German family courts have a long‐standing tradition of hearing the child's voice when proceedings affect the child. This article aims to provide an overview of the German procedural rules. The current role and practice of child hearings in family courts and the direct effects on the child are discussed in detail. The perceived benefits, challenges, and pitfalls are deliberated from the viewpoint of the psychological expert. Hearing the voice of the child in person is increasingly viewed as beneficial to the proceedings if the judges and other professionals involved possess the necessary qualifications and competence. 相似文献

Each year, the United States invests about $45 billion in research conducted by federal researchers within federal laboratories. These efforts generate extensive social benefits when results are transferred to the private sector. It is important that we effectively quantify the economic and societal impact of federal technology transfer activities to inform taxpayers and policymakers about the value of public investments in this form of research. The Argus II device, an artificial retina commercialized in the United States by Second Sight in 2013, provides a rich example of how private sector innovation can be enhanced by research collaborations with federal labs and academia. Over the 25-year journey from idea to product, Second Sight carried out research and development collaborations with six Department of Energy national laboratories and seven universities. The case of Argus II also offers valuable insight into (1) how private industry, academia, and government can work together to bring socially beneficial innovations to fruition and (2) the tradeoffs inherent in these public–private collaborations. In this paper, we use a Markov model to estimate the realized and potential future social benefits associated with Argus II. We provide an interactive tool that can be used to replicate our findings and modify assumptions using updated patient information as it becomes available. We also provide insight into the aspects of federal involvement surrounding the development of Argus II that contributed to its successful commercialization and discuss other spillover benefits from these public–private collaborations. 相似文献

The Republic of Ireland has been convulsed by a series of police corruption scandals over the past fifteen years and they show no sign of abating. In 2015, in an attempt to stem the consequent drain in public confidence in the Garda, the government established a Policing Authority which it presented as ‘the most important single change in the governance of the Garda Síochána in its history’. This article critically examines whether the new Irish Policing Authority can be interpreted as a successful adaptation of the traditional police authority concept to a parliamentary democracy policed by a single, national body. In particular, it considers whether it is equipped to shield the Garda and policing from the influence of partisan political and institutional interests, while at the same time deliver transparent democratic scrutiny of the Garda and policing on behalf of all sections of the community. 相似文献

This article offers an interdisciplinary analysis of the General Data Protection Regulation (GDPR) in the context of electronic identification schemes. Gov.UK Verify, the UK Government's electronic identification scheme, and its compatibility with some important aspects of EU data protection law are reviewed. An in-depth examination of Gov.UK Verify's architecture and the most significant constituent elements of both the Data Protection Directive and the imminent GDPR – notably the legitimising grounds for the processing of personal data and the doctrine of joint controllership – highlight several flaws inherent in the Gov.UK Verify's development and mode of operation. This article advances the argument that Gov.UK Verify is incompatible with some major substantive provisions of the EU Data Protection Framework. It also provides some general insight as to how to interpret the requirement of a legitimate legal basis and the doctrine of joint controllership. It ultimately suggests that the choice of the appropriate legal basis should depend upon a holistic approach to the relationship between the actors involved in the processing activities. 相似文献

Analysis of length polymorphisms at STR loci in the human genome has become a standard approach for comparative genotyping in many areas including disease research and diagnostics, parentage assessment, investigations of human diversity, and forensic science. The simultaneous analysis of multiple STR loci through multiplex PCR and multicolor fluorescence detection offers sample conservation, high throughput, and automated genetic analysis. Careful design and optimization of tetranucleotide STR multiplexes has led to reliable, standardized systems that powerfully differentiate and distinguish individual human DNA profiles. The development of these multiplex systems involved a rigorous experimental strategy that included careful selection of PCR primer sequences (for yield, specificity, and multiplex compatability), along with optimization of PCR component concentrations, thermal cycling parameters, and fluorescence detection conditions. This developmental approach rendered well-characterized DNA typing systems that are high performing (sensitive, specific, and balanced), optimized to universal parameters (same reaction conditions), resilient to fluctuations in reaction conditions, and simple to implement and use routinely. 相似文献

This article evaluates the role of increased capital mobility, sectoral interests, and domestic institutions in bringing about policy change in French capital markets. Capital mobility played an indirect role by making it more costly for French governments to pursue inflationary economic policies. But it was domestic politics, not capital mobility, that led governments to achieve lower inflation by stabilizing the exchange rate. The key domestic political factor was institutional change to regulatory practices, while financial markets reduced bank lending to industry and internationalized French finance, breaking the strong ties and comon monetary diplomacy interests of bankers, industralists, and policymakers, and thereby weaken the political priority of promoting domestic growth and industrial competitiveness. 相似文献

Well constructed sub-population databases are fundamental to the application of DNA-based forensic statistics. The size of such databases can affect the ability to examine adequately statistical or population genetic features, and the integrity of both the DNA profile and associated ethnicity information is also of importance. Use of short tandem repeat (STR) DNA profiling technology and the thoughtful construction of the governing legislation has seen large databases of DNA profiles collated for the four major sub-populations of New Zealand.
