention via the human rights legislation has had significant effects within the Scottish court system and on policy development without amounting to a major upheaval.     

Human Rights in Policing: The Past,Present and Future

This article seeks to demonstrate, largely from practitioners’ perspectives, the growing evolution in understanding and implementation of meaningful human rights standards within the policing context. In the early 2000s, human rights were perceived and treated as a rather restrictive framework in UK policing. They are now more readily seen as a set of tools that guide and help the police to balance the views and interests of all parties to the criminal justice process. Human rights values enable police in the UK to better endeavour to do the right thing, ‘without fear or favour’.     

The Impact of Increased State Regulation of Campus Sexual Assault Practices: Perspectives of Campus Personnel

ABSTRACT

Seeking to improve university accountability and compliance with federal mandates, states are considering new reforms including mandating reporting of campus sexual assault allegations. These new policies remain an empirical “black box.” To address these gaps, the current exploratory study draws upon a recent survey that examines the extent of awareness, perceptions, concerns, and policy practices of victim advocates and other personnel concerning new legislation. Virginia is chosen as the state for this case study given its recent implementation of a controversial mandated reporting law, as well as other initiatives, across institutions of higher education. Findings suggest that campus personnel are aware and largely supportive of the new reforms, but they also share concerns. Implications for research and policy development are discussed.     

Legislative Institutions as a Source of Party Leaders' Influence

Legislators' actions are influenced by party, constituency, and their own views, each weighted differently. Our survey of state legislators finds that legislator's own views are the strongest influence. We also find that institutions are an important source of party leaders' influence. Legislators in states where members rely more on party leaders—states without term limits, with less professional legislatures, and where the majority party controls the agenda—put more weight on leaders' preferences. Beyond direct party influence, the views of party leaders are preemptively incorporated into legislators' preferences when the rules of the legislature make party leaders more powerful.
