涉外劳动合同的法律适用问题研究

对涉外劳动合同的法律适用,我国学术界存在很大的争议,司法实践也存在不同的做法。主要有适用《合同法》第126条与适用劳动法两种观点。从劳动合同的本质来看,应该承认涉外劳动合同中存在法律冲突。为了更好地保护劳动者,要进行法律的相应完善,这可以从对当事人的意思自治进行限制,引入保护弱者利益原则和直接适用的法理论来着手。

Developments in pharmacists' disciplinary processes and outcomes

Pharmacy disciplinary processes and outcomes protect consumers by deterring pharmacists from unacceptable practices and maintaining the reputation and standing of the pharmacy profession. It is important that pharmacists are informed of disciplinary processes and outcomes in order to predict what is regarded as unacceptable behaviour and the potential consequences thereof. Disciplinary procedures and outcomes also play an important role in maintaining public trust in the pharmacy profession and it is therefore important that the public has confidence in the disciplinary structure. The outcomes of pharmacy disciplinary cases that reflect the patient care role of pharmacists are particularly important in helping to determine pharmacists' changed professional responsibility and potential legal liability in the provision of these patient care services.     

Age estimation of Korean children based on dental maturity

The aim of this study was to evaluate the relationship between age and dental maturity and to establish the standard database of dental maturity based on the Demirjian's stages, which can be used for the age estimation of Korean children. For this purpose, dental maturity was measured by the Demirjian's stages on a randomly selected sample of panoramic radiographs taken from 2706 patients between 1 and 20 years of age and analyzed by multiple linear regression analysis based on the method of least squares. The results showed that, except for the third molars, the development of permanent teeth in Korean children was more advanced in females. The Demirjian's stage G of the second molar appeared last in both male and female subjects by age 18, showing 95th percentile at age in the male and female subjects between 16.7-17.4 years and 17.1-17.3 years, respectively. Coefficients of determination (r(2)) of the Demirjian's stages relative to age in regression analysis were 0.9721 in male and 0.9740 in female subjects. The standard error was 0.63 years in male and 0.62 years in female subjects. The estimated age according to regression analysis was within +/-1.0 year of the actual age in 92.0% of male and 92.5% of female subjects. Collectively, the data of the present study can be used as a reference for dental maturity and a standard for age estimation of Korean children.     

Characterization of lesions in hanging deaths

Hanging is a common method of committing suicide and a routine task in medico-legal autopsies. The hanging mark is the most relevant external sign and its characteristics are well known, but, for unknown reasons, there are major differences in reports on internal findings. We retrospectively studied 228 consecutive cases of hanging deaths. A complete standard autopsy was performed for every case. We investigated the association between the characteristics of the hanging mark and the frequency of bone, cartilage, soft tissue, and vascular injuries with the mode of suspension. Most cases (75.3%) presented some kind of bone or cartilage fracture, but these were unrelated to any of the variables studied. Vascular lesions are clearly more infrequent: intimal injuries were found in the carotid artery (9.1%), the jugular vein (2.2%), and ruptures of the carotid adventitial layer (21.7%). These could be partially associated with the use of a hard fixed noose and body weight.     

Using Student Risk Factors in School Violence Surveillance Reports: Illustrative Examples for Enhanced Policy Formation, Implementation, and Evaluation

This article presents information about the range and type of violent and associated behaviors that occur on American school campuses. We argue that the prevailing practice of reporting single‐item population estimate trends from school violence surveillance surveys provides an incomplete basis upon which to form and evaluate public policy related to school violence. The presentation draws upon information derived from the 1993, 1995, 1997, and 1999 Centers for Disease Control's Youth Risk Behavior Surveillance (YRBS) surveys (CDC 1995, 1996, 1998, 2000) and the 1997–1998 California Student Survey (CSS) (Austin et al. 2001). Secondary analyses using the YRBS and the CSS are used to illustrate the importance of considering risk and school adjustment patterns when examining school violence trends to formulate public policy agendas.

Misconduct allegations and higher education in a southern sheriff’s department

The purpose of this research is to determine if a relationship exists between education level and misconduct allegations for patrol deputies. Official data from 231 deputies were collected from a large sheriff’s office in the Southeastern United States. Significant relationships were found between education level and the number of misconduct allegations, administrative referrals, and sustained allegations. While some college exposure may be beneficial for job performance, a four-year degree might not yield the anticipated benefits.
